HomeMy WebLinkAboutResolutions - 1959.10.25 - 19183Misc. 3590 RESOLUTION By: Mr. Fred W„ Smith IN RE: AMENDMENTS TO OAKLAND COUNTY EMPLOYEES RETIREMENT PLAN TO THE OAKLAND COUNTY BOARD OF SUPERVISORS Mr. Chairman, Ladies and Gentlemen: WHEREAS, the present provisions of the County Retirement Plan do not include the Circuit Court Judges of Oakland County, and WHEREAS, the State Retirement System provides benefits only on that portion of the salary of Circuit Judges paid by the State, and the proposed amendments hereto will provide benefits only for that portion of salary paid by the County, and WHEREAS, your Retirement Commission deems it only fair that these offici a ls should acquire retirement benefits commensurate with the total salary paid for these positions in the same manner as other County officials and employees receiving their salaries solely from County funds provided no duplication of benefits result, and WHEREAS, the Actuary has estimated the costs of such inclusion to be approximately $4200 per year starting in the budget year 1'261, and WHEREAS, the Ways and Means Committee and the Salaries Committee concur in these recommendations. NOW THEREFORE BE IT RESOLVED that the Supervisors Resolution establishing the Oakland County Employees' Retirement Plan as amended be further amended as follows: 1. That section 2(r) be amended to read as follows: "Employee" means any person, not excluded in section 16(b) hereof, who is in the emky of the County and who receives from funds of the County 40 per cent or more of a.: ru:nuneration received by him for personal services rendered to all governmental units. 2. That section 16(b) be amended to read. as follows: (ID) The membership of the Retirement System shall not include (1) employees of the Board of County Road Commissioners, (2) any i:::,erson encjaiTed for special services on a contract or fee basis, (3) the Medical Directx, (4) the Actuary, and (5) any employee who is inc'iuded law as an active or inactive member mf any other retirern.F:nt systt.wi, except the Federal . social security survivors, and disaLiiity insurance program, by reason of the remuneultien paid him by the County. Smith ' • Delos Hamlin RETIREMENT COlvIMITTEE Misc. 3590 3, That section 19 be amended to read as follows: (a) The Retirement Commission shah fix and determine by appropriate rules and regulations haw much service rendered by a member in any fiscal year is ecuivalont to a year of service: Provided, That in no case shah less than days of service rendered in any cahmdar month be credited as a month of service; nor shall less than 10 months of service rendered in any calendar year be credited as a year of service; nor shall more than one year of service be credited for any member for all service rendered by him in any calendar year. (b) Any employee of the County who is not a member of the retirement system and who subsequently becomes a member shall have the past service rendered by him in the ein;sioy of the County credited to him: Provided, That he pays into the employees savings fund an amount equal to the amount his accumulated centrilautions would have been, as of the date ha becomes a member, had he been a member from the date of his entry in County employment or January 1, whichever dote is later. Payment of his said accumulated contributions shall be due as af the date his membership in the retirement system becomes effective and rear interest shah be added to any unpaid balances from and after the said due date. Payment of said accumulated contributions, together with reviler interest from the date due to the date paid, shall be made in accarcarree with such rules and regulations as the Retirement Commission shah adopt: Provided, That no such member shall receive credit for any such past service until he has paid into the employees savings fund all payments duo the fund by him for such past service.
