McCULLOCH, CHAIRPERSON SHERIFF'S DEPARTMENT - CONTRACT FOR CROWNTRAFFIC CONTROL AT THE NEW PINE KNOB MUSIC THEATRE - 1992 SEASON TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Arena Associates, Inc., the operator of a summer theatre facility called The New Pine Knob, has requested the Oakland County Sheriff's Department to supply Patrol Officers for crowd and traffic control for the upcoming 1992 season; and WHEREAS, the Sheriff's Department has agreed to supply such Patrol Officers on an availability overtime hourly basis, the number of man-hours to be determined by the Sheriff's Department; and WHEREAS, The County of Oakland shall be reimbursed for such services by Arena Associates at the hourly overtime rates for the 1992 season, as was established by Miscellaneous Resolution #91181. NOW THEREFORE, BE IT RESOLVED, that the Oakland County Board of Commissioners approve the execution ot the attached contract consistent with provisions contained therein. Mr. Chairperson, on behalf of the Public Services Committee, I move the adoption of the foregoing resolution. PUBLIC SERVICES COMMITTEE IHEREBYAI"r""c71-`r (InFGOINIG RESOLUTION f " _ 1171/1/ McCULLOCH, Chairperson REFERENCE: Oakland County Board of Commissioners Miscellaneous Resolution t AGREEMENT THIS AGREEMENT, made and entered into this day of 1992, by and between the COUNTY OF OAKLAND, a Michigan Constitutional Corporation hereinafter called "County," and ARENA ASSOCIATES, INC., hereinafter called "Pine Knob," and WHEREAS, Pine Knob is the operator of an entertainment theatre in Independence Township and the County of Oakland; and WHEREAS, Pine Knob, due to the absence of sufficient police traffic services, and in recognition that said traffic services are required on the public roads, hereby contracts with the County of Oakland to assure against the lack of said traffic control on public streets adjacent to Pine Knob; and WHEREAS, Pine Knob agrees that staffing will be in coordination with the Sheriff's Department with regard to traffic assignments on the public roads adjacent to Pine Knob at times before and after performances at said theatre; and WHEREAS, all or certain of the performances may require crowd control within the theatre grounds; and WHEREAS, Pine Knob agrees to notify the County in advance of its requirements for deputies and pay the sum of $46.68 per hour for Lieutenant, $41.63 per hour for Sergeant, and $35.96 per hour for Patrol Deputy worked including court time, to the County, said sum to be paid monthly, and WHEREAS, the County is agreeable to provide a number of officers that the Oakland County Sheriff's Department may have — . • available for such purposes for the consideration hereinafter set forth during the 1992 season. NOW, THEREFORE, in consideration of the mutual promises of the parties hereto, it is agreed as follows: 1. During 1992 at Pine Knob, for each performance and reasonable times immediately before and after such performances the County will provide, under this Agreement, Sheriff's Deputies to provide traffic control on the public roads adjacent to the Pine Knob performance. 2. During the 1992 season at Pine Knob, for each theatre performance, the County shall provide Sheriff's Deputies as set forth above, to provide for the reasonable control and maintenance of order within the theatre grounds. 3. It is anticipated that the "average attendance" of Pine Knob events in the 1992 season will be 7500. For an event where attendance is expected to be approximately 7500, the parties agree that the following police staffing will be provided: Ingress Traffic Control 1 - Deputy (4 signal light of N.B. 1-75 Sashabaw Ramp 1 - Deputy (4 N.B. Sashabaw and new South Drive entrance 1 - Deputy @ N.B. Sashabaw and North Drive entrance Venue Police 1 - Sergeant as supervisor positioned at Police Trailer 2 - Deputies to patrol venue/parking lots * - Once traffic clears, two (2) of the traffic Deputies will assist as venue patrol Perimeter Control 1 - Deputy assigned perimeter control Central Cash Room 1 - Deputy to arrive two (2) hours prior to door time assigned to cash room 1 - Deputy to arrive 1/2. hour prior to event time to escort the cash pulls * - Once traffic clears, the third traffic Deputy is assigned to assist cash pulls Egress Traffic Control 1 - Deputy @ Pine Knob Road and Waldon Road intersection 2 - Deputies at Waldon and Sashabaw intersection signal (starting time prior to show end) 2 - Deputies @ North Drive and Sashabaw signals * 1 Deputy @ Sashabaw and NB 1-75 on Ramp. N.B. 1-75 Sashabaw Ramp signal light will switch to flashing * - Of these above listed traffic Deputies, one (1) will remain, one (1) hour after traffic clears to patrol immediate neighborhood areas. Venue Police (As Event Ends) 1 - Sergeant as supervisor positioned at Police Trailer 2 - Deputies assigned to venue patrol Central Cash Room 1 - Deputy to remain in cash room until cash pulls completed 1 - Deputy assigned to cash room to assist with final cash pulls. Combined Total = 11 Officers Police staffing levels may be adjusted up or down by mutual agreement based upon factors such as an anticipated variation from the average attendance and the type of entertainment being provided. Any disputes regarding staffing levels shall be resolved between the OCSD Business Manager and the Arena Associates Director of Facility Administration. 4. The County shall bill Arena Associates, whose address is: Palace of Auburn Hills, Two Championship Drive, Auburn Hills, Michigan 48326, Attention: Pete Hess; for such services on a monthly basis at the end of each month beginning May 31, 1992 and Pine Knob shall pay such bill 15 days after billing. Interest of 1% each month shall be paid on any outstanding balance from and • after due date until paid. 5. Pine Knob shall supply all parking, road, and informational signs as required by Independence Township. 6. Pine Knob shall provide an emergency exit for police and fire vehicles as required by Independence Township. . 7. County shall comply with all laws, ordinances, rules, regulations, and orders of any public authority bearing on the performance of the work to be performed by the County. 8. County shall be responsible for all the acts and omissions of its Deputies which it acknowledges and agrees are in the status of independent contractors and not employees or agents as to Pine Knob. 9. County shall assume responsibility for the conduct of its Deputies in performing their duties while acting within the scope of their employment on the public roads and/or theatre grounds in accordance with the terms of this Agreement. 10. County agrees to pay all taxes in connection with the work of its Deputies pursuant to the Agreement and to provide pay for any and all related employee benefits of its Deputies. 11. This Agreement shall terminate on December 31, 1992 or at any time that Pine Knob shall be in default.
