Present: Chairman Chadwick, Member Ball, Member Felton, Member Zabitz Absent: None MINUTES OF NOVEMBER 5, 2003 Motion by Ball, seconded by Felton, CARRIED UNANIMOUSLY: To approve the minutes of the November 5, 2003 meeting of the City Board of Canvassers. CANVASS OF GENERAL ELECTION OF NOVEMBER 2, 2004 This meeting was called in accordance with the provisions of Public Act 65 of the Second Extra Session of 1963, which provides for a City Board of Canvassers of four members, and pursuant to all requirements of said Act to certify votes cast, for local propositions, in the General Election held on November 2, 2004. The members received the sealed envelopes, containing the Optical Scan Tabulator Tapes, Statement of Vote AERO Reports, and Poll Book Summary Sheets as submitted by the Election Board. Each precinct was reviewed by the Canvassing Board and results were certified as follows: CITY OF OAK PARK BALLOT PROPOSALS NO. 2004-01 AND NO. 2004-02 Motion by Chadwick, seconded by Ball, CARRIED UNANIMOUSLY: To adopt the following resolution: WHEREAS, At the General Election, held in the City of Oak Park, County of Oakland, Michigan, on November 2, 2004, between the hours of 7:00 o'clock A.M. and 8:00 o'clock P.M., Eastern Daylight Time, the propositions hereinafter set forth were submitted; and WHEREAS, Returns from the voting precincts at said election have been filed with the City Clerk and have been presented to and examined by the Board of Canvassers. d ' 3":7 • • City Board of Canvassers November ;, 2004 Page 2 NOW, THEREFORE, BE IT RESOLVED THAT: The Board of Canvassers hereby determines that the votes cast at the said election held on November 2, 2004, on the City Proposals were as follows: BALLOT PROPOSAL No. 2004-01 (Annexation of Bridgewater Apartments) Shall the following described territory, located in the Charter Township of Royal Oak, Oakland County, Michigan, be annexed to the home rule City of Oak Park, Oakland County, Michigan, in accordance with the provisions of MCL 42.34(5) and MCL 42.34(6)? Land in the Township of Royal Oak, Oakland County, Michigan, described as: PARCEL I: Part of the S.W. 1/4 of Section 19, T.1N, R.11E., Royal Oak Township, Oakland County, Michigan, being more particularly described as follows: Beginning at a point which is due south 626.00 feet from the West 1/4 corner of Section 19, T.1N, R.11 E.; Thence S 89° 34' 47" E 1282.76 feet; Thence S 00° 51' 25" W 702.21 feet; Thence N. 89° 22' 35" W 1272.30 feet; Thence due north 697.32 feet to the point of beginning. PARCEL II: • Part of the Southwest 1/4 of Section 19, T.1N, R.11E, Royal Oak Township, Oakland County, Michigan, being more particularly described as follows: Beginning at a point which is due West 882.83 feet, along the East and West 1/4 line of Section 19, and S 00° 27' 00" W 423.00' from the center post of Section 19, T. 1 N., R. 11 E.; Thence S00° 27' 00" W 904.62'; Thence S89° 55' 00" W 410.30'; Thence N 00° 27' 00" E 1328.22'Thence due East along the East and West 1/4 line of Section 19, 205.04'; Thence S 00° 27' 00" W 423.00'; Thence due East 205.26' to the point of beginning. VOTES CAST IN FAVOR OF THE PROPOSITION: 6,547 VOTES CAST AGAINST THE PROPOSITION: 5,868 There being a majority of the qualified electors of the City of Oak Park voting at said election having voted for the proposition, it is hereby determined that the Proposition No. 2004-01 passed. • • City Board of Canvassers November 3, 2004 Page 3 BALLOT PROPOSAL No. 2004-02 (Annexation of Lincoln Woods Apartments) Shall the following described territory, located in the Charter Township of Royal Oak, Oakland County, Michigan, be annexed to the home rule City of Oak Park, Oakland County, Michigan, in accordance with the provisions of MCL 42.34(5) and MCL 42.34(6)? Land in the Township of Royal Oak, Oakland County, Michigan, described as: A parcel of land in the East Half (1/2) of Southwest Quarter (1/4), Section 19, Town 1 North, Range 11 East, Royal Oak Township, Oakland County, Michigan, described as follows: Commencing at a point 883.00 feet West from center post of said Section 19, and thence South 0 degrees 29 minutes 30 seconds West 423.00 feet, thence West 205.26 feet, thence North 0 degrees 29 minutes 30 seconds East 423.00 feet, thence East 205.26 feet along the East and West Quarter (1/4) Section line to point of beginning, subject to rights of the public in the Northerly 43 feet of said parcel for public roadway purposes. VOTES CAST IN FAVOR OF THE PROPOSITION: 7,041 VOTES CAST AGAINST THE PROPOSITION: 5,287 There being a majority of the qualified electors of the City of Oak Park voting at said election having voted for the proposition, it is hereby determined that the Proposition No. 2004-02 passed.
