HomeMy WebLinkAboutResolutions - 2012.06.21 - 20276June 21, 2012 REPORT (MISC . 1/12156) BY: Human Resources Committee, John Scott, Chairperson RE: HEALTH AND HUMAN SERVICES — HOMELAND SECURITY DIVISION — TERMINATION OF FIDUCIARY FOR 2009, 2010 AND 2011 HOMELAND SECURITY GRANT PROGRAM To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: The Human Resources Committee, having reviewed the above referenced resolution, reports with the recommendation that the resolution be amended to include the following amendments: To add a new WHEREAS paragraph after the seventh (7`) WHEREAS paragraph: WHEREAS the above cited grant agreements created positions to support the fiduciary and local efforts and responsibilities; and To amend the 10th WHEREAS paragraph as follows: WHEREAS the termination of Oakland County as fiduciary and subgrantee for the 2010 State Homeland Security Grant Program requires the deletion of two (2) full-time eligible special revenue Homeland Security UASI Regional SAP positions in the Homeland Security Division, (1060601-10519 & 1060601-11203) and the deletion of one (1) full-time non-eligible (2,000 hours per year) Buyer II position in the Purchasing Division, (1020401-10521); and To add a new WHEREAS paragraph after the 10 1h WHEREAS paragraph: WHEREAS the termination of Oakland County as fiduciary and subqrantee for the 2010 State Homeland Security Grant Program requires that one (1) full- time eligible special revenue Business Analyst position (1060601-11204) and (1) part-time non-eligible special revenue Technical Assistant (1,000 hours per year), position (1060601-11205), be deleted in Health and Human Services/Homeland Security Division; and To amend the second (2nd) Be It Further Resolved paragraph as follows: BE IT FURHER RESOLVED that two (2) full-time eligible special revenue Homeland Security UASI Regional SAP positions (1060601-10519 & 1060601-11203) be deleted in Health and Human Services/Homeland Security Division and (1) full-time non-eligible special revenue Buyer 11 (2,000 hours per year), position (1020401-10521), be deleted in Management and Budget/Purchasing Division. And to add the following Be It Further Resolved paragraphs after the second (2nd) Be It Further Resolved paragraph: BE IT FURHER RESOLVED that one (1) full-time eligible special revenue Business Analyst position (1060601- 11204) and (1) part-time non-eligible special revenue Technical Assistant (1,000 hours per year), position (1060601- 11205), be deleted in Health and Human Services/Homeland Security Division. •BE IT FURHER RESOLVED that two (2) full-time eligible special revenue Homeland Security Regional SAP positions (1060601- 10296 & 10520) be continued in the Health and Human Services/Homeland Security Division to support local efforts and continue to be funded by the remaining portion of the regional allocation. BE IT FURTHER RESOLVED that one (1) full-time eligible Intelligent Analyst position (4030501-11093) be continued in the Sheriff's Office and funded by the remaining portion of the regional allocation. BE IT FURTHER RESOLVED that all positions and other programs costs associated with this grant are contingent upon continuation of grant funding. Human Resources Committee Vote: Motion carried unanimously on a roll call vote with Scott and Nuccio absent MISCELLANEOUS RESOLUTION #12156 June 7, 2012 By: General Government Committee, Christine Long, Chairperson IN RE: HEALTH AND HUMAN SERVICES — HOMELAND SECURITY DIVISION — TERMINATION OF FIDUCIARY FOR 2009, 2010 AND 2011 HOMELAND SECURITY GRANT PROGRAM TO: OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the purpose of the Homeland Security Grant Program (HSGP) is to provide federal pass- through funds to prevent, deter, respond to and recover from incidents of national significance, including threats and incidents of terrorism; and WHEREAS to identify and prioritize how the HSGP funds will be used, the State of Michigan, through the Michigan Homeland Protection Board, created Regional Security Planning Boards; and WHEREAS the Regional Homeland Security Planning Board for Region 2 (also known as the UASI Board) is comprised of the following political subdivisions: the City of Detroit, and Macomb, Monroe, Oakland, St. Clair, Washtenaw and Wayne Counties; and WHEREAS the UASI Board is not a legal entity that can manage and distribute HSPG funds; thus, a fiduciary is needed for the UASI Board to manage and distribute HSPG funds; and WHEREAS Oakland County has acted as fiduciary for the UASI Board since 2006; and WHEREAS in April 2012, the UASI Board voted that Macomb County become the fiduciary for the 2012 grant agreements for the UASI Board; and WHEREAS the Homeland Security Division of the Health and Human Services Department ("Homeland