IN RE: ECONOMIC DEVELOPMENT AND COMMUNITY AFFAIRS - RESOLUTION APPROVING THE
PROVISIONS OF A BROWNFIELD PLAN FOR THE DUNHILL PARK PROJECT- CITY OF NOVI
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the Oakland County Board of Commissioners, pursuant to and in accordance with the
provisions of the Brownfield Redevelopment Financing Act, being Act 381 of the Public Acts of the State
of Michigan of 1996, as amended (the "Act"), have established a redevelopment of Brownfields
Redevelopment Authority and Board (OCBRA) to facilitate the cleanup and redevelopment of Brownfields
within Oakland County's communities; and
WHEREAS the Dunhill Park Project in The City of Novi (the "Property") is an environmental hazard, a
"facility" under state statute and a non-producing parcel; and
WHEREAS a Brownfield clean up and redevelopment plan (the "Plan") has been prepared to restore the
environmental and economic viability to this parcel; and
WHEREAS pursuant to OCBRA by-laws, a local committee has been appointed, participated in
discussions regarding the proposed plan and project, reviewed the plan, and recommends its approval;
and
WHEREAS the City of Novi has reviewed the Plan, and has been provided a reasonable opportunity to
express views and recommendations regarding the Plan in accordance with Sections 13 (13) of the Act,
and has concurred with the provisions of the Plan; and
WHEREAS the OCBRA, pursuant to and in accordance with Section 13 of the Act, has approved a
resolution (attached) adopting the Plan, and recommends the adoption of the Plan by the Oakland County
Board of Commissioners to be carried out within the City of Novi relating to the Dunhill park
redevelopment.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners does hereby
adopt the Brownfield Redevelopment Plan to be carried out within the City of Novi, relating to the Dunhill
Park Project redevelopment.
BE IT FURTHER RESOLVED that a public hearing on the adoption of the Brownfield Plan approved by
the Oakland County Brownfield Redevelopment Authority for the Dunhill Park Project redevelopment in
the City of Novi shall be held on April 21, 2016 at 9:30 AM in the Oakland County Board of
Commissioners' Auditorium, 1200 North Telegraph Road, Pontiac, Michigan.
Chairperson, on behalf of the Planning & Building Committee, I move the adoption of the foregoing
resolution.

WHEREAS, per the Oakland County Brownfield Redevelopment Authority (BRA) Bylaws, Article II
Section 9. Not less than sixty days prior to the submittal of any proposed Brownfield redevelopment plan to the
BOC pursuant to Section 14(a) of the Act, by resolution the Board shall appoint a committee for any such
proposed plan to allow for input of the city, village or township involved. The committee shall consist of a
minimum of one or more of the Directors of the Board, as well as one elected official, or his/her designee from
the affected city, village, or township. The committee so appointed shall make recommendations to the Board,
which shall include or address any changes to the Brownfield redevelopment plan sought by the city, village or
township, as well as any other significant concerns or issues raised by the city, village or township.
WHEREAS, Dan Hunter (Oakland County BRA) and Victor Cardenas, Assistant City Manager, City of
Novi have been designated to serve on the Local Host Committee since February 16, 2016 for the Dunhill Park
project
WHP,REAS, all parties involved with this project and the specific persons nominated for this committee
have meet about this project on February 16, 2016: and,
THEREFORE, be it resolved, to approve and ratify the appointment of Dan Hunter, Oakland County
BRA along with Victor Cardenas, Assistant City Manager City of Novi to serve on the Dunhill Park project
committee.

RESOLUTION TO APPROVE A BROWNFIELD REDEVELOPMENT PLAN
FOR THE DUMITLL PARK BROWNFIELD PROJECT
March 10, 2016
WHEREAS, Dunhill Park in the City of Novi has been an environmental hazard, a "faeility:_under state

WHEREAS, a clean up and redevelopment plan has been established to restore the environmental and
economic viability to the Dunhill Park parcel; and,
WHEREAS, the local host committee consisting of Victor Cardenas, Assistant City Manager from the

:Brownfield plan dated February 16, 2016; and, •
WHEREAS, the BRA Board has reviewed the proposed plan; now,
THEREFORE, BE IT RESOLVED, the Brownfield Plan for the Dunhill Park project was approved by
the OCBRA on March 10, 2016 by a majority vote of 6 yeas to 1 nay, provided that:
1. the Brownfield plan is also approved by the City of Novi at their meeting on March 14, 2016;
and,
2. a letter of transmittal of environmental reports including documentation that classifies the site as
a facility including but not limited to any site investigation report; and,
3. in the event the State does not approve the 381 work plan, the 381 work plan would be subject
to the OCBRA consultant for approval
4. the 381 work plan will include description and conditions that demonstrate that the work done
was necessary; and,
5. the final approval is subject to the Oakland County Board of Commissioners review process in
which it's corporation Council will review the language of the reimbursement agreement; and,
6. the plan will be amended to reflect two changes:
a. attachment D administrative line will reflect $60,000 in capture not $55,000
b. the 15% factor language on page 3 of the plan will be removed
BE IT FURTHER RESOLVED, to recommend the adoption of this plan by the Oakland County Board
of Commissioners, and. its Planning & Building and Finance Committee.

