IN RE: SHERIFF'S DEPARTMENT - ADDITION OF LAW ENFORCEMENT PATROL SERVICES
CONTRACTS - TOWNSHIP OF COMMERCE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS it is the policy of the Oakland County Board of Commissioners to
permit the Sheriff's Department to enter into contractual agreements with
local units of government to provide Law Enforcement Patrol Services; and
WHEREAS the Township of Commerce has requested the addition of four (4)
Patrol Deputy (with Fill-In) Enforcement Patrol Services contract and the one
(1) Patrol Investigator Law Enforcement Patrol Services contract for the
period January 1, 1993 through December 31, 1993 at rates established by the
Board; and
WHEREAS the County vehicle fleet will be expanded by two (2) leased
patrol vehicles and one (1) leased unmarked vehicle for these contract
additions; and
WHEREAS it is the County's policy to provide the acquisition cost of
additional vehicles for new Law Enforcement Patrol Services contracts which
require vehicles.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners authorizes the Chairperson of the Board and the Oakland County
Sheriff to enter into Law Enforcement Patrol Services agreements with the
Township of Commerce for the addition of four (4) Patrol Deputy (with Fill-
In) Enforcement Patrol Services contract at annual rates of $77,447 for 1993
and the one (1) Patrol Investigator Law Enforcement Patrol Services contract
at the annual rate of $66,767 for 1993
BE IT FURTHER RESOLVED that the Board of Commissioners creates five (5)
Deputy II positions in the Contracted Patrol Unit, Protective Services
Division of the Sheriff's Department (436-18), effective January 1, 1993.
BE IT FURTHER RESOLVED that the County vehicle fleet be expanded by two
(2) patrol vehicles and one unmarked patrol vehicle for these contracts.
Mr. Chairperson, on behalf of the Public Services Committee, I move the
adoption of the foregoing resolution.

in millage to add four Oakland County Sheriff Deputies and one
Oakland County SherifC Investigator to our law enforcement staff.
The millage will be collected to enable us to implement the increase
in staff effective January 1, 1993.

Miscellaneous Resolution I
AGREEMENT FOR LAW ENFORCEMENT sERyjcFs
THIS AGREEMENT made and entered into this 1st Day of January, 1993 by
and between the COUNTY OF OAKLAND, through its Board of Commissioners and the
Oakland County Sheriff, hereinafter referred to as "COUNTY," and the Township
of Commerce, hereinafter referred to as the "LOCAL JURISDICTION."
WITNESSETH:
WHEREAS, the County is agreeable to rendering such services on the terms
and conditions as hereinafter set forth;
NOW THEREFORE, IT IS AGREED AS FOLLOWS:
1. The County agrees to provide police protection and supervision
within the corporate limits of the Local Jurisdiction, including all private
roads, said protection to consist of the enforcement of State statutes and
the Local Jurisdiction ordinances, including the writing of tickets
therefore; for the purpose of performing such functions, the County shall
furnish anid supply one (1) Patrol Investigator, equipment, communication
facilities and other necessary supplies needed in order to perform such
services, including all insurances, liability insurance and other protection
or benefits of whatever nature. Notwithstanding anything heretofore
contained, it is agreed that in all instances where special supplies, such as
stationery, notices, forms, appearance tickets, and the like needed to be
executed in the name of the Local Jurisdiction shall be required, they shall
be supplied by the Local Jurisdiction at its cost and expense. The County
agrees to hold the Local Jurisdiction harmless and defend it against any
suit, claim, cause of action, etc., as the result of any act, and/or omission
to act, on the part of the County or Patrol Investigator, and/or agents while e .
such Patrol Investigator employees and/or agents are under the control of the
Oakland County Sheriff or his designated representative.
2. The standards of performance, the discipline of the Patrol
Investigator and other matters incident to the performance of such services
and the control of the Patrol Investigator so assigned to provide such
service shall remain in the County; however, the standards of performance
shall not be lower than that furnished another jurisdiction in Oakland
County, nor shall the caliber and the ability of the Patrol Investigator
supplied be lower than that furnished other jurisdictions in Oakland County.
3. The Local Jurisdiction shall not be required to assume any
liability for the direct payment of salaries, wages or other compensation to
the County for any County personnel performing the services set forth in this
document except as herein otherwise specified.
4. The Law Enforcement Service to be provided by the County shall
consist of furnishing one (1) Patrol Investigator. Training time shall be
considered as Law Enforcement Service. The commencement time of the shift is
to be determined by the usual shift starting and ending time established by
the Oakland County Sheriff's Department. Law Enforcement Services beyond the
scope of this contract are available upon request by the local jurisdiction
to be paid for at the established overtime rate.
5. The Local Jurisdiction agrees to pay for such Law Enforcement
Service at the established yearly rate per Patrol Investigator consistent
with the attached payment schedule, such sum to be paid monthly. Billing
shall commence on the date the Patrol Investigator is assigned to the Local
Jurisdiction. Fractional months services will be prorated on work day basis
for the month involved.