Security Division") recommends, as of September 30, 2012, terminating the grant agreements with the State of Michigan that make Oakland County fiduciary for the UASI Board or fiduciary for other political subdivisions within Region 2; and WHEREAS the Homeland Security Division recommends terminating the grant agreements which were approved by the following Miscellaneous Resolutions: (1) MR #10133; (2) MR #10134; (3) MR #10212; (4) MR #11047; (5) MR #11118; (6) MR#12011; and (7) #12012; and WHEREAS pursuant to the grant agreements, the Homeland Security Division will give the State of Michigan Emergency Management and Homeland Security Division 30 days written notice of the termination; and WHEREAS the Homeland Security Division will give written notice to the political subdivisions within Region 2 that Oakland County will cease operating as fiduciary for the UASI Board on September 30, 2012 and that all Interlocal Agreements associated with the grant agreements will be terminated on the same date; and WHEREAS the termination of Oakland County as fiduciary and subgrantee for the 2010 State Homeland Security Grant Program requires the discontinuation of two (2) full-time eligible special revenue Homeland Security-UASI Regional SAP in the Homeland Security Division, position #10519 & 11203 and the discontinuation of one (1) full-time non-eligible (2000 hr/year) Buyer II position in the Purchasing Division, position #10521, for Management and Administrative purposes; and NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners terminates the grant agreements with the State of Michigan that were approved by the following Miscellaneous Resolutions: (1) MR #10133; (2) MR #10134; (3) MR #10212; (4) MR #11047; (5) MR #11118; (6) MR#12011; and (7) #12012. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners authorizes and directs the Manager of the Homeland Security Division to send written notice to the State of Michigan terminating the above-listed grant agreements and to send written notice to the political subdivisions terminating the Interlocal Agreements associated with the above-listed grant agreements, BE IT FURTHER RESOLVED that two (2) full-time eligible special revenue Homeland Security-UASI Regional SAP, position 10519 & 11023 be discontinued in Health and Human Services/Homeland Security Division and (1) full-time non-eligible special revenue Buyer 11 (2,000 hr/year), position 10521, be discontinued in Management and Budget/Purchasing Division. FISCAL NOTE (MISC. #12,156) June 21, 2012 BY: FINANCE COMMITTEE, TOM MIDDLETON, CHAIRPERSON IN RE: DEPARTMENT OF HEALTH AND HUMAN SERVICES – HOMELAND SECURITY DIVISION – TERMINATION OF FIDUCIARY FOR 2009, 2010 AND 2011 HOMELAND SECURITY GRANT PROGRAM TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above-referenced resolution and finds: 1. Oakland County has acted as fiduciary for the Urban Area Security Initiative (UASI) Board since 2006. In April 2012, the (UASI) Board voted that Macomb County become the fiduciary for the 2012 grant agreements for the (UASI) Board. Therefore, as of September 30, 2012, the Homeland Security Division recommends terminating the grant agreements with the State of Michigan that make Oakland County fiduciary for the (UASI) Board or fiduciary for other political subdivisions within Region 2. 2. It is expected:that there will be inter-local agreements put in place with the new Fiduciary in order to protect Oakland County's financial interest for reimbursement of the Oakland County portion of the grant award and the eligible Regional grant costs incurred by Oakland. 3. Funding for Citizen Corp is provided for programs to increase domestic preparedness among members of the community and will be used to continue funding Citizen Corps Councils to support the oversight and outreach functions of the councils and to expand CERT training essential for developing the Citizen Corps. The following grants were awarded through this funding. 4. As adopted per M.R. #10212 funding awarded in the amount of $7,892 under the 2009 MICHIGAN CITIZEN CORPS PROGRAM GRANT — MONROE COUNTY is anticipated to be fully expended prior to the transfer of fiduciary responsibilities to the next political subdivision. 5. As adopted per M.R. #11047 funding awarded in the amount of $6,687 under the 2010 STATE HOMELAND SECURITY GRANT PROGRAM CITIZEN CORPS PROGRAM GRANT — MONROE COUNTY will not be entirely exhausted prior to the transfer to the next fiduciary. It is the intention of Oakland County to cut off all requests for funding from the political subdivisions as of a specified date and subsequently make the next fiduciary aware of the remaining totals with the transfer of fiduciary responsibilities. 