Chairman, Ladies and Gentlemen: WHEREAS, Chapter 17, Section 395 of Act No. 40 of the Public Acts of 1956, as amended, provides that "The county drain commissioner may relinquish jurisdiction and control to a township, city or village of any county drainage district upon which there is no outstanding indebtedness or contract liability and which is wholly located within the boundaries of a township, city or village, and there- after the county drain comnissioner shall be relieved of and the township, cityi r village shall assume, tLe :7aintenance, jurisdiction, control and operation thereof and its future operzltion shall be financed in the same manner as is prot vided for special assessment districts within such township, city or village: 'T-ovided, That such proceeding shall have first been approved by a majority of the members elect of the county board of supervisors and by the resolution of the governing body of the township, city or village in which such drain is located." WHEREAS, the territory now known as the City of Southfield becrffqo incorporated as the City of Southfield on April 28, 1958; and WHEREAS, the City of Southfield has, by resolution dated. April 15, r63, formally requested the County Drain Commissioner to relinquish jurisdic- tion of the Miller Drain, a county drain; and WHEREAS, the aforementioned Miller Drain lies entirely within the territorial limits of said City of Southfield. NOW, THE7E 7777, BE IT RESOLVED, that pursuant to the provisions of Chapter 17, Section 395 pf Act No. 40 of the Public Acts of 1956, as amended, the County Drain Commissioner be and is hereby authorized to relinquish juris- diction to the City of Southfield of the aforementioned Miller Drain and the drainage district therefor. Mr. Chairman, on behalf of the Drain Committee, I move the adc2tion of the foregoing resolution. DRAIN COMMITTEE Moved. by Potter supported by Dohany the resolution be adopted.
