HomeMy WebLinkAboutResolutions - 2013.02.07 - 20698MISCELLANEOUS RESOLUTION# ii022 February 7, 2013 BY: PLANNING AND BUILDING COMMITTEE, JIM RUNESTAD, CHAIRPERSON IN RE: PARKS AND RECREATION COMMISSION — 2012 BP FUELING COMMUNITIES GRANT ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS, the Oakland County Parks and Recreation Commission has been nominated by Barrick Enterprise, a local BP Branded Marketer, for a grant through the BP Fueling Communities Program; and WHEREAS, the BP Fueling Communities Program provides grants to local organizations that are nominated by BP's Branded Marketers to support the communities in which they do business; and WHEREAS, the Fueling Communities Program gives back to local organizations that support health, education, youth, food and housing to spread charity and goodwill; and WHEREAS, the Oakland County Parks and Recreation Commission has been approved as a recipient of a $20,000 grant; and WHEREAS, the grant will fund the Disabled Veteran's Sport Initiative, which will include a Paralympic Experience Sports Expo, Paralympic Sports Clinic Series, and social opportunities for persons with disabilities as part of Oakland County Parks and Recreation's Adaptive Recreation programming. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes and approves the 2012 BP Fueling Communities grant award for the Disabled Veteran's Sport Initiative in the amount of $20,000. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners directs its Chairperson or designee to execute said grant agreement on behalf of the County of Oakland. Chairperson, on behalf of the Planning and Building Committee, I move the adoption of the foregoing resolution. Hall (1/07/2013) Paralympics Experience Sports Expo Large special event that includes: Sports demonstrations, motivational Paralympic veteran athlete, hands-on-sports clinics. Expo including disabled sports groups, non- profit agencies that support disabilities as well as veterans. Kick off would assist us in recruitment, determining sports clinic and community awareness Location: Date: Oakland University Spring 2013 (10 am - 3 pm) Goal - To provide a hands-on resources for disabled Veteran's on opportunities available to them. To provide disabled veterans an opportunity to try new recreational opportunities. Expenses include: Facility rental, speaker, t-shirts, food, supplies, staffing Budget: $7,000 Adaptive Sports Clinic Series Develop and implement two disabled sports clinic series in 2013. Each series will have a minimum of 4 sessions. Potential sports and recreation clinics: Archery; Swimming; Sit Volleyball golf, hand- cycling and fishing Expenses include: equipment, adaptive equipment and facility rental, staffing Budget: $5,000 Social Opportunities Provide social opportunities that assist in promoting and recruiting Paralympics sports clinics. Opportunities would provide a social network for disabled veterans along with their family and friends. Potential options include: Barbeque at the park, fishing derby or golf outing. Expenses include: facility rental, refreshments, and supplies) Budget: 4 events @ $2,000/event = $8,000 Total project budget: $20,000 Total requested from BP Fueling Communities: $20,000 QAKLAND OUNTY PARKS BP / Barrick Oil - BP Fueling Communities Grant Proposal Paralympics - Disabled Veterans Program Overview: The Oakland County Parks Paralympics program for Veterans with disabilities is designed to motivate and encourage participation in recreation and sport opportunities This program is a community-based grass root adaptive sports program serving Veterans with physical, visual, or cognitive disabilities such as post-traumatic stress disorder and traumatic brain injury as well as other individuals with physical disabilities. It is not just about sports; it's also about attitude, camaraderie and promoting healthy, active lifestyles. 723,368 80, 487 Michigan Veterans Michigan Veteran's with Disabled Benefits Program Goals: • To increase awareness of the recreation and sports available to people with physical Disabilities. • To increase awareness in our community about individuals with different types of physical disabilities. • To provide Veterans the opportunity to participate in adaptive sports at local lever for fun and recreation or to meet personal fitness goals. • To encourage inclusion of individuals with disabil ities • To increase awareness and knowledge of the public on the importance of active lifestyles for veterans with disabilities, and the use of recreation and sport activities to encourage healthy, active choices. • To provide resources for those individuals that are ready for the next level might consider training to become an elite athlete to possibly compete on the Paralympics level. Benefits of Disabled Sports and Recreation: Sport can play a key role in the lives and communities of persons with a disability, the same as their peers without a disability. • Socialization - Socialization through sport is particularly valuable for persons with a disability as they often remain in the home environment, protected and guarded by their families. Participation in sport creates peer interaction, co-operative relationships and teamwork. • Empowerment - Sport can also play a significant role in reducing the focus on the impairment or disability of the person and places the focus on their abilities. This leads to empowerment and greater self-confidence that can be applied to other realms of life, for example employment. • Independence - Disability sport programs serve to strengthen participants both mentally and physically, promote rehabilitation, and facilitate a capacity for self-help. "While sport has value in everyone's life, it is even more important in the life of a person with a disability. This is because of sport's rehabilitative influence and the fact that it is a means to integrate the person into society and sport teaches independence". • Inclusion - Sport can promote the inclusion of everyone and eliminate stigmatization. 