HomeMy WebLinkAboutResolutions - 1992.12.10 - 19886December 10, 1992 MISCELLANEOUS RESOLUTION #92286 BY: PUBLIC SERVICES COMMITTEE, JOHN MCCULLOCH, CHAIRPERSON IN RE: PROSECUTING ATTORNEY - ACCEPTANCE OF 1992/1993 OAKLAND COUNTY NARCOTICS TASK FORCE GRANT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS Miscellaneous Resolution #89105 requires liaison committee review of grant acceptances that vary more than fifteen (15) percent from original grant applications; and WHEREAS the Oakland County Office of the Prosecuting Attorney applied for funding of the second year of the Oakland County Narcotics Task Force grant under authority of the Anti-Drug Abuse Act of 1988 for the period October 1, 1991 through September 30, 1992 in the amount of $1,077,285 (State - $646,371, County - $430,914); and WHEREAS the State of Michigan, Department of Management and Budget, Office of Criminal Justice has awarded Oakland County a grant of $211,315, which requires County match of $140,895 (40%) for a total program of $352,210 as detailed in Schedule A; and WHEREAS the objective of the Narcotics Task Force will be the investigation and prosecution of large scale drug conspiracies operating in Oakland County; and WHEREAS the grant continues funding for one (1) Assistant Prosecutor IV, one (1) Legal Secretary and three (3) Assistant Prosecutor III positions through September 30, 1993; and WHEREAS the attached contract has been approved by the County Executive's Contract Review Process. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the Prosecuting Attorney's 1992/93 Narcotics Task Force grant in the amount of $211,315 with a county match of $140,895 for a program total of $352,210 as shown on Schedule A. BE IT FURTHER RESOLVED that future level of service, including personnel, will be contingent upon the level of funding available through the State for this program and acceptance of this grant does not obligate the County to any future commitment. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the grant agreement and to approve amendments and extensions up to fifteen (15) percent variance from the award, consistent with the agreement as originally approved. REV2/92 OFFICE OF DRUG CONTROL POLICY ANTI-DRUG ABUSE ACT GOVERNOR'S DISCRETIONARY FUNDS APPLICATION INSTRUCTIONS The information in the application is necessary and essential for Office of Drug Control Policy grant administration and for completion of the federal reporting requirements. Review the following instructions and the Application Guidelines and Program Instructions carefully before completing this Application. A. Applicant Summary. 1. Agency Identification. Enter the name and address of the applicant agency. 2. Implementing Agency. Enter the name of the agency responsible for implementing the project. 3. Federal ID Number. Enter the Federal IRS Employer ID number for the applicant agency. 4. Project Title. Enter a descriptive title for this project, not to exceed two lines of 30 characters each. Use the same title from the previous year's grant if this is a continuation application. 5. Application Status. Check the appropriate box. If this is the first time this project has been funded to this applicant, check "New". If this project has been funded to this applicant previously, check "Continuation" and complete items 5a and 5b. 5a. Check the box which identifies the year of funding of this application. 5b. Enter the ODCP project number from the preceding year of funding. 6. Project Period. Enter the start date and end date of the project covered by this proposal. The project period for each grant is limited to 12 months. 7. Program Area. Enter the title of the Program Priority Area described in the Anti-Drug Abuse Act Application Guidelines under which this application is made. Each program priority area requires a separate application. 8. Civil Rights Contact Person. Provide the name, title, agency address and telephone number. Attach certification that a current Equal Employment Opportunity Plan which meets federal and state requirements is on file in the Office of Drug Control Policy. Submit a copy of the applicant EEO Plan if the certification cannot be made. 9. Project Contact Person. Provide the name, title, project address and telephone number. This person reports to the Project Director, is on-site and has responsibility for the day-to-day implementation of the project. The project contact should be familiar with the details of the project budget. This information is to be provided only if the Project Contact is a person other than the Project Director. The Project Director, Financial Officer and Authorizing Official must certify, by signature, that the information presented in the application is correct and that the applicant agency agrees to comply with all the provisions of the Anti-Drug Abuse Act and Governor's Discretionary Fund program. Project Director Identification. Provide the name, title, address and telephone number of the individual who will be directing this project. Financial Director Identification. Provide the name and title, address and telephone number of the individual who is fiscally responsible for this project. Authorizing Officer Identification. Provide the name and title of the individual authorized by the applicant agency to enter into this agreement. Office of Drug Control Policy prohibits the same person from signing as both the Project Director and the Financial Officer. 