LiLLY SECRETARY PSEMEIER JOHN WITHERuP PERSONNEL ETW;ECTOR OAKLAND CouNrre Bomin OF AUDITORS OAKLAND COUNTY COURT HOUSE 1200 NORTH TELEGRAPH ROAO PONTIAC, MICHIGAN 48053 PHONE 338-4751 PROPOSED PERSONNEL POLICIES RESOLUTION To be Submitted to the Oakland County Board of Supervisors November 9, 1965 WHEREAS, the County of Oakland desires to recruit and retain the best possible employees; and WHEREAS, the County wishes to assure the continuity of good govern- mental administration; and WHEREAS, it is to the County's advantage to assure that the selection, pay, advancement and treatment of its employees is based on merit; and WHEREAS, the County can become eligible for certain Federal matching fund programs if its personnel policies and practices meet the Federal standards of a modern governmental merit system; and WHEREAS, because of the large amount of background work necessary to so develop the County's personnel practices, it appears advantageous to work out the administrative details before actually formalizing such policies into a merit system plan to be submitted to a vote of the people as provided by Article Xi Section 6 of the State Constitution; and WHEREAS, the earliest County-wide election at which such a merit system proposal could be voted on by the electorate would be the primary election scheduled for August of 1966, NOW THEREFORE BE IT RESOLVED that the following personnel policies be placed in effect January 1, 1966, that the Personnel Policies Board and the Board of Auditors develop the necessary operating rules, regulations and procedures by that date and that effective January 1, 1966, all of the County's departments, institutions and employees are requested to abide by the provisions of this resolution and give their utmost co- operation during this developmental period, AND BE IT FURTHER RESOLVED that the following personnel policies shall be placed in effect January 1, 1966. Page 2 I. The selection, pay, advancement and treatment of County employees shall be based solely on merit without reference to their political affiliation, religious beliefs, racial origin or sex. II. This resolution applies in its entirety to all employees paid by the County of Oakland, except: A. The employees of the Oakland County Road Commission; and B. No provisions covering the manner of selection, appointment, removal from office or limitation of political activity shall apply to: 1. Officers elected by popular vote, and persons appointed to fill vacancies in such offices. 2. Officers and employees for whom the Constitution specifically directs the manner of appointment. 3. Members of Boards and Commissions, officers and employees specifically required by law to be appointees of the Board of Supervisors, the Governor or other officials or official bodies. 4. One deputy or assistant to each of the elective offices, who in case of a vacancy in the elective office or inability of such elective officer to perform his duties, would be entitled to perform the duties of the office, until the vacancy is filled or the inability removed. 5. The attorneys and investigators employed by the Prosecuting Attorney's Office. 6. Those serving in temporary or part-time County positions. The Personnel Policies Board shall have final determination as to who shall be covered within the intent of these policies. III. The Personnel Policies shall be administered by a Personnel Policies Board made up of seven members of the Board of Supervisors, to be appointed by the Chairman of the Board of Supervisors, with the concurrence of the Board of Supervisors, for one year term to tun concurrently with the term of the Chairman of the Board of Supervisors. The Chairman of the Personnel Policies Board shall be selected by the Chairman of the Board of Supervisors and the members of the Personnel Policies Board shall receive the same per diem compensation and mileage as that paid to members of the Board of Supervisors. The Personnel Policies Board shall meet at such times and places as its Chairman shall designate or on the written request of three members. During this developmental period, the Salaries Committee of the Board of Supervisors shall be the Personnel Policies Board. Page 3 IV. The duties and responsibilities of the Personnel Policies Board shall include those of the Salaries Committee of the Board of Supervisors and in addition shall include: The preparation and enforcement of specific rules and regulations to carry out the provisions and intent of these policies; acting as the final County appeal body in all personnel matters involving covered County employees including the right to hear witnesses and review records and recommending to the Board of Supervisors on the provisions of all employee fringe benefit programs. V. The policies, rules and programs of the Personnel Policies Board shall be administered by the Board of Auditors, whose Director of Personnel shall be the Executive Secretary to the Personnel Policies Board. VI. The Personnel Policies shall provide: A. The continued maintenance of a formal classification plan and salary schedule. B. That all County positions shall be filled by the selection of all County employees on the basis of merit as measured by competitive examinations under rules and regulations promulgated by the Personnel Policies Board, except: 1. Those positions specifically exempted by the pro- visions of these policies, and 2. Incumbent County employees shall not be required to take competitive examinations for the classi- fications they hold as of the effective date of these policies and shall be given regular status in such classifications, and 3. Positions may also be filled by the transfer, pro- motions or re-employment of an employee with regular status in the County service provided the employee meets at least the minimum qualifications shown in the latest written specification of the classification of the new position, and 4. If it is necessary to fill a position before a com- petitive examination can be held, a person who meets the minimum qualifications for the classification can receive one non-renewable provisional appoint- ment for a period of not more than six months. C. That all County employees, except those exempted by the pro- visions of these policies shall be required to successfully complete a probationary period of six months before competitive appointments, or promotions shall be considered complete; at which time they will be deemed to have regular status in their classification. That employees with regular status shall not be separated from the County service or demoted except for cause, or for reasons of curtailment of work or lack of funds. E. That a formal appeal procedure be developed giving employees with regular status the right to appeal dismissals, suspensions, demotions and disciplinary actions to the Personnel Policies Board. Such procedure shall provide for the scheduling of a hearing within a reasonable length of time. F. That the political activities of covered County employees be limited to those allowed Federal employees under the Federal Political Activities Act (Hatch Act). However, employees shall have the right to express their views as citizens and to cast their votes. MR.
