IN RE: REPORT OF THE 1963 COUNTY LEGISLATIVE PROGRAM
TO THE OAKLAND COUNTY BOARD OF SUPERVISORS
Mr. Chairman, Ladies and Gentlemen:
Pursuant to Miscellaneous Resolutions 4086, 4c.7 and 4100, your Legislative
Committee prepared for presentation to the 1963 regular session of the State Legislature
several amendments to existing laws and, with the cooperation and assistance of the
six State Representatives of Oakland County, our State Senator and County Legislative
Agent, proceeded to have bills introduced to accomplish the purposes set forth in the
program approved by the Board.
Following is a detailed report of the various items approved by the Board,
together with requests from various Department Heads, and action taken by the Legislature:
Public Act #1, sponsored by Senators Roberts and Love, provides that in addition
to approving notice of sale of sewer project bonds, the Municipal Finance Commission
must also approve the sale of such bonds.
Act #27, which provides that the Board of Supervisors, by resolution adopted by
an affirmative vote of 2/3 of the members, may provide a per diem rate for the Chairman
in an amount larger than the amount established for other members of the Board.
Also the Board, by resolution, may authorize the county treasurer to advance funds
to any county officer for anticipated expenses in connection with county business.
Act #54 is a new act that provides for the establishment of community mental
health service programs; prescribes the powers of counties and certain citi es;
the powers and duties of the State Department of Health; and provides funds for the
operation of local community mental health programs.
Act #2, sponsored by Senator Roberts, is known as the act to prevent hunting with
firearms in the Township of Avon, County of Oakland, and the act does not take effect
until approved by a majority of the electors voting thereon in the Township of Avon.

Act #25 contains a provision whereby the Board of Supervisors by a majority vote
of its members elect may authorize the county treasurer to pay directly to the school
districts all moneys as shown on such statement due to the school districts within the county.
In such case the county superintendent shall not be required to compute and report
delinquent school taxes handled by the county.
Act #13 amends Section 45 of Chapter 84 of the Revised Statutes of 1846, authorizing
the Friend of the Court, in those counties which have a Friend of the Court, to accept
service of summons in divorce cases where there are children under 17 years of age.
Act #179 provides that the sixth judicial circuit consisting of the County of Oakland
be increased from 5 to 7 judges.
Act #172 is an amendment to the above bill and increases the state's portion of the
circuit judges salaries from $12,000 to $15,000.
Act #215 takes immediate effect and clarifies the language of the Drain Code,
Act 40 of the Public Acts of 1956, as amended, and specifically on apportionment of benefits.
Act #216 permits the issuance of bonds to provide sites for, and for the erection
thereon, of town halls, fire stations, libraries, or other buildings required for the public
use in whole or in part.
Act #65 provides that provision may be made by the Board of Supervisors in each
county or of counties contracting together for the diagnosis, treatment, care, training and
detention of children in a child care home to be conducted as an agency of the court or
county.
Act #35 provides that counties with 500,000 to 1,000,000 population may establish,
by a majority vote of the members of the Board of Supervisors, a board of jury commissioners
consisting of three qualified electors of the county, who shall be appointed by the Board of
Supervisors.
The following bills did not pass:
Senate Bill 1044, Department of Public Works, to be included in 1964 Legislative
Program.

House Bill 574, incorporation voting.
House Bill 294, dealing with county law library fees.
This is a total of 15 County bills, 12 adopted and 3 lost, resulting in about 80%
success for the 1963 Legislative Program.
A detailed copy of a report on the above and support items was mailed to all
members of the Board of Supervisors
Pursuant to a meeting held on September 4, 1963, your Legislative Committee wishes
to report further that after due deliberation it stands ready to recommend enabling legislation
for Home Rule implementation in Oakland County.
Your Committee also wishes to acknowledge the excellent cooperation and efforts
of the Oakland County Legislators, State Association of Supervisors, Township Association,
Oakland County Corporation Counsel and Legislative Agent in helping to bring the Oakland
County 1963 Legislative Program to a successful conclusion.
MR. CHAIRMAN, on behalf of the Legislative Committee, I move that the foregoing
report be received and placed on file.