11. Jurisdiction. Name the county(ies) in which this project will operate. Identify the Michigan Senate District(s), Michigan Representative District(s), and U.S. Congressional District(s) that will be served by this project. Provide the population (number of people) to be served by this project, i.e., statewide, county, city and provide population count. 12. Service Impact. Check the appropriate box. Provide the total fiscal year drug enforcement budget for the two years requested. Indicate all major sources of funding in the categories provided (Federal, State, Local/Public or Private). Include the federal funds that you are requesting in the Federal source for the current year. 13. Budget Summary. Transfer the budget category totals from the Budget Detail to the appropriate category line in the Budget Summary. Be sure the amounts total down and across. B. Budget Detail. The purpose of the Budget Detail is to assist the applicant in developing a financial plan for their project and to provide the Office of Drug Control Policy with the projected costs required to implement the project. Cost projections must be reasonable and relate directly to the goals and objectives of the project. USE WHOLE DOLLARS ONLY. Budget projections should be only for the period covered by this proposal and may not exceed twelve months. Costs are subject to review and approval by the Office of Drug Control Policy. Please use the following definitions to determine the source of funding for each item in the budget detail. Federal Funds. Funds provided through Anti-Drug Abuse Act funding and Governor's Discretionary Funds from the Office of Drug Control Policy to the applicant agency. Grantee Match. Cash match appropriated by the applicant specifically for this project. No match required for Governor's Discretionary Funds. Total Funds. The combined total of federal funds and grantee match. C. Budget Narrative. This section should describe budget costs not fully explained in the budget detail. ODCP-701 REV 2/92 D. Program Narrative. There are five separate sections to the Program Narrative. Prepare each section according to the individual instructions provided. Limit your narrative to the pages provided. E. Assurances. The Assurances detail the conditions of the Agreement between the Office of Drug Control Policy and the applicant agency for Anti-Drug Abuse Act and Governor's Discretionary Funds funding if an application is approved. Review the Assurances carefully and understand that these requirements will become part of the grant contract when an award is made. F. Certifications. Review and have the Authorizing Official sign the Certifications of Debarment, Lobbying, Non-Supplanting of funds, and Equal Employment Opportunity Plan. G. Submission. The applicant assures that it will comply with the provisions of 28 CRF applicable to grants and cooperative agreements including Part H, Applicability of Office of Management and Budget Circulars; Part 18, Administrative Review Procedure; Part 20, Criminal Justice Information Systems; Part 22, Confidentiality of Identifiable Research and Statistical Information; Part 23, Criminal Intelligence Systems Operating Policies; Part 30, Intergovernmental Review of Department of Justice Programs and Activities; Part 42, Nondiscrimination Equal Employment Opportunity Policies and Procedures; Part 61, Procedures for Implementing the National Environmental Policy Act; and Part 63, Floodplain Management and Wetland Protection Procedures. 2. The applicant assures that it will comply with the provisions of the Office of Justice Programs' "Financial and Administrative Guide for Grants", M7100.1C. 3. The applicant assures that it will comply, and all its contractors will comply, with the non-discrimination requirements of the Anti-Drug Abuse Act; Title VI of the Civil Rights Act of 1964; Section 504 of the Rehabilitation Act of 1973, as amended; Title IX of the Education Amendments of 1972; the Age Discrimination Act of 1975; and the Department of Justice Nondiscrimination Regulations 28 CRF Part 42, Subparts C, D, E, and G. 4. The applicant assures that in the event a Federal or State court or Federal or State administrative agency makes a finding of discrimination after a due process hearing on the grounds of race, color, religion, national origin, or sex against a recipient of funds, the recipient agency will forward a copy of the finding to the Office of Civil Rights Compliance, Office of Justice Programs. 5. The applicant assures that it will formulate an Equal Employment Opportunity Program (EEOP), in accordance with 28 CRF 42.301 et. seq., and submit a certification to the state that it has a current EEOP on file which meets the requirements therein. 