HomeMy WebLinkAboutResolutions - 1963.06.24 - 20344Miscellaneous Resolution 4188 June 24, 1963 BY: Mr. MacDonald IN RE: OAKLAND COUNTY ROAD COMMISSION CONDEMNATION PROCEDURES TO THE OAKLAND COUNTY BOARD OF SUPERVISORS Mr. Chairman, Ladies and Gentlemen: The Board of Supervisors, at its meeting on March 21, 1963, directed this Committee to present a report to the said Board relative to condemnation procedures of the Oakland County Road Commission for road rights of way. The report was to specify that a minimum of three-fourths of the valuation of the property be given at the time that the property is taken. At its meeting on May 17, 1963, your Roads and Bridges Committee requested the Board of County Road Commissioners to prepare a report outlining the condemnation procedures followed by the Road Commission and that the report specifically include the procedure with regard to payment of the monies determined by the Road Commission to be the compensation for the taking. The Board of County Road Commissioners presented a report and outline at the meeting of this Committee on May 24, 1963. The report included the statutory authority and proce- dural steps followed by the Road Commission and also the Road Commission's procedure as to tender of the amount of compensation determined by the Road Commission to be paid for the taking of the property. It appears from the report that the Road Commission is, in fact, tendering the full amount of compensation prior to the taking of the property. Your Committee has accepted the Road Commission's report and recommends that the Road Commission, at the time the tender is made, in addition, advise the property owner of his right to accept any or all of the amount so tendered without prejudice to the property owner's right to appeal.