111 Understanding - By involving participants with and without a disability in the same programs there is increased understanding and sensitivity about one another and it can assist with preventing social exclusion. GRANT AGREEMENT This Grant Agreement (the "Agreement") is entered into as of the day of , 20 by BP Products North America (30 S. Wacker Drive, Suite 900, Chicago, IL 60606) and the County of Oakland, a Michigan Constitutional and Municipal Corporation, whose address is 1200 North Telegraph Road, Pontiac, Michigan 48341, by and through its statutory agent, the Oakland County Parks and Recreation Commission ("County"). RECITALS A. The BP Fueling Communities program provides grants to local organizations that are nominated by BP's Branded Marketers to support the communities in which they do business. Fueling Communities gives back to local organizations that support health, education, youth, food and housing to spread charity and goodwill. To fuel the spirit of BP's sponsorship of Team USA and the United States Olympic Committee, Barrick Enterprises, Inc., a local BP Branded Marketer, nominated the Oakland County Parks and Recreation Commission for a $20,000 Fueling Communities grant to fund the Disabled Veteran's Sport initiative. Specifically, the funding will assist the development of recreational opportunities for veterans with disabilities. The program will include: Paralympic Experience Sports Expo (kickoff event), Paralympic sports clinic series and social and networking events for veterans with disabilities. B. The County accepts the grant of money from BP Products North America. NOW, THEREFORE, the Parties agree as follows: 1. Description of Grant & Parties Responsibilities. 1.1. BP Products North America agrees to provide a grant from its "Fueling Communities" grant program in the amount of $20,000 to the County for programs for disabled veterans in 2013. There is no match requirement for this grant. 1.2. The County agrees to provide the following programs in 2013 with the grant award: Paralympic Experience Sports Expo ($7,000), Paralympic Sports Clinic Series ($5,000), and 4 social and networking events for veterans with disabilities ($8,000), for a total project cost of $20,000. 1.3. The County will provide a project completion report to BP Products North America by July 1, 2014. 1.4. A representative from Barrick Enterprises, Inc. will sit on committee formed by the County, through its Parks and Recreation Commission, to plan the programs and events funded through this grant. 2. Effective Date of Grant. The Grant awarded to the County by BP Products North America shall be paid to the County within Ten (10) business days of this Agreement being executed by both Parties. The grant shall be paid by check made out to the "County of Oakland" or by electronic deposit, at the County's option. 3. Other Provisions. 3.1. Amendments. This Agreement shall not be changed except by a writing signed by both Parties. 3.2. Entire Agreement. This Agreement constitutes the entire agreement between the Parties with respect to the monetary grant. 3.3. Applicable Law. This Agreement shall be governed by, and construed and enforced in accordance with, the laws of the State of Michigan. 3.4. Additional Documents. BP Products North America and the County agree to execute any and all documents, instruments, certificates and communications deemed to be reasonably necessary to effectuate the intent of this Agreement and agree to cooperate and negotiate in good faith with respect to any and all matters relating to this Agreement. 3.5. Binding Effect. This Agreement shall be binding upon and inure to the benefit of the successors and assignees of the respective Parties to this Agreement. 3.6. Notices. Any notice or communication required or permitted under this Agreement will be deemed duly given if (a) in writing, and (b) hand delivered or sent by certified or registered mail, postage prepaid, return receipt requested, to a Party at the address specified below, or at such other address as a Party may designate to the other Party in a notice pursuant to this Section 5.6. Severability. Where possible, each provision in this Agreement will be interpreted in such a manner as to be effective and valid under applicable law. Accordingly, the Parties agree that the provisions of this Agreement will be deemed severable, and if any provision or part of this Agreement is held illegal, void, or invalid under applicable law, such provision or part will be changed to the extent reasonably necessary to make the provision or part, as so changed, legal, valid, and binding. If any one or more of the provisions contained in this Agreement will, for any reason, be held to be invalid, illegal, or unenforceable in its entirety, such invalidity, illegality, or unenforceability will not affect any of the other provisions of this Agreement, and this Agreement will be construed as if such invalid, illegal, or unenforceable provision or provisions had never been contained herein unless the deletion of such provision or provisions would result in such a material change as to cause completion of the transactions contemplated hereby to be unreasonable. 3.8. Section Headings. The Section headings contained in this Agreement have been inserted only as a matter of convenience and for reference, and in no way shall be construed to define, limit, or describe the scope or intent of any provision of this Agreement. 3.9. Counterparts and Facsimile Signatures. This Agreement may be executed in counterparts, each of which will be deemed an original but all of which will constitute one and the same instrument. Signatures on this Agreement may be delivered by facsimile in lieu of an original signature, and the Parties agree to treat facsimile signatures as original signatures. The Parties hereto have signed this Agreement on the date first above written. The Oakland County Parks and Recreation Commission has been nominated by Barrick Enterprise for a grant through the BP Fueling Communities Program. 2. The resolution approves and authorizes acceptance of the 2012 BP Fueling Communities grant award for the Disabled Veteran's Sport Initiative. 3. Grant funds will be used by the Parks and Recreation's Adaptive Recreation programming services function to provide a variety of opportunities for persons with disabilities. 4. There is no grant match requirement for this grant. 5.
