HomeMy WebLinkAboutResolutions - 2015.09.26 - 21997MISCELLANEOUS RESOLUTION #15229 August 26, 2015 BY: Public Services Committee, Bill Dwyer, Chairperson IN RE: PROSECUTING ATTORNEY - FY2015 TITLE IV-E CLIENT SERVICES CONTRACT (EXTENSION FOR FY 2016) — GRANT AMENDMENT OVER 15% To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS this amendment extends the contract period and increases funding for the Michigan Department of Health and Human Services (MDHHS) Title IV-E Agreement; and WHEREAS pursuant to and in compliance with MCL 712A.17(5), upon request of the Department of Health and Human Services of the State of Michigan (MDHHS), "the prosecuting attorney shall serve as a legal consultant" to the MDHHS and the Oakland County Prosecuting Attorney does so serve as legal consultant to the MDHHS; and WHEREAS the MDFIHS is required to comply with federal and state statutes governing investigation and placement of children (See MCL 722.622, et seq. and CFR Title 45) and the Oakland County Prosecutor's Office assists in that compliance, resulting in better outcomes for Oakland County families and better foster care case management; and WHEREAS Oakland County Prosecutor's Office entered into a contract with MDHHS approved by Miscellaneous Resolution #15061 to provide legal consultation regarding the abuse/neglect of children cases, court proceedings, establishment of protocol, petition information, and periodic strategy and training meetings with the MDDHS staff; and WHEREAS the contract is federal Title IV-E funds passed through MDHHS; and WHEREAS the original funding period was October 1, 2014 through September 30, 2015; and WHEREAS the one-year contract amendment period is October 1, 2015 through September 30, 2016; and WHEREAS the MDHHS has established the maximum amount of $544,217 that the Prosecutor's Office may bill for legal services during the contract amendment period: and WHEREAS the grant match requirement is met by the use of Title IV-E funding non-reimbursable portion of costs for legal representation of the MDFIFIS staff, and the MDHHS contract agency staff; and WHEREAS the existing staff at the Prosecutor's Office that currently represent the MDHHS will continue to do so under the contract amendment with no new positions requested; and WHEREAS this contract amendment has been reviewed and approved in accordance with the Board of Commissioners Grant Procedures. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the contract amendment between Oakland County and the MDHHS for the Prosecutor's Office to provide legal consultation regarding the abuse/neglect of children cases, court proceedings, establishment of protocol, petition information and periodic strategy and training meetings with the MDHHS staff. BE IT FURTHER RESOLVED that Oakland County is projected to receive maximum revenues of $544,217 for Title IV-E services provided October 1,2015 through September 30, 2016. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the contract award and to approve any contract extensions or changes, within fifteen percent (15%) of the original award. This amendment extends the grant period and increases funding for the Michigan Department of Health and Human Services (MDHHS) Title IV-E agreement, with the Prosecuting Attorney to provide legal consultation regarding the abuse/neglect of children cases, court proceedings, establishment of protocol, petition information, and periodic strategy and training meetings with MDHHS staff. 2. The original funding period was October 1, 2014 through September 30, 2015 approved by Miscellaneous Resolution #15061. 3. The one year grant extension is from October 1, 2015 through September 30, 2016. 4. With this contract extension there is a potential ability to generate a maximum of $544,217 in revenue over the year (not-to-exceed billable amount of $544,217) per the agreement with MDHHS. 5. The contract will be funded via Title IV-E pass through funds. 6. No County match is required, as the grant match requirement will be met by the use of Title IV-E funding (50%) non-reimbursable portion of costs for legal representation from the Department of Health and Human Services staff and MDHHS contract agency staff. 7. Existing staff at the Prosecutor's Office that currently represents MDHHS will continue to do so under this contract. There are no new grant positions being requested. 8. A budget amendment is recommended.