WHEREAS, Dunhill Park in the City of Novi has been a environmental hazard, a "facility' under state
statute, and a non-producing parcel for many years; and,
WHEREAS, A Bro-wnfield plan was approved with amendment and conditions by the Oakland County
Brownfield Redevelopment Authority (OCBRA) on March 10, 2016; and,
WHEREAS, a reimbursement agreement has been drafted to accompany the Brownfield plan for the
Dunhill Park parcel; and,
WHEREAS, the reimbursement agreement between the OCBRA and Hunter Pasteur Homes Dunhill
Park, LLC. Outlines the roles and responsibilities of both parties for the development and reimbursement of
funds for the Dunhill Park project; and,
WHEREAS, the OCBRA has reviewed the proposed reimbursement agreement; now,
THEREFORE, BE IT RESOLVED, the reimbursement agreement for the Dunhill Park project was
approved by the OCBRA on March 10, 2016 by a majority vote of 6 yeas to 1 nay, provided that:
1. the Brownfield plan is also approved by the City of Novi March 14, 2016; and,
2. paragraph SD of page 4 of the reimbursement agreement be deleted; and,
3. comply and reflect the conditions and amendments as set by the OCBRA in the Brownfield plan
approval resolution
BE IT FURTHER RESOLVED, to recommend the adoption of this reimbursement agreement by the
Oakland County Board of Commissioners, and its Planning & Building and Finance Committee.

The following preamble and Resolution were offered by C:ouncilmember Wrobel
and supported by Councilmember Gatt.
WHEREAS, the City of Novi has been approached by a developer, Hunter
Pastuer Homes, with a request for a Brownfield project in connection with a
development known as Dunhill Park; and
WHEREAS, the City would like the project reviewed and processed by the
Oakland County Brownfield Redevelopment Authority; and
WHEREAS, the Oakland County Brownfield Redevelopment Authority was
created by Oakland County pursuant to MCL 125.2651 et seq. to assist
jurisdictions like the City of Novi, which does not have its own Brownfield
Authority; and
WHEREAS, the Oakland County Brownfield Redevelopment Authority is
prepared to assist City of Novi by reviewing the proposed Dunhill Park project,
provided that City of Novi acknowledges certain rights that the Oakland County
Brownfield Redevelopment Authority has, to wit:
OCBRA intends to collect an administrative fee of $5,000.00 per year for
the length of the Brownfield plan; and
OCBRA will capture and collect an amount of $50,000 from the project
that will be placed in the OCBRA revolving loan fund for future
remediation projects.
WHEREAS, the City of Novi will have the opportunity to provide public
comment on any Brownfield plan (including the amount of the administrative
fee to be collected and the amount that will be captured for the revolving loan
fund) before it is finally adopted by the OCBRA and/or the Oakland County
Board of Commissioners;
RESOLUTION DECLARED ADOPTED.
NOW BE IT THEREFORE RESOLVED that City of Novi requests that the OCBRA
undertake revieW of the Dunhill Park Project.
IT IS FURTHER RESOLVED THAT City of Novi acknowledges and understands
that COBRA intends to collect certain administrative fees and certain taxes for its
revolving loan fund, which will be specified in detail in any Brownfield Plan
before it is finally adopted.

WHEREAS, the Oakland County Board of Commissioners, pursuant to and in
accordance with the provisions of the Brownfield Redevelopment Financing Act, being

