IN RE: OAKLAND COUNTY WATER RESOURCES COMMISSIONER - REQUEST FOR APPROVAL
TO TRANSFER TITLE TO CERTAIN EASEMENTS, RIGHTS OF WAY, TRANSMISSION MAINS,
DISTRIBUTION LATERALS AND APPURTENANCES TO THE MUNICIPALITIES IN WHICH THEY
ARE LOCATED
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS Oakland County holds legal title to portions of the water supply system and the
sanitary sewer supply system in West Bloomfield Township and the water supply system in the City of
Auburn Hills and the sewer supply system in Independence Township; and
WHEREAS the municipalities of the City of Auburn Hills, and the Townships of Independence and
West Bloomfield have requested that legal title to certain easements, rights-of-way, transmission mains,
distribution laterals and appurtenances be transferred from Oakland County to the respective
municipalities; and
WHEREAS there is no outstanding debt or other indebtedness with respect to the finance, design
or construction of the aforementioned systems which would otherwise prohibit the transfer of these
property interests; and
WHEREAS it is the recommendation of the Oakland County Water Resources Commissioner that
the Oakland County Board of Commissioners approve and authorize the transfer of said property
interests.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby
approves and authorizes the Oakland County Water Resources Commissioner to transfer legal title of
certain easements, rights-of-way, transmission mains, distribution laterals and appurtenances to the
municipalities in which they are located, to wit: the City of Auburn Hills, and the Townships of
Independence and West Bloomfield.
BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners hereby directs
its Chairperson or his designee to execute the attached QUIT CLAIM CONVEYANCE OF EASEMENTS,
RIGHTS OF WAY ALONG WITH WATER AND SANITARY SEWER SYSTEM FACILITIES AND
IMPROVEMENTS and all other related documents which may be required between THE COUNTY OF
OAKLAND and THE CITY OF AUBURN HILLS and THE TOWNSHIPS OF INDEPENDENCE and
WEST BLOOMFIELD.

Background: Oakland County holds legal title to portions of the Auburn Hills Water Supply System which
consists of easements and rights-of-way, transmission mains, distribution laterals and appurtenances
necessary for the transportation and distribution of potable water, and related equipment, facilities and
improvements therein, excluding leads. The City of Auburn Hills has requested that the County divest itself and
transfer all title and interest in the local systems serving the City. There is no outstanding debt or other
indebtedness with respect to the finance, design or construction of the systems that would otherwise prohibit
the transfer of these property interests.
We are requesting authorization to proceed to transfer the County's legal title in the local water supply system
to the City of Auburn Hills, and that this matter is placed on the Planning & Building Committee agenda for
February 25, 2014 for the Committee's consideration and approval.

Dear Mr, McCulloch:
It is our understanding that your staff has undertaken a review of the real property
interests associated with the City of Auburn Hills Water and Sewer and has detemained
that there are multiple easements and/or rights-of-way that were acquired in the name of
the county on behalf of the City of Auburn Hills As you know, from time to time the
City has also extended the systems acquiring the necessary easements on its own behalf.
To clean up the legal title to the systems, we are requesting that the County formally
transfer or assign any of its title and interest in all easements and fee property (if any) that
pertain to the City of Auburn Hills Water and Sewer System.

WATER RESOURCES COMMISSIONER, in his capacity as "County

serving the Township. There is no outstanding debt or other indebtedness with respect to the finance, design
or construction of said systems that would otherwise prohibit the transfer of these property interests.

Dear Mr. McCulloch:
It is our understanding that your staff has undertaken a review of the real property interests
associated with Independence Township's sanitary sewer and has determined that there are
multiple easements and/or rights-of-way that were acquired in the name of the county on behalf
of Independence Township. As you know, from time to time the Township has also extended
the systems acquiring the necessary easements on its own behalf. To clean up the legal title to the
systems, we are requesting that the County faintally transfer or assign any of its title and interest
in all easements and fee property that pertain to Independence Township's sanitary sewer
system.
Once the assignments/conveyances to the Township are provided to us, we will review them and
have them formally accepted by the Township Board.

has extended its systems acquiring necessary Easements on its own behalf,
In order to clean up and straighten away Legal Title to our systems, We are requesting
that the Oakland County Water Resources Commission formally transfer or assign any of
its Title and Interest in all Easements and Property that pertain to the Charter Township
of West Bloomfield Water and Sewer System at no monetary cost to our municipality.

AND WATER SYSTEM FACILITIES AND IMPROVEMENTS
KNOW ALL MEN BY THESE PRESENTS, that the COUNTY OF
OAKLAND, a Michigan Constitutional Corporation, whose address is 1200
North Telegraph, Pontiac, Michigan 48341, and the OAKLAND COUNTY
WATER RESOURCES COMMISSIONER, in his capacity as "County
Agency" whose address is the Office of the OAKLAND COUNTY WATER
RESOURCES COMMISSIONER, One Public Works Drive, Bldg. 95 West,
Waterford, Michigan 48328-1907, Grantors, for and in consideration of the sum
of ONE DOLLAR AND 00/CENTS ($1,00) receipt of which is hereby
acknowledged, paid to them by the CHARTER TOWNSHIP OF WEST

the property described in Attachment "A", including easements and right-of-way,
and the water mains, laterals and related equipment, facilities and improvements
therein, excluding leads, located within the easement and/or right-of-way areas
described on the attached and incorporated in Attachment "A."
Grantors convey to Grantee all easements and right-of-way and water system
improvements, including the right to construct, operate, maintain, repair and/or
replace a water supply system across and through the following described lands
situated in the Township of West Bloomfield, Oakland County, Michigan. The
conveyance of the system(s) and improvements is "as-is" and Grantors make no
warranties as to the condition or fitness for a purpose, said warranties being
expressly disclaimed.
PROPERTY DESCRIPTIONS:

Grantee agrees to and acknowledges that it shall be responsible for all
restrictions and conditions as set forth in the easements and right-of-way set forth
in Attachment "A."
This instrument shall be binding upon and inure to the benefit of the parties
hereto, their heirs, representatives, successors and assigns.