6. In accordance with the Elliot-Larsen Civil Rights Act and the Michigan Handicappers Civil Rights Act, a grantee or contractor must not discriminate against any employee or applicant for employment, with respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or indirectly related to employment, because of race, color, religion, national origin, ancestry, age, sex, height, weight, marital status or handicap. Failure to comply with this requirement is cause for cancellation of the grant. 7. In accordance with Executive Directive 1979-4 and Michigan Department of Civil Rights Standards and Procedures for Civil Rights Compliance in State and Federal Contracts, a grantee or contractor must have an established policy of equal employment opportunity without regard to race, color, religion, national original, age, sex or handicap. The grantee or contractor must take steps necessary to correct any underrepresentation and achieve a reasonably representative work force at all levels of employment. In addition, the grantee or contractor must: ODCP-701 REV 2/92 a. state in all recruiting materials and advertisements that all applicants will receive equal consideration for employment without regard to race, color, religion, national origin, age, sex or handicap, and b. post in conspicuous places notices setting forth the law on equal opportunity in employment and public accommodations. (Posters are available from the Michigan Department of Civil Rights.) 8. A grantee or contractor must inform the Office of Drug Control Policy of any federal or state actions, taken against the grantee or contractor, pertaining to equal employment opportunity requirements. 9. A grantee or contractor is required to keep employment or other records, used in preparation of the Minority-Female-Handicapper Status Report, Work Force Utilization Analysis and EEO Plan, six months beyond the life of the grant or contract to permit access by the Office of Drug Control Policy, Michigan Department of Civil Rights or other authorized persons as may be necessary to ascertain compliance. 10. The award of a grant is subject to acceptance of the required reporting forms and EEO Plan and a determination of compliance with Equal Employment Opportunity requirements by the Office of Drug Control Policy or the Michigan Department of Civil Rights. 11. A grant recipient must not furnish finished products to the State originating or manufactured in the Republic of South Africa; must not sell goods or services to the South African military, Department of Cooperation and Development, or national, provincial or local police or prison agencies, unless the grant recipient is a signatory of the Sullivan Principles and is in the two highest categories of progress; must not be controlled by a South African firm; and must not enter into a subcontract with an entity that does not comply with the conditions outlined above. 12. The project must be operational within 60 days of the original starting date of the grant period. The grantee must submit documentation to the Office of Drug Control Policy explaining the reasons for any delay, the steps taken to initiate the project, and the expected starting date. If the project is not operational within ninety (90) days of the original starting date of the grant period, the grantee must submit further documentation explaining the delay. The Office of Drug Control, Policy may at this time cancel the project, or extend the implementation date. 13. The applicant must comply with the data collection and reporting requirements established by the Office of Drug Control Policy. Failure to comply will result in ODCP action to withhold the release of funds. 14. Expenditures incurred prior to the effective date of the grant will be ineligible for funding. 15. No grant funds will be used for indirect administrative costs. 16. The applicant assures that anti-drug abuse grant funds made available under the Anti- Drug Abuse Act and Governor's Discretionary Funds will not be used to supplant state and local funds that would otherwise be available to verify that such charges are accurate. ODCP-701 REV 2/92 17. The applicant assures that fund accounting, auditing, monitoring, and evaluation procedures shall be provided to assure fiscal control, proper management, and efficient disbursement of funds received under the Act. 18. Accounting procedures shall provide for accurate and timely recording or receipt of funds by source, or expenditures made from such funds,and unexpended balances. Controls must be adequate to ensure that expenditures charged to grant activities are for allowable purposes and documentation is readily available to verify that such charges are accurate. 19. The applicant will maintain records to include copies of purchase orders and invoices of the purchase and rental of property approved by the Office of Drug Control Policy as allowable costs. The applicant will promptly notify the Office of Drug Control Policy when any property approved under the grant can no longer be reasonably used for the purposes stated in the application. 20. The applicant will comply with the audit requirements as specified in OMB Circular A-128, Audits of State and Local Governments, or 01VIB Circular A-110, Grants and Agreements with Non-Profit Organizations, and OMB Circular A-122, Cost Principles for Non-Profit Organizations. 