MISCELLANEOUS RESOLUTION # 92022

IN RE: DEPARTMENT OF PUBLIC SERVICES/CIRCUIT COURT PROBATION
DIVISION-STUDENT INTERN/CASE AIDE GRANT ACCEPTANCE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS the original application for the Student Intern/Case Aide Grant
(Probation Enhancement Grant) requested a funding level of $69,140, to cover the
period October 1, 1991 through September 30, 1992; and
WHEREAS this Student Intern/Case Aide Grant (Probation Enhancement
Grant) has been awarded funding in the amount of $23,948, as approved by the
Michigan Department of Corrections; and
WHEREAS the award stipulates this funding level for the period October 1,
1991 through March 31, 1992; and
WHEREAS the award for $23,948 is approximately a sixty-five percent (65%)
variance from the grant application of $69,140 as detailed in the attached schedule;
and
WHEREAS funding to continue the program beyond March 31, 1992 must go
through another application process; and
WHEREAS the grant award contract has been reviewed and approved as to
legal sufficiency by the Office of Corporation Counsel; and
WHEREAS this program is 100% state funded and does not obligate the County
to further commitment.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners accept the 1991-1992 Student Intern/ Case Aide Grant (Probation
Enhancement Grant) in the amount of $23,948.
BE IT FURTHER RESOLVED that the future level of service including
personnel, be contingent upon the level of state funding available for this program.
BE IT FURTHER RESOLVED that the Chairperson of the Board is authorized
to execute the grant agreement and to approve amendments and extensions up to
fifteen (15) percent variance from the award, consistent with the agreement as
originally approved.
Mr. Chairperson, on behalf of the Public Services Committee, I move the
adoption of the foregoing resolution.

DIVISION - STUDENT INTERN/CASE AIDE GRANT ACCEPTANCE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
Pursuant to Rule XI-G of this Board, the Finance Committee has
reviewed Miscellaneous Resolution # and finds:
1) The original application for the Student Intern/Case Aide
Grant (Probation Enhancement Grant) requested a funding
level of $69,140, to cover the period of October 1, 1991
through September 30, 1992.
The Michigan Department of Corrections has awarded
funding in the amount of $23,948 to cover the period of
October 1, 1991 through March 31, 1992.
The award for $23,948 is approximately a sixty-five
percent (65%) variance from the grant application as
detailed in the attached schedule.
Any additional funding for this grant beyond March 31,
1992 will require another application process.
This grant is 100% State funded and does not obligate the
County to further commitment.
Future level of service, including personnel, will be
contingent upon the level of State funding available for
this program.
The following amendments to the 1992 Adopted Budget are
recommended:

-AMENDMENT
AGREEMENT BETWEEN
THE STATE OF MICHIGAN
AND
OAKLAND COUNTY
COMMUNITY SERVICE PROGRAM

Section 4, and Section 5 of the agreement made and entered into on
1991, by and between the State of Michigan,
Office of Community Corrections (OCC), hereafter referred to as the
STATE, and Oakland County, Community Service Program, 1200 N.
Telegraph Rd., North Office Building, Pontiac, MI 48053, hereafter
referred to as the CONTRACTOR.
Section 4 - PERIOD OF PERFORMANCE
The term of this agreement shall be from October 1, 1991 to
March 31, 1992.
Section 5 - COMPENSATION
The STATE agrees to provide payment to the CONTRACTOR for
allowable costs incurred during the performance of this contract.
The maximum amount payable to the CONTRACTOR under this agreement
is $23,948.
Allowable costs are identified in the attached Budget Summary
(Attachment B). The CONTRACTOR must secure the approval of OCC
prior to the purchase of any equipment.
Payments are subject to, and contingent upon, availability of
funding from the legislature and/or executive branches. Payments
may be limited, discontinued, or eliminated if the legislature
fails to appropriate sufficient funds, or if an executive order,
directive, or departmental decision limits, discontinues, or
eliminates the ability of the STATE to make such payments.
Payment for services shall be in accordance with the following
schedule and terms:
1. The CONTRACTOR shall receive an advance payment in an
amount equal of two month's funding upon signing of this
Agreement.
2. Subsequent payments, if applicable, shall be based on the
CONTRACTOR'S approved budget and reported expenditures.
3. Any unexpended and non-encumbered funds shall be returned
to the STATE within 30 days after the termination date of

the contract. Returned funds shall be in the form of a
check made payable to the STATE OF MICHIGAN and mailed
to:

Lansing, MI 48909
All other conditions of the October 1, 1991 agreement shall remain
in effect.
IN WITNESS WHEREOF, the STATE and the CONTRACTOR have caused this
agreement to be executed by their respective officers duly
authorized to do so.
