HomeMy WebLinkAboutResolutions - 1965.11.09 - 19646I ; I RESOLUTION 4493 Miscellaneous Resolution No. November 9, 1965 BY: Drain Committee - Mr. Potter, Chairman Reference: Duck Lake 11 TO: The Oakland County Board of Supervisors Mr. Chairman, Ladies Gentlemen: WHEREAS, certain interested citizens who are the owners of property fronting on Duck Lake located in Highland Township, Oakland County, Michigan, have filed a petition, directed to the Oakland County Board of Supervisors, requesting the drilling of a well or wells or any other devices k which will supply water to raise the level of said Duck Lake pursuant to the provisions of Act No. 146 of the Public Acts of 1961, as amended; and WHEREAS, said petition was signed by a number of freeholders H equal to at least two-thirds (2/3) the number of freeholders owning lands 1 abutting said Duck Lake and verification thereof has been made by the Oakland County Drain Commissioner, and WHEREAS, the Circuit Court for the County of Oakland, did on the 111 18th day of June, 1962, by Court Order No. L-54,394, fix and determine the III! normal height and level of said Duck Lake at an elevation of 1016.63 feet ij above mean sea level and did further approve the Special Assessment District as established for the Duck Lake Level Project, and H WHEREAS, due to the lack of sufficient run .=aff to replenish the supply of water in Duck Lake, it has been impossible, up to the present time to raise the level of said lake to the required height of 1016.63 feet; and , 44 93 WHEREAS, the property owners have deposited a total amount of Sixty Five Hundred ($6,500) Dollars to cover the costs incidental to drilling one test well and two observation wells, with appurtenances, in order to determine the feasibility of deep wells as a means of replenishing the supply of water in said Duck Lake. NOW THEREFORE BE IT RESOLVED, that, in the event test borings I indicate the availability of water in sufficient quantities, the Drain Com- missioner be authorized to proceed as follows: 1) To engage the services of a competent engineering firm to design such pumping facilities and appurtenances thereto as are necessary to raise the level of Duck Lake to the required height of 1016.63 feet. 2) To advertise for and receive bids for the construction of such facilities. 3) To award the construction contract to the contractor submitting 1-1 the lowest bid and who, in his judgment is responsible and capable of perform- ing such contract. H 4) To apportion the cost of the project to the benefited pro- oerties within the Special Assessment District, as near as may be, pursuant d to the provisions of Chapter 7 of Act No. 40 of the Public Acts of 1956, as amended. 5) To set a date and time at which the assessment roll will be open for review and to advertise such date and time of review. 6) To finance the construction of the Duck Lake project by the 11 issuance of Lake Level Orders payable over an appropriate time period out of H monies received in payment of the special assessments to be levied in the future, such time period not to exceed seven (7) years. - 2 - i xan.4 T.
