HomeMy WebLinkAboutResolutions - 1965.01.12 - 19563RESOLUTION Miscellaneous Resolution No 4402 By: Drain Committee - Mr. Potter Reference: Bevins Lake Level Project To: The Oakland County Board of Supervisors Mr. Chairman, Ladies and Gentlemen: WHEREAS, this Board by Miscellaneous Resolution No. 3972 dated June 25, 1962 directed the, Drain Commissioner to establish the level of Bevins Lake accord- ing to the provisions of Act No. 146 of the Public Acts of 1961, as amended; and WHEREAS, the Circuit Court of Oakland County, upon recommendation of the Drain Commissioner, established the level at 910.40 feet above mean sea level; and WHEREAS, the Engineers retained by the Drain Commissioner have sub- mitted a report including plans, specifications and estimate of cost; and WHEREAS, negotiations are presently being conducted to acquire rights- of-way in the name of the County of Oakland necessary for the containment of a dam site or other device required for the purpose of achieving the normal level of said lake; I ! #4402 NOW, THEREFORE, BE IT RESOLVED 1) That the plans, specifications, and estimate of cost be accepted and approved; 2) That the Special Assessment District established by the County Drain Commissioner be accepted and approved; 3) That the County Drain Commissioner shall apportion the cost of the project to the benefited properties in the district, as near as may be, pursuant to the provisions of Chapters 7 and 9 of Act No. 40 of the Public Acts of 1956, as amended; 4) That the County Drain Commissioner be authorized to advertise for and to receive construction bids for the subject project; 5) That the Drain Commissioner be authorized to award the construction contract to the contractor submitting the lowest bid and who, in his judgment, is responsible and capable of performing such contract; 6) That the Bevins Lake Level Project be financed by the issuance of Lake Level Orders payable over an appropriate time period out of monies received in payment of the special assessments to be levied in the future, such time period shall not exceed seven (7) years. Mr. Chairman, on behalf of the Drain Committee, I move the adoption of the foregoing resolution.
