resolution on September 24, 2012 Reports with the recommendation the resolution be

IN RE: SHERIFFS OFFICE — FISCAL YEAR 2013 AUTOMOBILE THEFT PREVENTION AUTHORITY
(ATPA) GRANT ACCEPTANCE
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the State of Michigan, Automobile Theft Prevention Authority (ATPA), awarded the Auto Theft
Unit of the Sheriff's Office funding in the amount of 61,330,455 for the fiscal year period of October 1,
2012 through September 30, 2013 and represents continuation funding; and
WHEREAS for FY 2013 the Oakland County Sheriff's Department will administer the total grant award
which includes a required match of $665,227 and is met by each participating municipalities local
matching funds; and
WHEREAS the Farmington Hills, Hazel Park, Waterford and Detroit Police Departments are included in
the FY 2013 grant awarded to Oakland County; and
WHEREAS Oakland County has been awarded $872,422 which includes a required fifty percent (50%)
County cash match obligation of $436,211; also included in this grant award are proportionate awards to
Farmington Hills Police Department of $122,894 with a required 661,447 local match; Hazel Park Police
Department of $105,202 with a required 652,601 local match; the Waterford Township Police Department
of $108,661 with a required $54,331 local match; and the Detroit Police Department of $121,276 with a
required $60,638 local match; and
WHEREAS the Oakland County matching funds requirement is available in the General Fund non-
departmental grant match account and has been included in the Fiscal Year 2013 Adopted Budget; and
VVHEREAS the award provides funding for the following current positions with the Sheriff's Office: one (1)
Special Revenue (SR) Sergeant (# 4030915-10333) and five (5) SR Deputy ll positions (# 4030915 -
06108, 06109, 06147. 06148, and 10898); and
WHEREAS funding for one (1) General Fund/General Purpose (GF/GP) position #11149 is contracted
with the City of Pontiac and reimbursed by the ATP& and
WHEREAS the FY 2012 grant award from ATPA authorized the creation of one (1) SR Deputy II position
(4030915-11067) in the Sheriff's Office assigned to the Detroit Police Department Auto Theft Program;
and
WHEREAS funding for this position is continued for FY 2013 through a separate ATPA grant awarded to
the City of Detroit in the amount of $107,916 and is confirmed by letter of agreement received from the
ATPA dated September 14, 2012; and
WHEREAS funding for this position was set up as GF/GP in error and will be reclassified from GF/GP to
Special Revenue (SR) funding and subject to Gosling Amendment Rules governing grant position
funding; and
WHEREAS the acceptance of this grant does not obligate the County to any future commitment; and
WHEREAS the continuation of the program is contingent upon future levels of grant funding; and
WHEREAS this grant award has been processed through the County Executive's Contract Review
process and the Board of Commissioners' Grant Acceptance Procedures.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the
Fiscal Year 2013 Automobile Theft Prevention Authority Grant award in the amount of $1,330,455
(Contract $665,228 and required matching funds of $665,227).
BE IT FURTHER RESOLVED that one (1) SR Sergeant (#4030915-10333) and five (5) SR Deputy II
positions (It's 4030915-06108, 06109, 06147, 06148, and 10898) be continued in the Sheriff's Office/
Investigative & Forensic Services/Special Teams Unit.
BE IT FURTHER RESOLVED that one (1) GF/GP Deputy II position (#4030629-11149) contracted by the
City of Pontiac in the Sheriff's Office/ Patrol Services/Pontiac will be reimbursed 50% by the FY13 ATPA
grant.

BE IT FURTHER RESOLVED that the funding of one (1) GF/GP Deputy II position (4030915-11067) be
changed from GE/GP to Special Revenue funded in the Sheriff's Office/investigative & Forensic
Services/Special Teams Unit; and continued by letter of agreement authorizing the Sheriff's Office to
participate in the separate ATPA grant award with the City of Detroit.
BE IT FURTHER RESOLVED that one (1) unmarked vehicle with radio be continued in support of the
Detroit ATPA effort. The grant award also funds Investigative Supplies of $2,447 and Phones/Pagers of
$3,500 and Overtime of $43,662.
BE IT FURTHER RESOLVED that the Board Chairperson on behalf of the County of Oakland, is
authorized to execute the grant acceptance.
BE IT FURTHER RESOLVED that continuation of this program, including positions, is contingent upon
continued grant funding of this program.

