HomeMy WebLinkAboutResolutions - 2015.07.29 - 21937MISCELLANEOUS RESOLUTION #15183 July 16, 2015 BY: Public Services Committee, Bill Dwyer, Chairperson IN RE: SHERIFF'S OFFICE-CONTRACT AMENDMENT #3 FOR LAW ENFORCEMENT SERVICES IN THE CHARTER TOWNSHIP OF INDEPENDENCE 2013-2015 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Charter Township of independence has contracted with the Oakland County Sheriffs Office to provide law enforcement services for the Township (MR. #12311); and WHEREAS paragraph 31 of this Contract provided that an amendment to this Contract must be approved by a resolution of the Oakland County Board of Commissioners and the Charter Township of Independence; and WHEREAS the Charter Township of Independence has shared a midnight contracted Deputy II (no-fill) with the Charter Township of Brandon; and WHEREAS the Charter Township of Independence has approved a proposed amendment to the contract which would add 1/2 of a Deputy II (no-fill); and WHEREAS the Charter Township of Brandon is in agreement and will add 1/2 of a Deputy II (no-fill); and WHEREAS the Sheriff has agreed to the provisions of Amendment #3 for the Charter Township of Independence under the terms of this contract. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves and authorizes its Chairperson to sign Amendment 3 to the original Oakland County Sheriff's Office 2013- 2015 Law Enforcement Services Agreement with the Charter Township of Independence. BE IT FURTHER RESOLVED that this amendment will take effect June 13, 2015. Chairperson, on behalf of the Public Services Committee, I move the adoption of the foregoing resolution. NOTE: No Trainees shall be assigned by the 0.C.S.O. to perform the duties of any SHERIFF'S DEPUTY contracted for and assigned to perform LAW ENFORCEMENT SERVICES under the terms of this Agreement. OAKLAND COUNTY SHERIFF'S OFFICE 2013-2015 LAW ENFORCEMENT SERVICES AGREEMENT WITH CHARTER TOWNSHIP OF INDEPENDENCE Amendment 3 Pursuant to paragraph 31 of the 2013-2015 Law Enforcement Services Agreement between the COUNTY and the CHARTER TOWNSHIP OF INDEPENDENCE, the parties hereby agree to amend said contract in accordance with the attached "Amendment 3 to Schedule A,'' effective June 13, 2015. All other contractual provisions, of the 2013-2015 Law Enforcement Services Agreement not otherwise affected by this Amendment remain in full force and effect. FOR AND IN CONSIDERATION of the mutual assurances, promises, acknowledgments, set forth in this Amendment 3 to the 2013-2015 Law Enforcement Services Agreement, ("Amendment") and for other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the undersigned hereby execute this Amendment on behalf of the Parties, and by doing so legally obligate and bind the Parties to the terms and conditions of this Contract. Kittle, Supervisor of the Charter Township of Independence, hereby acknowledges that he hereby executes this Amendment on behalf of the Municipality and hereby accepts and binds the Municipality to the terms and conditions of this Amendment. Building 38 East Pontiac, MI 48341 Re: Independence Township - Request to increase Staffing Sheriff Bouchard: Independence and Brandon Townships have shared the expenses for one midnight shift deputy since 2011. On May 4, 2015, Brandon Township approved a motion to replace their shared o f f i c e r with a full-time deputy. Independence Township agreed to take the same action and restor e proper staffing as well. On May 26, 2015 the Charter Township of Independence Board of Trustees approved Motion #2015-05-100 to amend the Oakland County Sheriff's Office 2013-2015 Law Enforcement Services Agreement with the Charter Township of Independence (Amendment 3) by adding one midnight shift deputy sheriff at a cost not to exceed $33,000. The incremental 1/2 of an officer and funding has been allocated for the remainder of 2015. Independence Township is requesting to increase current staffing of 29.5 officers to a total of 30 officers. Upon approval, Independence will then have 1 Lieutenant, 3 Command Sergeants, 5 Patrol Investigators and 21 Deputy II (No-Fill) officers. FISCAL NOTE (MISC. #15183) July 29, 2015 BY: Finance Committee, Tom Middleton, Chairperson IN RE: SHERIFF'S OFFICE — CONTRACT AMENDMENT #3 FOR LAW ENFORCEMENT SERVICES IN THE CHARTER TOWNSHIP OF INDEPENDENCE 2013 — 2015 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced resolution and finds: 1. The Charter Township of Independence has requested amendment #3 to the law enforcement contract with the Oakland County Sheriff's Office to provide law enforcement services to this community. 2. Resolution authorizes adding one-half (1/2) GF/GP FTE Deputy II (No-Fill) position (previously 50% of the position served Independence Township and 50% Brandon Township); increasing the number of deputies serving Independence Township from 29.5 to 30 positions. 3, The Law Enforcement contract Amendment #3 is effective June 13, 2015 through December 31, 2015. A contract extension is anticipated; the budget will be reviewed and amended at the time the 2016-2018 patrol contracts are presented to the Board of Commissioners for approval. 4.
