MCCULLOCH, CHAIRPERSON IN RE: CIRCUIT COURT JUDICIAL SUPPORT GRANT APPLICATION/ACCEPTANCE TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS WHEREAS the State Court Administrative Office has limited funds available through a grant award from the Anti-Drug Abuse Act of 1988; and WHEREAS these funds are to provide assistance to trial courts, on the basis of demonstrated need, to expedite the adjudication of drug and drug-related cases; and WHEREAS the Circuit Court has applied for and has been awarded a judicial support grant to assist in the adjudication of drug and drug -related cases in the amount of $17,940; and WHEREAS $13,455 (75%) is the State portion and $4,485 (25%) is the County match which is included in the Circuit Court's 1992 Adopted Budget; and WHEREAS a visiting judge, outside court reporter services and current Court staff will be assigned to the grant therefore, no new personnel will be required; and WHEREAS the funds for this grant must be expended by September 30, 1992. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the Judicial Support Grant in the amount of $17,940. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the grant agreement and to approve amendments and extensions up to fifteen (15) percent variance from the award, consistent with the agreement as originally approved. Percent of caseload comprised of drug and drug-related statute violations: Approximately 15% of felony caseload. Please describe the conditions leading to the current backlog that are due to drug and drug-related statute violations (i.e. steady increase in enforcement, efforts of a grand jury investigation, unusual drug activity): Grand jury since 1989, charged with investigating major narcotics cases; major drug distribution networks conducting large scale operations: resignation of one judge has left a vacancy since May 12. Please describe the potential and actual impact on delay of drug and drug-related statute violation cases in your court: Volume of delayed trials on our Speedy Trial Report increases monthly; civil cases are continually pushed to the background. Please discuss what efforts been made to consider other alternative strategies or the use of sitting judges in the county area who may be available to address the backlog of drug and drug-related cases: We sought cooperation for a pilot project implementing Supreme Court Administrative Order 1991-5, but the district courts could offer little assistance; also we use video arraignments to speed the criminal process. Describe the support teams that you would plan to use and how these teams would be used if funds were granted: The team will consist of the visiting judge, the court reporter, and a court clerk. The secretary of the judge originally assigned to the case will provide secretarial services. The Assignment Office, working with the assigned judge, will identify appropriate cases and handle scheduling. The Circuit Court has applied for and has been awarded a judicial support grant to assist in the adjudication of drug and drug-related cases in the amount of $17,940. 2. The grant is 75% ($13,455) funded by the State and 25% ($4,485) is funded by the County which is in the Circuit Court's 1992 Adopted Budget. 3. A visiting judge, outside court reporter services and current Court staff will be assigned to the grant therefore, no new personnel are required. 4. The funds for this grant must be expended by September 30, 1992. 5. Corporation Counsel has reviewed and approved the grant contract as to legal sufficiency. 6.
