REGULAR MEETING OF THE BOARD OF CANVASSERS
CITY OF SOUTHFIELD
COUNTY OF OAKLAND, MICHIGAN
NOVEMBER 9, 2000
The Regular Meeting of the Board of Canvassers convened at 8:00 p.m. on November 9, 2000, in
the Council Conference Room, 26000 Evergreen Road, Southfield, Michigan, to canvas the results
of the Special Election held November 7, 2000.
PRESENT: Mary Katheryne DeCuir, Sheridan Holzman, Charles Kleinbrook
Sylvia S. Stern
ABSENT: None
7 A motion was offered by Stern and supported by Kleinbrook that
Holzman be elected Chairman of the Meeting of the Board of Canvassers.
Motion was adopted.
• WHEREAS, at the General Election duly called and held in the City of Southfield, County of
Oakland, Michigan, on Tuesday, November 7, 2000, between the hours of 7:00 a.m. and 8:00 p.m.,
Eastern Standard Time, pursuant to the provisions of Act 239, Public Acts of 1970 as amended on
September 15, 1981, the Eve Charter Amendments were presented on the ballot at said General
Election; and;
WHEREAS, the votes east at said election have been. filed in the office of the City Clerk and have
been presented and examined by the Board of Canvassers;
NOW, THEREFORE, BE IT RESOLVED that the Board of Canvassers hereby determines that the
votes cast for the five Charter Amendments at the said General Election held on November 7, 2000
were as follows:

AND BE IT FURTHER RESOLVED that the Board of Canvassers further determines that the
following charter amendments were approved:
Lharter Amendmcnt A
• Shall Section 4.1(c) of the Charter of the City of Southfield be amended to provide that the Council
shall elect a Council President and President Pro Te at its second regular meeting in November of
each year; and that the term of each such office shall be one (I) year, unless the officer is sooner
removed by a vote of at least five (5) members, in which case Council shall elect a successor for the
unexpired term.
Charter Amendment B.
Shall Section 8,2 of the Charter of the City of Southfield be amended to provide that each City
Officer and Department Head shall submit a proposed budget for the next fiscal year to the City
Administrator on OF before the first day of March; the City Administrator shall submit the budgets
to the Mayor on or before the first day of April; and the Mayor shall submit the budget to the
Council at the first regular meeting in May.
Charter Amendment
Shall Section 8.5 of the Charter of the City of Southfield be amended to provide that the Council
shall, adopt the budget for the next fiscal year at a Special Budget Meeting to be held not later that
the third week in June.

Charter Amendment _D
Shall Section 11.5(b) of the Charter of the City of Southfield be amended to provide that in the
event Council fails to make a temporary appointment within sixty (60) days of a vacancy in an
elective office, it shall order a Special Election to be held as soon as legally possible to fill such
vacancy for the balance of the unexpired term of said elective officer.
Charter Amendmilit E
Shall the Charter of the City of Southfield be amended by inserting a new Section 11.20 to provide
that, except as permitted by law, the City shall not discriminate against a person with respect to
luring, contracting, purchasing, the use of City facilities or the provision of City services on the basis
of religion, race, color, national origin, age, sex, height, weight marital status, or disability.

CHARTER AMENDMENT
Section 4.1 City Council; How Constituted; Term of Office.
(a) There shall be a council of seven (7) members. Subject only
to limitations and exceptions provided by this Charter or
other provisions of law, all powers of the City shall be
vested in and exercised by the Council, which shall
constitute the legislative body of the City, and which shall
have the power and authority to adopt such laws,
ordinances, and resolutions as it may deem proper in the
exercise thereof. In all cases, where the word "council" is
used in this Charter, the same shall be synonymous with the
word "commission", or any other term used in any state or
federal law referring to municipal, legislative, or governing
bodies.
(b) At the regular, City election held in the year 1963, and at
each regular, City election thereafter, there shall be elected
four (4) members of the Council, the three (3) candidates
receiving the highest number of votes for such office shall
hold their offices for a term of four (4) years, and the
candidate receiving the next highest number of votes for
such office shall hold his office for a term of two (2) years.
All such terms of office shall commence at 8:00 p.m., on the
second Monday following the City election, at which they
are elected and shall end when their respective successors
have been duly elected and qualified.
(c) The Council, at its second regular meeting in November of
each year, shall elect a presiding officer, to be known as
council president, and shall also elect a council president pro
tern. The term of each such office shall be one (1) year,
unless the officer is sooner removed by a vote of at least five
(5) members, in which case Council shall elect a successor
for the unexpired term.

Section 8.2 Budget Procedure.
On or before the first day of March of each year,
each City officer and department head shall submit
to the City Administrator, a proposed budget for the
next fiscal year. The City Administrator shall
submit the budgets to the Mayor on or before the
first day of April, and the Mayor shall submit the
budget to the Council at the first regular meeting in
May.

CHARTER AMENDMENT
Section 8.5 Adoption of Budget.
At a special budget meeting to be held not later than the
third week in June, the Council shall, by resolution
concurred in by at least five (5) members, adopt the budget
for the next fiscal year. The Council shall, in such
resolution, make an appropriation of the money needed for
municipal purposes during the next fiscal year and determine
the amount necessary to be raised by taxes upon real and
personal property for such purposes.

CHARTER AMENDMENT
Section 11.5 Vacancy Defined.
In addition to other provisions of this Charter, a
vacancy shall be deemed to exist when any elective
officer fails to qualify within the time prescribed in
section 11.3 of this Charter; a vacancy shall also
exist when an officer fails to qualify within ten (10)
days after his appointment, dies, resigns, is removed
from office, moves his legal residence from the City,
is convicted of a felony or breach of public trust, or
is judicially declared to be mentally incompetent.
Except as otherwise provided in this Charter,
vacancies in office shall be filled in the following
manner:
(a) Vacancies in appointive offices shall be filled
in the manner provided for making the
original appointment, and shall be filled for
the unexpired term.
(b) Vacancies in elective offices shall be filled by
temporary appointment by the Council by
majority vote of its members elect. Such
appointee shall hold office and serve until a
successor to fill such vacancy shall be elected
at the next regular, City election and
qualified. The successor officer elected at
said election shall hold office for the balance
of the unexpired term of the officer whose
vacancy is filled. In the event Council fails
to make a temporary appointment within
sixty (60) days of the vacancy, it shall order
a special election to be held as soon as legally
possible to fill such vacancy for the balance
of the unexpired term of said elective officer.
(c) If four (4) or more vacancies exist
simultaneously in the office of councilman,
the Clerk shall, within ten (10) days •