6. As adopted per M.R. #12012 funding awarded in the amount of $93,642 under the 2011 MICHIGAN CITIZEN CORPS PROGRAM GRANT — REGIONAL FIDUCIARY will not be entirely exhausted prior to the transfer to the next fiduciary. It is the intention of Oakland County to cut off all requests for funding from the political subdivisions as of a specified date and subsequently make the next fiduciary aware of the remaining totals with the transfer of fiduciary responsibilities. 7. The purpose of the Homeland Security Grant Program (HSGP) is to provide federal pass-through funds to prevent, deter, respond to and recover from incidents of national significance, including threats and incidents of terrorism. The following grants were awarded through this funding. 8. As adopted per M.R. #10133 funding awarded in the amount of $538,468 under the 2009 FEMA STATE HOMELAND SECURITY GRANT PROGRAM MONROE COUNTY FIDUCIARY is anticipated to be fully expended prior to the transfer of fiduciary responsibilities to the next political subdivision. 9. As adopted per M.R. #10134 funding awarded in the amount of $2,967.318 under the 2009 FEMA STATE HOMELAND SECURITY GRANT PROGRAM —REGIONAL FIDUCIARY is anticipated to be fully expended prior to the transfer of fiduciary responsibilities to the next political subdivision. 10. As adopted per M.R. #11118 the 2010 FEMA STATE HOMELAND SECURITY GRANT ACCEPTANCE awarded Region 2, of the State $11,798,426 through the U.S. Department of Homeland Security Federal Emergency Management Agency (FEMA) which released funding to the Michigan Department of State Police, Emergency Management and Homeland Security Division. This consists of $1,013,146 from the State Homeland Security Program (SHSP) and $10,785,280 from (UASI). 11. The grant reimbursement covers the period of August 1, 2010 through April 30, 2013. 12. Expenditures for the 2010 grant have commenced, however, not all funding will be exhausted prior to the transfer to the next fiduciary. It is the intention of Oakland County to cut off all requests for funding from the political subdivisions as of a specified date and subsequently make the next fiduciary aware of the remaining totals with the transfer of fiduciary responsibilities. 13. As adopted per M.R. #12011 the 2011 FEMA STATE OF MICHIGAN HOMELAND SECURITY GRANT PROGRAM AGREEMENT awarded Region 2 of the State $8,091,476 through the Michigan Department of State Police, Emergency Management and Homeland Security Division for a 2011 Homeland Security Grant Program. This consists of $541,780 from the (SHSP) and $7,549,696 from (UASI). 14. The grant reimbursement covers the period of September 1, 2011 through May 30, 2014. FINANCE COMMITTEE Motion carried unanimously on a roll call vote. 15. No funding has been expended to date from the 2011 grant. As a result, Oakland County will budget their portion of funding, which amounts to $69,303 from the (SHSP) funds and $965,732 from (UASI) funds for a total of $1,035,035 (less incentive payment allocation of $1,500 for a total of $1,033,535) in FY 2013. The FY 2014 Budget will reflect $51,977 from the (SHSP) funds and $724,299 from (UASI) funds for a total of $776,276 (less one percent salary and fringe benefit increase of $1,742 for a total of $774,534). The remaining fund allocations within the budget (attributed to the other political subdivisions) will be reduced by a total amount of $6,824.242 in FY 2013 and $5,118,182 in FY 2014. 16. As a result of decreased fiduciary and subgrantee responsibilities for the above listed grants, Oakland County is required to delete two (2) Special Revenue full-time eligible Homeland Security-UASI Regional SAP positions( #10519 and #11023), one (1) Special Revenue full-time eligible Business Analyst position (#11024), and one (1) Special Revenue part-time non-eligible (1,000 hours/year) Technical Assistant position ( #11025) within the Homeland Security Division, and one (1) full-time non-eligible (2,000 hour/year) Buyer ll position (#10521) in the Purchasing Division. 17. The remaining portion of the award allocated to Region 2 will be used to continue funding for two (2) Special Revenue full-time eligible Homeland Security-Regional SAP positions (#10296 and #10520) within the Health and Human Services/Homeland Security Division as well as one (1) Special Revenue full-time eligible Intelligent Analyst position (#11093) within the Oakland County Sheriff's Office. 18. The future level of service, including personnel, will be contingent upon the level of funding available from the State. 19. The FY 2013 and FY 2014 Special Revenue Budgets for the 2011 FEMA STATE OF MICHIGAN HOMELAND SECURITY GRANT PROGRAM AGREEMENT will be reflected in the County Executive Recommended Budget (see attached schedule A for the amendments included in the County Executive Recommended Budget).
