CITY BOARD OF CANVASSERS
NOVEMBER 4, 1987
The Meeting of the City Board of Canvassers was called to order by
Chairman Chadwick at 4:00 P.M.
PRESENT: Chairman Chadwick, Members Black, Mortin, Passerman,
City Clerk McAllister-Arms
ABSENT: None
This meeting was called in accordance with the provisions of Public Act
65 of the Second Extra Session of 1963, which provides for a City Board
of Canvassers of four members, and pursuant to all requirements of said
Act to certify votes cast in the General Election of the City of Oak
Park held on November 3, 1987. The purpose of this election was to
elect a Mayor for a two-year term and two Council members for four-year
terms; and to determine the votes cast at said election on the
following Proposals:
PROPOSAL A
Shalt Section 13.1 of Chapter 13 of the Charter of the City of Oak
Park be amended to authorize the City Council to establish by
ordinance, rather than by Charter, the respective dollar amounts
in excess of which comparative prices or competitive bids must be
obtained in connection with the purchase or sale of said property,
including materials and supplies and public improvements, and to
authorize the Council, upon certification of the City Manager, to
waive the receipt of sealed bids where the materials, supplies or
public improvements are available only from a single source?
PROPOSAL B
Shall Section 13.2 of Chapter 13 of the Charter of the City of Oak
Park be amended to authorize the City Council to establish by
ordinance, rather than by Charter, the dollar amount of contracts
in excess of which approval of the City Attorney as to form and
legality and certification by the City Accounting Officer as to
availability of funds is required prior to execution of such
contracts?
The members received sealed envelopes containing the Statement of Votes
and Poll Books, designated for the City Board of Canvassers, as
submitted by the Precinct Election Boards. The Poll Books were
inspected as were the Statement of Votes and certified as follows:

Motion by Member Mortin supported by Member Black:

Board of Canvassers.
Motion carried unanimously.

Board's Certificiation.

PROPOSALS A & B - AMENDMENTS TO THE CITY OF OAK PARK CHARTER
These proposals to amend the City of Oak Park Charter will appear
on the Official Ballot as follows:

PROPOSAL A
Shall Section 13.1 of Chapter 13 of the Charter of the City
of Oak Park be amended to authorize the City Council to
establish by ordinance, rather than by Charter, the respec-
tive dollar amounts in excess of which comparative prices or
competitive bids must be obtained in connection with the
purchase or sale of city property, including materials and
supplies and public improvements, and to authorize the
council, upon certification of the city manager, to waive
the receipt of sealed bids where the materials, supplies or
public improvements are available only from a single source?

Shall Section 13.2 of Chapter 13 of the Charter of the City
of Oak Park be amended to authorize the City Council to
establish by ordinance, rather than by Charter, the dollar
amount of contracts in excess of which approval of the city
attorney as to form and legality and certification by the

The full text of the proposed amendments to Section 13-1
(Proposal A) and Section 13-2 (Proposal B) of the Oak Park Char-
ter, adopted by resolution of the City Council, is set forth
below:
Section 13.1 Purchase and sale of property.
The city manager shall be responsible for the purchase
and sale of all city property.
The council shall establish, by ordinance, dollar
amounts within which comparative prices shall be obtained
for the purchase or sale of all materials, supplies and pub-
lic improvements, except:
(a) In the employment of professional services or
(ID) When the city manager shall determine that no
advantage to the city would result.
In all sales or purchases in excess of a dollar amount
established by ordinance:
(a) The sale or purchase shall be approved by the
council,
(b) Sealed bids shall be obtained, except:
(1) Where the council shall determine by unani-
mous resolution of those present at the
meeting that the public interest will be best
served by joint purchase with, or purchase
from, another unit of government; or
(2) When the city manager certifies in writing to
the council that the materials, supplies or
public improvements needed to best serve the
interests of the city are available from only
a single vendor, supplier or contractor, the
council may waive the requirements of this
section for obtaining sealed bids; or
(3) In the employment of professional services.
(c) The requirements of section 13,2 shall be complied
with,
No sale or purchase shall be divided for the purpose of
circumventing the dollar value limitation required by this
section. The council may authorize the making of public
improvements or the performance of any other city work by
any city agency without competitive bidding.
Purchases shall be made from the lowest competent
bidder meeting specifications, unless the council shall
determine that the public interest will be better served by
accepting a higher bid. Sales shall be made to the highest
competent bidder, unless the council shall determine that
the public interest will be better served by accepting a
lower or different bid.
All purchases and sales shall be evidenced by written
contract or purchase order.
The city may not sell any park, cemetery or any part
thereof except in accordance with restrictions placed
thereon by statute.
The city may not purchase, sell or lease any real
estate or any interest therein except by the affirmative
vote of four or more members of the council.
The purchase and sale of all city property shall be
subject to the provisions of section 5,13.
Detailed purchasing, sale and contract procedures shall
be established by ordinance.
Section 13.2 Contracts,
All contracts and leases to which the city is a party
when this Charter becomes effective shall remain in full
force and effect.
The authority to contract on behalf of the city is
vested in the council and shall be exercised in accordance
with provisions of statute and of this Charter, provided
that purchases and sales may be made by the city manager
subject to the provisions of section 13.1.
Any contract or agreement in an amount in excess of an
amount established by ordinance made with form or terms
other than the standard city purchase order form shall
before execution be submitted to the attorney for approval
with respect to its form and legality. A copy of all con-
tracts or agreements requiring such approval shall be filed
in the office of the clerk together with a copy of the
approval.
Before any contract, agreement or purchase order
obligating the city to pay an amount in excess of an amount
established by ordinance is executed the accounting officer
of the city shall first have certified that an appropriation
has been made for the payment thereof, or that sufficient
funds will be available if it be for a purpose being
financed by the issuance of bonds or by special assessments
or for some other purpose not chargeable to a budget appro-
priation. In the case of a contract or agreement obligating
the city for periodic payments in future fiscal years for
the furnishing of a continuing service or the leasing of
property, such certification need not cover those payments
which will be due in future fiscal years, but this exception
shall not apply to a contract for the purchase or
construction of a public improvement unless such purchase or
construction is being financed by an installment contract
under authority of section 11,6. Certification by the
accounting officer of the city shall be endorsed on each
contract, agreement or purchase order requiring same or
shall be filed as an attachment thereto.
No contract or purchase order shall be subdivided for
the purpose of circumventing the dollar value limitations
required by this section.
No contract shall be amended after the same has been
made except upon the authority of the council, provided that
the city manager may amend contracts for those purchases and
sales made by him under the authority of section 13,1.
No compensation shall be paid to any contractor except
in accordance with the terms of the contract.
No contract shall be made with any person, firm or cor-
poration in default to the city.
An individual agreement of employment shall not be
deemed a contract requiring approval by the attorney or cer-
tification by the accounting officer of the city,