21. If an audit report disallows costs, the grantee will forward the amount of the disallowed costs to the Office of Drug Control Policy within ninety (90) days of such notification. Failure to do so will result in such deficiency being reported to the Department of Treasury. 22. Funds awarded by the Michigan Office of Drug Control Policy may be terminated at any time for violation of any terms and requirements of this agreement. 23. The applicant assures that anti-drug abuse funds shall be used only to provide drug enforcement activities. 24. The applicant certifies that neither the agency or its officers are presently debarred, suspended, proposed for debarment, declared ineligible or voluntarily excluded from participation in this transaction by any Federal department or agency and agrees to sign the Certification regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion. 25. The applicant assures that all income (forfeitures) generated as a result of the grant project shall be deemed project income and must be used for the purposes of and under the conditions applicable to the use of grant funds. 26. The applicant assures that all funds forfeited and funds seized but not legally forfeited as a result of this grant project shall be kept in separate trust accounts. The funding for this unit will be provided by the County of Oakland and the state grant dollars. All costs are self- explanatory. -6- ODCP-70 1 REV 2/92 D. PROGRAM NARRATIVES PROGRAM NARRATIVE I. PROBLEM STATEMENT. Describe the problem exactly as it exists in your community. Define the nature and magnitude of the problem to be addressed through your proposal. Analyze the causes of the problem. Document statements with valid, current statistical data to clearly demonstrate why the problem exists. Identify the source and date of your information. If your project has been previously funded, describe present and past achievements and impact on the drug/violent crime problem in your community. OAKLAND COUNTY PROSECUTOR'S NARCOTICS TASK FORCE The problem in Oakland County is the existence of major drug distribution networks which continue their large scale operations despite the best efforts of existing law enforcement agencies. The members of these networks are repeat drug offenders who engage in foreseeable patterns of serious drug activity. Multi-jurisdictional "concept teams" are able to arrest and prosecute low level street dealers utilizing the primary investigatory technique of "undercover buys." However, this traditional law enforcement effort is not suitable for the successful penetration of the major distribution networks because street level dealers prosecuted for the possession or sale of small amounts of drugs receive lenient sentences and return to their illegal activities within a short period of time. Arrest and prosecution for these individuals is merely a cost of doing business. The criminal justice system operates a revolving prison door with no deterrent effect. Studies indicate that high echelon dealers deal with only a few people known to them, thereby insulating themselves from traditional ''undercover buys." Moreover, little, if anything, has been done to systematically identify or target major drug offenders and distribution networks. Concept teams suffer from structural weaknesses which prevent them from pursuing major distribution networks. These structural flaws include: a lack of permanent trained personnel; a continuing pressure for statistical success; a lack of unity of command; and pressures to respond to local "street problems'' faced by local contributing police departments. These structural weaknesses prevent concept teams from conducting an effective "war on drugs." The Oakland County Sheriff's Department submitted a 1991 Application for Anti-Drug Abuse Act Grant. The Sheriff's Department Application stated: According to the Narcotics Enforcement Team annual reports, the budget and manpower allocation for narcotics enforcement has experienced a significant increase over the past five years, yet the number of Class I and Class II dealers arrested and charged have actually decreased. One can conclude that traditional buy teams have no effect on major narcotics traffickers. The magnitude of the problem is easily understood by reference to the results of grand jury efforts over the past thirty (30) months in Oakland County. From September 1989, to March 1992, the grand jury has indicted 93 members of formerly secret, major drug organizations operating in Oakland County. The largest organization was dealing in approximately $1,000,000.00 of cocaine at the wholesale level weekly. The ringleader of the smallest organization was arrested by police while preparing to flee the jurisdiction in possession of nearly $600,000.00 in currency and gold which he had accumulated by drug dealing. -7- ODCP-701 REV 2/92 PROGRAM NARRATIVE II. PROJECT DESCRIPTION. Outline clearly in detail your overall project. Include a chronological plan of your goals (exactly what the project will achieve). Explain how project activities will attain these goals and impact