HomeMy WebLinkAboutResolutions - 1962.11.07 - 19943Miscellaneous Resolution 4054 November 7, 1962 BY: Mr. Levinson IN RE: TEMPORARY AGREEMENT FOR USE OF DOWNTOWN COURT HOUSE SITE To the Oakland County Board of Supervisors WHEREAS, the Board on January 25, 1962, approved the appointment of a Special Committee to study the use of the old Court House site, and WHEREAS, the Committee has since that date considered possible temporary use of the property with the City of Pontiac, and WHEREAS, the property was offered for sale and there were no bidders, and WHEREAS, the old Court House and adjacent building have now been demolished and the site is ready for other use, and WHEREAS, the City in a letter addressed to the Board on October 26, 1962, advised that they would prefer not to open negotiations for the purchase of this property by the City at this time temporary but would prefer that the Downtown Merchants open negotiations for/lease of the property as a parking lot, and WHEREAS, the letter from the Downtown Pontiac Business Association dated November 1 1962 offering to enter into an agreement with the County for the use of this property for free parking of shoppers in the downtown area was considered by the Committee at a meeting on November 5, 1962, and a resolution adopted to recommend to the Board a temporary agreement to lease said property to the Association for a period of 6 months, subject to a 10-day cancellation clause, for payment of consideration of $1.00, and WHEREAS, it is also recommended that the Association as tenant agree to pay for all improvements on the site, to maintain same in accordance with all City regulations and to carry a liability insurance policy with the County named as "additional insured", NOW THEREFORE, BE IT RESOLVED as follows: 'eSley Dcan Luther Flea-c-o-CI #4054 temporary That the Board of Auditors be authorized to enter into a/ agreement with the Downtown Pontiac Business Association, a Non-profit Corporation, for use of the downtown Court House site for a period not to exceed 6 months, subject to a 10-day cancellation clause after January 1, 1963, at an agreed rental of $1.00. temporary 2. That the/agreement include provisions for the tenant to improve and maintain the site in accordance with City regulations and hold the County harmless as to any public liability or property damage temporary 3. That such/agreement be entered into after approval of the Special Committee as to the terms and conditions thereof. MR. CHAIRMAN, on behalf of the Special Committee, I move the adoption of the foregoing resolution. A sufficient majority having voted therefor, the resolution was adopted.
