HomeMy WebLinkAboutResolutions - 2014.10.08 - 21533MISCELLANEOUS RESOLUTION #14237 October 8, 2014 By: Planning and Building Committee, James Runestad, Chairperson IN RE: WATER RESOURCES COMMISSIONER - TRANSFER OF COMMERCE TOWNSHIP/HURON VALLEY HOSPITAL BACK-UP WELL SITE PROPERTY To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS Oakland County holds legal title to a certain piece of property located in the Charter Township of Commerce formerly used as a back-up well site for the Huron Valley Hospital, and which is no longer needed for its intended purpose; and WHEREAS, the Charter Township of Commerce has requested that the County divest itself and transfer all title and interest in the well site property to Huron Valley Hospital; and WHEREAS, there is no outstanding debt or other indebtedness with respect to the finance, design or construction of the site that would otherwise prohibit the transfer of property interests. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby transfers and assigns all County interest in the back-up well site property. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners hereby directs its Chairperson or designee to execute a Quit Claim deed in substantially the form attached hereto, in favor of the Huron Valley Hospital and any other necessary property transfer documents, to effectuate the transfer of the said back-up well site property. Basch, Senior Attorney SUBJECT: WATER RESOURCES COMMISSIONER — TRANSFER OF COMMERCE TOWNSHIP/HURON VALLEY HOSPITAL BACK-UP WELL SITE PROPERTY DATE: September 17, 2014 Background: In 2002, the County of Oakland conveyed its ownership interest and title to a portion of the original Commerce Township/Huron Valley Hospital back-up well site property to Huron Valley Hospital. The County retained ownership of two (2) — 100 foot radius isolation areas around the existing wells and buildings. The wells and buildings have now been abandoned and are no longer needed for their intended purpose. The Charter Township of Commerce has requested that Oakland County divest itself and transfer all title and interest in the remaining well site property to Huron Valley Hospital. A copy of the township's letter is included with this memorandum. There is no outstanding debt or other indebtedness with respect to the finance, design or construction of the site that would otherwise prohibit the transfer of property interests. We are requesting authorization to proceed to transfer the County's legal title in the well site property to Huron Valley Hospital, and that this matter be placed on the Planning & Building Committee Agenda for September 20, 2014 for the Committee's consideration and approval. Nash, On December 17, 2013 I wrote to advice you that Commerce Township is in the process of acquiring property from Huron Valley Hospital on which the township intends to construct a water storage facility. I indicated that the current back-up wells were intended to be lawfully abandoned and the well site conveyed to the Hospital wizen the new water storage facility is complete and operational. Our plans have changed and we are asking that as Commerce Township moves toward construction of tile new water storage facility that your office take all steps necessary to immediately abandon the wells and facilitate the conveyance of the well site property. to the Hospital. We understand that your office has already received authority from the Hospital concurring in this request. Please let me know ifyou require anything further from the township or the hospital.