on the problem stated. Include a description of project activities and position description of all positions to be funded by federal and match funds. The goal of the Narcotics Task Force is to target and destroy major drug distribution networks operating in Oakland County through effective use of a specially designated cadre of prosecutors assigned to work with a citizens grand jury and local law enforcement organizations. Through the assignment of four assistant prosecutors to the Task Force, all Class I, II, and Ill drug violators will be identified and prosecuted. Existing no plea policies will continue to be enforced. The Task Force will vertically prosecute all cases in which Level I, II, and ill are identified. The Task Force will be established as a separate unit within the Prosecutor's Office. It will be established to operate as though on a permanent basis. Utilizing an electronics communications system (pagers), a Task Force prosecutor will be available twenty-four hours a day to advise and assist law enforcement officers during any stage of investigations. POSITION DESCRIPTION I. CRIMINAL PROSECUTORS Four prosecutors will conduct grand jury investigations and vertically prosecute major controlled substance cases developed by the grand jury or otherwise presented to the task force by criminal investigative units. II. SECRETARY One legal secretary is needed to perform clerical and typist functions for the Task Force. -8- ODCP-701 REV 2/92 PROGRAM NARRATIVE III. PROGRAM OBJECTIVE. Objectives are specific, quantified indicators of expected results of the project. The objectives must be described in terms of measurable events that can be realistically expected under time constraints and available resources utilizing quantitative data. Objectives must be related to the problem. Describe who will do what, by when and why. The performance of the Narcotics Task Force will be measured by objective achievement. The expected results are that, by selectively targeting repeat and career drug offenders, the unit will: 1. Increase the number of Class I, II, and III violators identified, prosecuted and convicted; 2. Increase the number of Class IV and V violators who are identified, prosecuted, and convicted; 3. Decrease the time between arrest and disposition of criminal drug unit cases; 4. Increase forfeitures of drug related assets. The objective for the Narcotic's Task Force will be the investigation and prosecution of large scale drug conspiracies operating in part in Oakland County, as well as all Class I, II, Ill, IV, and V violators identified. -10- ODCP-701 REV 2/92 PROGRAM NARRATIVE IV. PERFORMANCE INDICATORS AND EVALUATION. State exactly how each objective will be measured and accomplished. Performance indicators (activities which evaluate and document your program's effectiveness), should be matched to your specific objectives. Specify the criteria and procedures to be used. Indicate how the project will demonstrate accountability and a measurable impact on the drug/violent crime problem. Identify the person responsible for the evaluation of this project. The performance and goal attainment of the Narcotics Task Force will be measured by evaluating: 1. The number of full-time prosecutors assigned to the unit; 2. The number of cases identified and investigated as meriting investigation by the Narcotics Task Force; 3. The number of defendants charged; 4. The number of defendants convicted; 5. The average time from charge through conviction of a defendant; 6. The number of Class I, II, and III defendants identified and convicted; 7. The number of Class IV and V defendants identified and convicted; 8. The number of individuals incarcerated; 9. The amount for drug related assets forfeited. The project director shall be responsible for conducting the quarterly evaluations. These evaluations shall be given to the Office of Criminal Justice quarterly and will be utilized to refine case selection and development of prosecution techniques for future investigations. -1 1- ODCP-701 REV 2/92 PROGRAM NARRATIVE V. PLANS FOR PROJECT PICK-UP WITH LOCAL FUNDS. Please describe the effort which will be made for local assumption/retention of the project after federal funding has expired. Specify the length of time this project will require federal funds. Utilizing demonstrated success, it is anticipated that county funding will be available to continue drug unit operations beyond the expiration of ADAA funding. The State of Michigan, Department of Management and Budget, Office of Criminal Justice has awarded the County a grant of $211,315, which requires County match of $140,895 (40%) for a total grant program of $352,210 as detailed in Schedule A, attached to the resolution. 3) The grant award continues funding for one (1) Assistant Prosecutor IV position, three (3) Assistant Prosecutor III positions, and one (1) Legal Secretary position, through September 30, 1993. County match requirements of this grant program are continued at 40% and is included in the 1992/93 Biennial Budget. 8) State guidelines do not allow grant funding for indirect administrative costs for this program, which equal $12,056.