6. The County shall NOT be required to fill-in for any time said
officer is not present due to annual leave, sick leave, personal leave or any
other authorized leave time granted unless requested by the local
jurisdiction to be paid for at the established overtime rate.
7. This twelve (12) month Agreement shall be effective January 1, 1993
and shall terminate December 31, 1993 provided that said Agreement may be
renewed for mutually agreed contract periods thereafter by the Local
Jurisdiction, at rates established by the County, by giving its intentions to
renew said Agreement in writing to the County at least 45 days prior to the
expiration date. Said notice is to be sent to the Oakland County Executive
and the Oakland County Sheriff, and be it provided further that either party
hereto may elect not to renew same by giving written notice thereof to the
opposite party at least 45 days prior to the expiration date.
8. In the event said Local Jurisdiction elects not to renew said
Agreement by giving notice as provided in paragraph 6, the Local Jurisdiction
agrees that if it establishes its own police department it will give
consideration to employ to the Oakland County Sheriff's Deputies, if any, who
will be laid off by virtue of the termination of said Agreement, but in no
event does the Local Jurisdiction agree that it shall be obligated to hire
such personnel.
9. The Local Jurisdiction may terminate said Agreement, upon sixty

Oakland County Sheriff.

AGREEMENT FOR LAN ENFORCEMENT SERVICES
THIS AGREEMENT made and entered into this 1st Day of January, 1993 by
and between the COUNTY OF OAKLAND, through its Board of Commissioners and the
Oakland County Sheriff, hereinafter referred to as "COUNTY," and the Township
of Commerce, hereinafter referred to as the "LOCAL JURISDICTION."
WITNESSETH:
WHEREAS, the Local Jurisdiction is desirous of contracting with the
County for the performance of Law Enforcement functions within its corporate
limits by the County; and

NOW THEREFORE, IT IS AGREED AS FOLLOWS:

Jurisdiction to be paid for at the established overtime rate.

CONTRACTS - TOWNSHIP OF COMMERCE - MISCELLANEOUS RESOLUTION 92204
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
Pursuant to Rule XI-G of this Board, the Finance Committee has reviewed
Miscellaneous Resolution #92204 and finds:
1) The four (4) Patrol Deputy (with Fill -In) contract and one (1)
Patrol Investigator contract requires five (5) additional Deputy
II-A positions.
Based on the rates established by Miscellaneous Resolution #91180,
annual revenue from the four (4) Patrol Deputy (with Fill-In)
contracts is $77,447 each; and for the one (1) Patrol Investigator
is $66,767 for a total revenue of $376,555.
Capital costs require transfer of funds from contingency of $67,776
for two (2) patrol vehicles; one (1) unmarked vehicle; three (3)
portable radios; and three (3) mobile radios. These transfers are
identified in Schedule A. Further, the contracts require two (2)
In-Car Terminals which shall be purchased with funds available in
the Computer Services Fund Balance.
Budget adjustments for operating expenditures which are consistent
with the rates established in Miscellaneous Resolution #91180 are
equal to revenue adjustments detailed on Schedule A. Costs above
the budget adjustments are to be absorbed within the Sheriff's
Department budget.
The 1992/93 General Fund Revenue and Expenditure Budget be amended
and funds transferred for these five (5) contracts and the
acquisition of the equipment as detailed in Schedule A; and the
1992/93 Motor Pool, Radio Communications, and Computer Services
Fund Budgets be amended and funds transferred as detailed on
Schedule B.