The Auto Theft Prevention Authority (ATPA) Grant #08-13 effective October 1, 2012, authorizes you to
assign six (6) Sheriff Deputies and one (1) Sheriff Sergeant to the Oakland County Auto Theft Team.
It is my understanding that you have entered into a reciprocal agreement with the Detroit Police
Department (DPD) to assign one additional deputy to the Auto Theft Team as listed on the attached
Budget Detail page). This mufti-jurisdictional arrangement is not only authorized by the ATPA, but
encouraged in order to enhance the effectiveness of both teams.

I-I. Membership in an ATPA Task Force: When an agency withdraws its employee from an ATPA Task Force, the ATPA. approved budget for that
position will remain with the Task Force, The Project Director must inform the ATPA when the withdrawal occurs and the vacant position must be
replaced within the required 30 day time period. ' '
I. All employees who are funded by an ATPA Task Force must have their activities approved by the Task Force commander.

F. Public communications materials or news releases that result from this grant must cite the "Automobile Theft Prevention Authority" as the source of
funding, Copies of the materials or news releases,must be sent to the ATPA. The ATRA has the royalty-free right to copy, publish, and distribute I
any data or material associated with this grant.
F. Any amount of the grant award received or forfeiture funds generated as a result of auto theft prevention activities shall be used to enhance auto
theft prevention programs. Forfeiture funds include, but are not limited to, forfeiture of cash and receipts from sale of property, ff auto theft 1

IV. Law Enforcement Measurable Objectives

1. Reduce the number of theft in your grant area by investigating caSes that have the highest potential for redudng the demand for stolen vehicles, arring ,
individuals who are involved and by reducing false theft reports.
2. Reduce the economic gain associated with auto theft by recovering stolen vehicles/parts/equipment and by constantly dentifying fraudulent
insurance activfty.
3. Recover more in stolen vehicles/parts/equipment value than the ATFA's total approved award.
4. Comply with ATPA guidelines/policies/conditions and !JCR requirements,

6. Personnel and/or budget modifications will he permitted only if the ATPA deems the request is justified. _Filling positions for short ,pericds of time in art
effort to use up a portion of the grant award will not be approved. Prior to any che.nge in personnel or the ATPA approved budget, the ATFA requires prior
written notifi(tation using the Project Modification Form (EX-34) with original signatures and approval from the ATPA on this form.
7'. Equipment Procurement Procedures/Consultant/Contractual Service: The grantee must attach a copy of an invoice to the financial report as supporting
documentation.
8. Financial/Progress Reports: See Reporting Schedule included in this Agreement on page four.
9. Public communications materials or news releases that result frorathis grant must cite the °Automobile Theft Prevention Authority" as the source of
funding.
10. Payment Procedure: Advance payment, with exception, will be. based on prior experience and budget Itmitations. It requires a formal agreement. Note:
New first time grantees must be registered in the state's vendor file by completing a vendor packet. The Project Director arid Financial Officer will serve
without any compensation from the ATPA grant award.
11. Matching Grant Award Amounts for Nonprofit Neighborhood Organizations: None.
12. Matching Grant Award Amounts for Law Enforcement and Prosecutors: Fifty percent (50W. The ATPA reimbursement will be the lesser of the total
reimbursable expenditures or the total ATPA approved budget amount.
13. Mileage Expense for Nonprofit Neighborhood Organizations: Must be limited to the grantee's estabEshed mileage reimbursement allowance for non-federally
funded activities not to exceed the ATPA approved budget amount. Grantees must provide supporting docilmentation for these expenses.
14. Vehicle Usage/Rental Expenses for Law Enforcement and Prosecutors: Must be limited to the grantee's established reimbursement policy for non-
federally funded activities not to exceed the ATFA approved budget amount Grantees must provide supporting documentation for these expenses.
15. Law Enforcement and Prosecutors: When an agency withdraws its employee from an ATPA Task Force, the ATPA approved budget for that position will
remain with the Task Force. The Protect Director must inform the ATPA when the withdrawal occurs and the vacant position must be replaced within the
required 30 day time period
16, Vacancy:' If a position is vacant for more than 30 days, the total ATPA approved budget for the position will be reduced accordingly.
17. Program Income: Seized property, fees, royalties, registrations, and etcetera, generated as a result of auto theft prevention activities must be used for
auto theft prevention activities.

