RE: (OPPOSE) Senate Bills 57 and 58 Permitting Parole Officers and
Probation Officers to Carry Concealed Weapons
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, Senate Bills 57 and 58, which are tie-barred, would
permit parole officers and probation officers to carry concealed weapons,
under certain conditions, with the written permission of the director of
the State Department of Corrections but without authorization of the
Probate Courts; and
WHEREAS, these bills were introduced February 6, 1991, passed
the Senate March .5, 1991, and have since been in the House Committee on
Corrections; and
WHEREAS, SB 57 and SB 58 would impact Oakland County's Probate
Court and District Courts by exempting Juvenile and District Court
Probation Officers from the section of the Penal Code and Firearms
Statute requiring individuals to be licensed to carry a concealed weapon;
and
WHEREAS, these bills, in effect would give Probation Officers
the right to carry concealed weapons by virtue of their positions, with
no consideration of the Probation Officer's employer's position on the
Issue; and
WHEREAS, the Oakland County Probate Court has expressed the
following concerns about SB 57 and SB 58:
(A) The appropriateness of Juvenile Probation officers carrying weapons.
(B) The obvious issues relating to safety in the Courthouse, on the job
and while off duty.
(C) The disregard for employer/management rights and consideration on an
issue of this magnitude, and
(D) The real liability issues for the Probate and District Courts and the
County of Oakland.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners takes a position opposing Senate Bills 57 and 58.
BE IT FURTHER RESOLVED that copies of this resolution be sent
to all State Legislators from Oakland County, the County's Legislative
Agent and the Michigan Association of Counties.
Mr. Chairperson, on behalf of the General Government Committee,
I move the adoption of the foregoing resolution.
