MCCULLOCH, CHAIRPERSON IN RE: DEPARTMENT OF PUBLIC SERVICES/CIRCUIT COURT PROBATION DIVISION-STUDENT INTERN/CASE AIDE GRANT ACCEPTANCE (3rd EXTENSION) TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the original application for the Student Intern/Case Aide Grant (Probation Enhancement Grant) requested a funding level of $69,140, to cover the period October 1, 1991 through September 30, 1992; and WHEREAS the Michigan Department of Corrections awarded funding in the amount of $23,948 for this grant, which was adopted by the Oaldand County Board of Commissioners on February 12, 1992 to cover the period October 1, 1991 through March 31, 1992; and WHEREAS the Michigan Department of Corrections granted extentions to provide continued funding as follows: Extension Period Amount Accum. Award 4/1/92 - 5/31/92 $7,983 $31,931 6/1/92 - 7/31/92 7,983 39,914 WHEREAS additional funding in the amount of $7,983 has been awarded to the County from the Michigan Department of Corrections to cover an extended period of August 1, 1992 through September 30, 1992; and WHEREAS the additional funding for $7,983 is approximately a sixty-seven percent (67%) variance from the original grant award for $23,948; and WHEREAS the attached contract has been approved by the County Executive's Contract Review Process; and WHEREAS this program is 100% state funded and does not obligate the County to any future commitment. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accept the extension of the 1991-1992 Student Intern/Case Aide Grant (Probation Enhancement Grant) in the amount of $7,983, for a total of $47,897. BE IT FURTHER RESOLVED that the future level of service including personnel, be contingent upon the level of state funding available for this program. BE IT FURTHER RESOLVED that the Chairperson of the Board is authorized to execute the grant agreement and to approve amendments and extensions up to fifteen (15) percent variance from the award, consistent with the agreement as originally approved. Murphy, County rxecutiv APPLIGATION FUNDS FOR JUDICIAL SUPPORT PROJECTS STATE COURT ADMINISTRATIVE OFFICE ANTI-DRUG ABUSE GRANT The State Court Administrative Office has limited funds available for trial courts to assist in the adjudication of drug cases. In order to qualify for assistance, the court will need to display an unusually high number of drug or drug-related cases which are the result of unusual enforcement activity or a significant backlog resulting from lack of adjudication resources. Each court receiving judicial support funds must agree to provide a brief follow-up questionnaire (approximately 2 pages) providing feedback on the impact of the judicial support funding. The State Court Administrative Office will distribute grant funds on the basis of demonstrated need to the extent that these funds are available. The funds will be used to reimburse trial courts for up to 75% of an agreed-upon amount (up to $20,000 per court) . These funds are to be used to provide visiting judges and support staff (clerk, bailiff and recorder) for the adjudication of backlogged drug or drug-related cases. Additional funding may be considered in situations of unusual circumstance or hardship if adequate documentation is provided. An effort should be made and presented that your court has explored the possibility of utilizing sitting judges in your county/area who may be available to address the backlog before a request is made for visiting judges. Section 5- COMPENSATION The STATE agrees to provide payment to the CONTRACTOR for allowable costs incurred during the performance of this contract. The maximum amount payable to the CONTRACTOR under this agreement is $47,897. Allowable costs are identified in the attached Budget Summary (Attachment B). The CONTRACTOR must secure the approval of OCC prior to the purchase of any equipment. Payments are subject to, and contingent upon, availability of funding from the legislature and/or executive branches. Payments may be limited, discontinued, or eliminated if the legislature fails to appropriate sufficient funds, or if an executive order, directive, or departmental decision limits, discontinues, or eliminates the ability of the STATE to make such payments. Payment for services shall be in accordance with the following schedule and terms: 1. The CONTRACTOR shall receive an advance payment in an amount equal of two month's funding upon signing of this Agreement. 2. Subsequent payments, if applicable, shall be based on the CONTRACTOR'S approved budget and reported expenditures. Any unexpended and non-encumbered funds shall be returned to the STATE within 30 days after the termination date of the contract. Box 30003 Lansing, MI 48909 All other conditions in the agreement covering the period October 1, 1991 to November 30, 1991, and entered into on December 4, 1991, as amended, shall remain in effect.