IN RE: SHERIFF'S OFFICE — FISCAL YEAR 2013 AUTOMOBILE THEFT PREVENTION AUTHORITY (ATPA)
GRANT ACCEPTANCE
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced resolution and
finds:
1. The Automobile Theft Prevention Authority (ATPA) awarded the Sheriff's Office, Auto Theft Unit,
funding in the amount of $1,330,455.
2. Of the total award of $1,330,455 Oakland County administers $1,103,977 which excludes the Detroit
Police Department ($121,276) and Hazel Park Police Department ($105,202) who each receive their
funding directly from the State.
3. In addition to the FY 2013 grant award the Oakland County Sheriff's Office is receiving participation
funding from the City of Detroit's ATPA grant award in the amount of $107,916 includes a required 50%
match obligation of $56,303 (adjusted to cover an award funding shortfall of $2,333); confirmed by
letter of agreement received from the ATPA dated September 14, 2012 which allows for the Sheriff's
Office to continue funding one additional Deputy II position #4030915-11067 to the Investigative and
Forensic Services Division/Special Teams Unit in support of the Detroit Police Department Auto Theft
Program.
4. The Deputy II position #4030915-11067 funding classification will be changed from GFGP to Special
Revenue (SR) and continue in support of the ATPA program.
5. The other municipalities participating in the Oakland County grant award are the City of Waterford, the
Farmington Hills Police Departments, and the City of Pontiac who is contracting with the OCSO.
6. The Oakland County Sheriff's Office award is $436,211 with a required $436,211 local match, and
includes the City of Pontiac who contracts for patrol services with the Sheriff's Office; the Farmington
Hills Police Department $61,447 with a required $61,447 local match; the City of Detroit Police
Department $60,638 with a required $60,638 local match; the Hazel Park Police Department $52,601
with a required $52,601 local match; and the Waterford Township Police Department $54,331 with a
required $54,330 local match.
7. The County's total match amount of $492,514 is partly available in the Sheriff's Investigative and
Forensic Services Departmental GFGP Transfer Out account in the amount of ($334,086) plus salary
and fringe benefit amendment to move position #4030915-11067 to SR in the amount of ($110,249);
with the balance of ($48,179) available in the Non-Departmental Grant Match line item of the General
Fund budget.
8. This award continues funding for five (5) SR FTE Deputy II positions (#'s 4030901-116270-06108,
06109, 06147, 06148, and 10898) and one (1) SR FTE Sergeant position (#4030901-116270-10333).
9. In addition funding for one (1) GFGP position #4030601-11149 is contracted with the City of Pontiac
and is reimbursed to the City of Pontiac by the ATPA.
10. The total FY 2012 approved budget program funding of $1,365,435 decreased for FY 2013 to
$1,330,435 representing a ($35,000) reduction.
11. Also provided in the grant award is funding for overtime, adjusted to $43,662; also funding for vehicles
of $70,000; Investigative Supplies of $2,447; and Phones/Pagers of $3,500; in addition one used
vehicle will continue in service to the Investigative and Forensic Services Division/Special Teams Unit.
12. In addition to the County match requirements, the County is expected to incur administrative and
support costs of $41,500 for FY 2013, which has been included in the FY 2013 Adopted Budget. This
grant does not allow for reimbursement of indirect costs.
