McCULLOCH, CHAIRPERSON IN RE: SHERIFF DEPARTMENT - CONTRACTED PATROL FOR CAMP DEARBORN TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS it is the policy of the Oakland County Board of Commissioners to permit the Sheriff's Department to enter into contractual agreements for the purpose of Law Enforcement Patrol Services; and WHEREAS the City of Dearborn has proposed a contract between the County and the City of Dearborn for law enforcement patrol services for the period June 15, 1992 through September 7, 1992; and WHEREAS the Sheriff's Department in conjunction with the City of Dearborn is proposing to contract for services per the attached agreement for one (1) Deputy II, four (4) Deputy I's, and ten (10) Part-Time Non-Eligible Park Deputies. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes the Chairperson of the Board and the Oakland County Sheriff to enter into the attached agreement with the City of Dearborn for the purpose of Law Enforcement Patrol Service at the rates included in the attached Schedule A. Mr. Chairperson, on behalf of the Public Service Committee, I move the adoption of the foregoing resolution. MICHIGAN 48126 • (313) 943-2235 • FAX (313) 943-3013 Oakland County Board of Commissioners Miscellaneous Resolution # Date: AGREEMENT FOR LAN ENFORCEMENT SERVICES THIS AGREEMENT made and entered into this 15th day of June, 1992 by anC between the Oakland County Sheriff, hereinafter referred to as "SHERIFF," and the City of Dearborn, hereinafter referred to as CAMP DEARBORN. WITNESSETH: WHEREAS, the City of Dearborn is desirous of contracting with the Sheriff for the performance of Park Patrol functions within Camp Dearborn; and WHEREAS, the Sheriff is agreeable to rendering such services on the terms and conditions as hereinafter set forth; NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. The Sheriff agrees to provide police protection within the jurisdictior of Camp'Dearborn, including all private roads, said protection to consist of the enforcement of State statutes and Park ordinances, including the writing of. tickets therefore; for the purpose of performing such functions, the Sheriff shall furnish and supply one [1] Deputy II, four [4] Deputy I's, and ten [10] Part-Time Non-Eligible Park Deputies, equipment, communication facilities and other necessary supplies needed in order to perform such services, including insurances, liability insurance and other protection or of whatever nature. Notwithstanding anything heretofore contained, it is agreed that in all instances where special supplies, such as stationery, notices, forms, appearance-tickets. and the like need to be executed in the name of Camp Dearborn shall be required, they shall be supplied by Camp Dearborn at its cost and expense. The Sheriff agrees to hold Camp Dearborn harmless and defend it against any suit, claim, cause of action, etc., as the result of any act, and/or omission to act, on the part of the Sheriff or its deputies, and/or agents while such patrol officer employees and/or agents are .under the control of the Oakland County Sheriff or hi:- designated representative. 2. The standards of performance, the discipline of the deputies and othe:- matters incident to the performance of such services and the control of tho deputies so assigned to provide such service shall remain in the Sheriff's Department; however, the standards of performance shall not be lower than that furnished another jurisdiction in Oakland County, nor shall the caliber and th.=• ability of the deputies supplied be lower than that furnished other jurisdictions in Oakland County. 3. Camp Dearborn shall not be required to assume any liability for the direct payment of salaries, wages or other compensation to the County for any Sheriff's Department personnel performing the services set forth in this document except as herein otherwise specified. 4. The Law Enforcement Service to be provided by the Sheriff shall consist of furnishing one (11 Deputy II, four [4] Deputy I's, and ten (101 Part-Time Non- Eligible Park Deputies. Training time shall be considered as Law Enforcement. Service. The commencement time of the shift is to be determined by the usua. shift starting and ending time established by the Oakland County Sheriff's Department. Law Enforcement . Services beyond the scope of this contract are available upon request by Camp Dearborn to be paid for at the established overtime rate or by Part-Time Non-Eligible Park Deputies. 5. Camp Dearborn agrees to pay for such Law Enforcement Service at the established rate consistent with the attached payment schedule, such sum to paid monthly. Billing shall commence on the date the deputies are assigned to Camp Dearborn. Fractional months services will be prorated on a work day basis for the month involved. 6. The Sheriff shall not be required to fill-in for any time said officer is not present due to annual leave, sick leave, personal leave or any other authorized leave time granted unless requested by Camp Dearborn to be paid for a; the established overtime rate or by Part-Time Non-Eligible Park Deputies. 7. This three r31 month agreement shall be effective June 15, 1992 an shall terminate September 7, 1992 provided that said agreement may be renewed fo- mutually agreed contract periods thereafter by Camp Dearborn at rates establisher by the County, by giving its intentions to renew said agreement in writing to th--- Sheriff at least forty-five [451 days prior to the expiration date. Said noticf- is to be sent to the Oakland County Executive and the Oakland County Sheriff, an be it provided further that either party hereto may elect not to renew same b: giving written notice thereof to the opposite party at least forty-five [45] dayr-7 prior to the expiration date. 8. In the event said Camp Dearborn elects not to renew said Agreement b -, giving notice as provided in paragraph 6, Camp Dearborn agrees that if i' establishes its own Parks Patrol it will give consideration to employ to tht,, Oakland County Sheriff's Deputies, if any, who will be laid off by virtue of Ulf ,: termination of said agreement, but in no event does Camp Dearborn agree that shall be obligated to hire such personnel._ 9. Camp Dearborn may terminate said agreement, upon sixty [60] days writter notice delivered to the Oakland County Executive and the Oakland County Sheriff. The estimated cost to provide patrol services to Camp Dearborn for the requested twelve (12) week period is $107,172 in 1992, which is summarized on Schedule B and detailed on Schedule C. The estimated cost to provide patrol services to Camp Dearborn for the requested twelve (12) week period is $111,992 in 1993, which is summarized on Schedule B and detailed on Schedule D. The rates for 1992 and 1993 are recommended as consistent with Schedule A. Approval of this contract does not commit the County to any future obligation. The future level of service including the added PTNE Park Deputy positions and Sheriff's overtime is contingent upon contract renewal.
