Very truly yours, (A)\t Kerry Kamer City Clerk KK/fs CITY OF PONTIAC, MICHIGAN CHARTER AMENDMENT CERTIFICATE TO BE FILED WITH THE COUNTY CLERK PURSUANT TO THE PROVISIONS OF ACT NO. 279, P.A. of 1909, AS AMENDED STATE OF MICHIGAN) COUNTY OF OAKLAND) CITY OF PONTIAC ) I, the undersigned, the duly acting and qualified Clerk of the City of Pontiac, Oakland County, Michigan, do hereby certify that the attached are true and complete copies of Section 6, Chapter XIX; Section 53, Chapter III; Sections 3, 4, 5, 7, Chapter XVIII, of the Charter of the City of Pontiac, as amended by a vote of the electors of said City, at the election held November 6, 1973, in said City of Pontiac. I do hereby certify that at said election the vote upon Charter Amendment to amend Section 6, Chapter XIX, was 3,446 votes cast in favor of, and 3, 339 votes cast against said Charter Amendment. I hereby further certify that at said election the vote upon Charter Amendment to amend Section 53, Chapter III, was 3,571 votes cast in favor of, and 3,413 votes cast against said Charter Amendment. I hereby further certify that at said election the vote upon Charter Amendment to amend Sections 3, 4, 5 and 7, Chapter XVIII, was 3, 180 votes cast in favor of, and 2,722 votes cast against said Charter Amendment. I hereby further certify that at said election the vote upon Charter Amendment to amend Section 53, Chapter III, was 3,740 votes cast in favor of, and 2,298 votes cast against said Charter Amendment. Service Retirement Annuity. Upon retirement from service, a member shall receive an annuity equal to 2.4% of final average salary for each complete year of service, subject to a maximum of 75% of final average salary. A fractional period of service of less than a full year shall be considered in the calculation of the annuity. CHAPTER XIX Section 6. Service Retirement Annuity. CHAPTER ITT Section 530 The executive head of the Police Department shall be the Chief of Police and the executive head of the Fire Department shall be the Chief of the Fire Depart- ment. All persons appointed to the Police and Fire Departments shall be first appointed as probationary members for a period of six months and shall come within the juris- diction of the Board immediately upon the expiration of the said probationary period. All members of the Police and Fire Departments shall be and remain residents of the County of Oakland, State of Michigan. CHAPTER III Section 53. The executive head of the Police Department shall be the Chief of Police and the executive head of the Fire Department shall be the Chief of the Fire Depart- ment. All persons appointed to the Police and Fire Departments shall be first appointed as probationary members for a period of six months and shall come within the juris- diction of the Board immediately upon the expiration of the said probationary period. All members a the Police and Fire Departments shall be and remain residents of the County of Oakland, State of Michigan. CHAPTER XVIII Sections 3, 4, 5 and 7 Secton 3., Administration of Retirement System. •There is hereby created a Board of Trustees in whom is vested the general administration, management and responsibility for the proper operation of the Retirement System and for making effective the provisions of this amendment. The Board shall be organized immediately after four trsutees have qualified. The Board shall consist of eleven (11) trustees as follows: (a) A member of the City Commission to be selected by the City Commission. (b) The City Manager. (c) The Finance Director. (d) The City Commission shall appoint five (5) citizens who are electors and freeholders of the City and who are not eligible to receive benefits under this Retirement System (hereinafter referred to as the citizen trustees). (e) Three members of the Retirement System to be elected by the members of the Retirement System. (f) To fill the vacancy created by the exclusion of policemen and firemen from membership, effective as of January 1, 1963, an election for a successor to such office shall be held concurrently with the regular annual election for trustee. (g) The election of the trustees provided for in this section shall be conducted under such rules and regulations as the Board shall adopt to govern such elections. Section 4. Preliminary Board. Until the first election is held, the City Manager shall appoint the employee trustees provided for in Section 3, paragraph (e), and the Commis- sion shall appoint the citizen trustee provided for in Section 3, paragraph (d), to serve until their successors are elected or appointed and have qualified. The Board so con- stituted (including the trustees provided for in Section 3, paragraph (a), (b) and (c) shall order and arrange for an election by the members of the Retirement System to be held within ninety (90) days after the effective date of this Retirement System. At the first election the citizen trustee shall serve four years; one elected trustee shall serve three years; one elected trustee shall serve two years; one elected trustee shall serve on eyear. Fromthe effective date of this amendment which increases the number of citizen trustees to five (5) the term of the incumbent citizen trustee shall remain un- changed, one citizen trustee shall be appointed to an initial term to expire one year after appointment, one citizen trustee shall be appointed to an initial term to expire two years after appointment, one citizen trustee shall be appointed to an initial term to expire three years after appointment, one citizen trustee shall be appointed to an initial term to expire four years after appointment. All of said initial appointments of new citizen trustees to be completed within fourteen (14) days from the effective date of the said re- ferred to amendment. Section 5. Trustees' Regular Term of Office - Vacancy. After the first election and first appointments, the regular term of office of the citizen trustees and the employee trustees provided for in Section 3, paragraphs (d), (e), and (f) shall be four (4) years, each serving until his successor is elected or appointed and qualified. If a vacancy occurs in the office of :.rustee, the vacancy shall be filled within ninety (90) days after the date of the vacancy, for the unexpired term, in the same manner as the office was previously filled. Each trustee shall within ten (10) days after his appointment or election take an oath of office to be administered by the City Clerk. Section 7. Each trustee entitled to vote Six (6) trustees shall constitute a quorum at any meeting of the Board. Each trustee shall be entitled to one (1) vote in the meeting of the Board and at least six (6) concurring votes shall be necessary for a decision by the trustees. An members of the Police and Fire Departments shall be and remain residents of the City of Pontiac or within the area of a circle of the City of Pontiac having a radius of ten (10) miles from the intersection of Saginaw and Huron Streets in said City.
