BY: Mr. Levinson
IN RE: REQUEST TO OAKLAND COUNTY BAR ASSOCIATION TO STUDY EFFECT
OF PRE-TRIAL REQUIREMENT ON COUNTY OPERATING COSTS
TO THE OAKLAND COUNTY BOARD OF SUPERVISORS
Mr. Chairman, Ladies and Gentlemen:
WHEREAS, this Committee has been informed that the procedural changes in the
General Court Rules of 1963 as adopted by the Michigan Supreme Court, which went into
effect on January 1, 1963, require a pre-trial conference in every contested civil action
in the Circuit Courts; and
WHEREAS, this Committee has been informed that because of these conferences
there is an increasing back-log of cases awaiting trial in the Circuit Courts; and
WHEREAS, it appears that the intent of the pre-trial conference was in some
measure to expedite the trial of cases and it has been questioned whether this is being
accomplished; and
WHEREAS, This Committee feels that the Oakland County Bar Association could
offer this Committee assistance in evaluating the effectiveness of the new rules and their
effect on the case load in the Circuit Courts and costs to the County;
NOW THEREFORE, BE IT RESOLVED that the Board of Supervisors request the
Oakland County Bar Association to make a survey of the procedural changes in the New
Court Rules to determine what effect, if any, the changes are making on the case load in
the Circuit Courts and request that they report their findings to the Board of Supervisors
as soon as possible.
MR. CHAIRMAN, on behalf of the Ways and Means Committee, I move the adoption
of the foregoing resolution.
WAYS AND MEANS COMMITTEE
