HomeMy WebLinkAboutResolutions - 1964.10.26 - 19530October 27, 1964 RESOLUTION !Miscellaneous Resolution No. 4372 By: II Reference: 1: Drain Committee - Mr. Potter Condemnation - Cass Lake Level Project The Oakland County Board of Supervisors Mr. Chairman, Ladies & Gentlemen: WHEREAS, this Board, by Miscellaneous Resolution No. 3939, :.dated April 16, 1962, directed the Drain Commissioner, pursuant to the provi- sions of Act 146 of the Public Acts of 1962, as amended, to initiate the nee- i i essary proceedings to establish the level for Cass Lake; and WHEREAS, the Circuit Court for the County of Oakland has es- tablished the level of Cass Lake ; and WHEREAS, it is necessary to construct a dam to control the level of Cass Lake ; and WHEREAS, the Drain Commissioner has ne gotiated in good faith ; with the owners of certain parcel of property necessar y for the construction ,.iof the dam ; and Curtis Potter, Cnairman William T. Duncan Leonard Terry #4372 WHEREAS, the Drain Commissioner has been unable to acquire the necessary parcel of property; and WHEREAS, Section 15 of Act 146 provides for condemnation of !private property; NOW, THEREFORE, BE IT RESOLVED, that pursuant to the provisions of Act 146 of the Public Acts of 1962, as amended, this Board determines and !deems it necessary to condemn the following described parcel of property for the purpose of controlling the level of Cass Lake, to-wit: "That part of Lot 24 of "Beachland" Subdivision as platted in Liber 22, Page 3, Oakland County Records, lying in Waterford Township described as follows: Beginning at a point on the westerly line of Cass Lake Road; bearing North 25 °49' West 35.00 feet from the southeasterly corner of Lot 24; thence due west along the township line 97.24 feet to the east bank of the Clinton River; thence northwesterly along said east bank 91 feet to a point on the west- erly line of Cass Lake Road; thence South 25 °49' East along the westerly line of Cass Lake Road 64.28 feet to the point of begin- ning." Owners of Record being Joseph J. Corey and Marjorie, Corey, his wife. Mr. Chairman, on behalf of the Drain Committee, I move the Hadoption of the foregoing resolution. DRAIN COMITTEE Moved by Potter supported by Rehard the resolution be adopted. A sufficient majority having voted therefor, the resolution was adopted,
