HomeMy WebLinkAboutResolutions - 2012.06.21 - 20282PLANNING AND BUIWING COMMITTEE MISCELLANEOUS RESOLUTION #12172 June 21, 2012 BY: PLANNING AND BUILDING COMMITTEE, DAVID POTTS, CHAIRPERSON IN RE: DEPARTMENT OF ECONOMIC DEVELOPMENT & COMMUNITY AFFAIRS — COMMUNITY & HOME IMPROVEMENT DIVISION — SOUTHWEST HOUSING SOLUTIONS HOUSING COUNSELING SERVICES AGREEMENT FOR FANNIE MAE INSURED LOANS To the Oakland County Board of Commissioners Chairperson, Ladies, and Gentlemen: WHEREAS Southwest Housing Solutions, Corporation (SWHS) agency is a dedicated Mortgage Help Network site for Fannie Mae; and WHEREAS the Oakland County Community & Home Improvement Division's Housing Counseling and Homeless Services Unit has been selected to collaborate in implementing certain services beneficial to the community relating to avoidance of foreclosures in the servicing of residential mortgage loans; and WHEREAS SWHS seeks the services of the Oakland County Community & Home Improvement Division's Housing Counseling and Homeless Services Unit to perform all required counseling based on the U.S. Department of Housing and Urban Development and/or Michigan State Housing Development Authority guidelines to the borrower and collect all the information and documentation and complete an intake package required by Fannie Mae to evaluate the loan for a foreclosure rescue program; and WHEREAS Oakland County Community & Home Improvement shall assemble and submit a completed Fannie Mae Intake Packet to SWHS for each borrower counseled; and WHEREAS SWHS shall pay the Oakland County Community & Home Improvement Division billable fees for services as defined by SWHS in the attached Agreement; and WHEREAS the terms of the agreement shall cover work performed by the Community & Home Improvement Division during the period of time beginning June 1, 2012, through May 31, 2013 and thereafter through automatic successive one-year term agreement extensions; and WHEREAS the Division estimates providing 100 billable units of counseling services averaging $150 per household totaling $15,000 annually; and WHEREAS the Division shall use the revenue to supplement federal Community Development Block Grant and Housing Counseling Grant funds allocated for housing counselor salaries and fringe benefits; and WHEREAS this agreement has been reviewed and approved by Corporation Counsel. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the Southwest Housing Solutions Housing Counseling Services Agreement for Fannie Mae Insured Loans BE IT FURTHER RESOLVED that the acceptance of this agreement does not obligate the County to any future commitment. Oakland County Community & Home Improvement Division has been selected to jointly promote and assemble completed Fannie Mae Intake Packets to forward to SWHS. Oakland County Community & Home Improvement Division will submit loans that have been identified owned or guaranteed by Fannie Mae. Oakland County Community & Home Improvement Division will provide all required counseling, based on the HUD and/or MR-IDA guidelines, to the borrower(s) and collect all the required documents based on Fannie Mae guidelines, necessary follow up documentation to obtain workout and submit a completed workout package to SWHS. SWHS shall provide no contact of any kind with the above mentioned agencies borrowers and this is to include email and US mail, as this will be construed as counseling and could jeopardize any funding the agency receives with MSHDA. In addition, a fee for service is included and outlined below. The partnership will strive to meet the following outcomes: 1. Assist families that identified as Fannie Mae invested loan. 2. Assemble a completed required Fannie Mae workout Packet with all required documentation ; per the attached Documentation Checklist 3. The Fee for Service on the first Submission of a Completed Fannie Mae Intake Packet $150.00 4. Request for updated documents due to an incomplete Fannie Mae Intake Packet, the S150.00 will be deducted $75.00. Making the submission for the agency $75.00; total for a submission on a completed Fannie Mae Intake Packet. 5. Provide additional follow up, only as appropriate to assist the borrower to stay current on the first 6 months of their Modification a Fee for Service to be paid at S100.00. Following execution of a copy of a workout agreement. 6. Maintain paper or internal client records on all transferred Fannie Mae Intake Packets sent to SWHS. Oakland County Community & Home Improvement Division will submit a monthly invoice to Southwest Housing for payment based on transferred Fannie Mae Intake Packets sent to SWHS. Upon receiving the invoice it will be compared against the Fannie Invoice and matched for accuracy. A SWHS internal invoice will be prepared and sent to Fannie Mae payment and once payment is received from Fannie Mae, SWHS will then immediately submit payment to S1ATHS's Finance Dept for Oakland County Community & Home Improvement Division to Reimburse for their invoice submission. HOUSING SERVICES AND CONFIDENTAILITY AGREEMENT This HOUSING SERVICES AND CONFIDENTALITY AGREEMENT (the agreement) is entered into as of the 1st day of June 2012 by SWHS and Oakland County Community & Home Improvement Division. SWHS and recipient hereby enter into a business transaction in which the party of, Oakland County Community & Home Improvement Division, agree to collaborate in the implementation of certain services beneficial to the community relating to avoidance of foreclosures in the servicing of residential mortgage loans. In this regard, recipient will identify a Fannie Mae invested borrower(s), gather the required documents per Fannie Mae guidelines and collect a proper and completed Intake Packet. With this process, the agency has gained Permitted Purpose to discuss all housing/financial option alternatives with the Fannie Mae invested borrower(s) and that their information will be transferred/shared with SWHS in order to evaluate for the same and forward to their investor, Fannie Mae. The Confidential Information shall only be used by SWHS for the Permitted Purpose and for no other purpose. No right title or interest in and to the Confidential information is transferred by SWHS. SWHS shall retain all Confidential Information in Strict confidence and shall not disclose the Confidential Information or any of the following information to any party. SWHS follows the HUD and National Industry Standards on File Retention and mandates for the handling of all personal Confidential Information that is held by SWHS. If any provisions of this Agreement is held to he invalid or unenforceable for any reason, such provision shall be voided, if possible, in order to achieve the intent of the parties and in any event, the remaining provisions of this Agreement shall remain in full force and effect and shall be binding upon the parties hereto. All provisions, which by their nature should survive the termination of this Agreement, shall survive the termination of this Agreement for any reason. Southwest Housing Solutions Corporation requests the services of the Oakland County Community & Home Improvement Division's Housing Counseling and Homeless Services Unit to perform all required counseling, based on the U.S. Department of Housing and Urban Development and/or Michigan State Housing Development Authority guidelines to the borrower, collect all the information and documentation, and complete an intake package required by Fannie Mae to evaluate the loan for a foreclosure rescue program. 2.