prepared to restore the environmental and economic viability to this parcel which the
DC BRA has reviewed and approved; and
WHEREAS, pursuant to OCBRA by-laws, a local committee has been appointed,
participated in discussions regarding the proposed plan and project, reviewed the
plan, and recommends its approval; and
WHEREAS, the OCBRA, pursuant to and in accordance with Section 13 of the
Act, shall consider recommending that the Oakland County Board of Commissioners
approve the Brownfield Plan to be carried out within the City of Novi, relating to the
redevelopment of the property; and
.WHEREAS, the City has reviewed the Plan, and has been provided a reasonable
opportunity to express its views and recommendations regarding the Plan in
accordance with Sections 13(13) of the Act.
NOW THEREFORE BE IT RESOLVED THAT, the City of Novi hereby concurs with the
provisions of the Plan including approval of the Plan by the Oakland County Board of
Commissioners and implementation of the Plan by the Oakland County Brownfield
Redevelopment Authority.
BE IT FURTHER RESOLVED THAT should any section, clause, or phrase of this
Resolution be declared by a court of competent jurisdiction to be Invalid, the same
shall not affect the validity of this Resolution as a whole, nor any part thereof other than
The part so declared to be invalid.
BE IT FURTHER RESOLVED THAT all resolutions or parts of resolutions in conflict with
any of the provisions of this Resolution are hereby repealed.

I. INTRODUCTION
In order to promote the revitalization of environmentally impacted and other eligible
areas within the boundaries of Oakland County, Michigan (the "County"), the County has
established the Oa_Hand County Brownfield Redevelopment Authority (the "OCBRA")
pursuant to Michigan Public Act 381 of 1996, as amended ("Act 381").
The primary purpose of this Brownfield Plan ("Plan") is to promote the redevelopment of
and private investment in certain "brownfield" properties within the County. Inclusion of
property within this Plan will facilitate financing of environmental response and other
eligible activities at eligible properties, and will also provide tax incentives to eligible
taxpayers willing to invest in revitalization of eligible sites, commonly referred to as
"brownfields." By facilitating redevelopment of brownfield properties, this Plan is
intended to promote economic growth for the benefit of the residents of the County and
all taxing units located within and benefited by the OCBRA.
This Plan is intended to apply to the eligible property identified in this Plan and, if tax
increment revenues are proposed to be captured from that eligible property, to identify
and authorize the eligible activities to be funded by such tax increment revenues.
This Plan is intended to be a living document, which may be modified or amended in
accordance with the requirements of Act 381, as necessary to achieve the purposes of
Act 381. The applicable sections of Act 381 are noted throughout the Plan for reference
purposes.
This Brownfield Plan describes the project to be completed (see Attachment C) and
contains information required by Section 13(1) of Act 381.
II. GENERAL PROVISIONS
A. Description of the EliRible Property (Section 13 (1)(h)) and the Project
The property comprising the eligible property consists of two (2) parcel(s) located at
47500 Eight Mile Road and 47700 Eight Mile Road, Novi, Michigan. The parcels are a
facility or adjacent and contiguous to a facility within the meaning of Act 381.
Hunter Pasteur Homes Dunhill Park TIC is the project developer ("Developer"). The
project is the development of 23.76 acres of land into 31 building lots, including utilities,
roadways and other improvements, and the intended construction thereon and sale of
31 single family homes.
Attachment A includes a site map of the parcel. The property is located on the north side
of Eight Mile Road, west of Beck Road.

The parcels located thereon and improvements will comprise the eligible property and is
referred to herein as the "Property."
Attachment C provides a description of the project to be completed at the Property (the
Project). The Project description provided herein is a summary of the proposed
development at the time of the adoption of the Plan. The actual development may vary
from the project description provided herein, without necessitating an amendment to this
Plan, so long as such variations arise as a result of changes in market and/or financing
conditions affecting the project and/or are related to the addition of amenities to the
project. Any material or substantive changes to the project description may he subject to
an amendment as determined by the OCBRA Board of Directors and shall be consistent
wi-th the overall nature of the proposed development, its proposed purpose, and the
purposes of Act 381.
B. Basis of Eligibility (Section 13 (1)(h) and Section 2 (n))
The Property is considered "eligible property" as defined by Act 381, Section 2, because
(a) the Property was previously utilized or is currently utilized for a commercial purpose;
(b) it is located within the City of Novi, County of Oakland; and (c) the Property is
determined to be a facility or adjacent and contiguous to a facility as defined by Act 381.
Soil testing has determined the presence of impacted soils containing arsenic at levels
exceeding the unrestricted residential criteria established by the Michigan Department of
Environmental Quality as well as the regional background level.
C. Summary of EliRible Activities and Description of Costs (Section 13 (1)(a),(b))
The "eligible activities" that are intended to be carried out at the Property are considered
"eligible activities" as defined by Section 2 of Act 381, because they include Baseline
Environmental Assessment activities, due care activities, potential additional response
activities and development and preparation of a brownfield plan and a work plan. A
summary of the eligible activities and the estimated cost of each eligible activity intended

to be paid with tax increment revenues from the Property are shown in the table attached
hereto as Attachment D. The eligible activities described in Attachment D are not

Act 381 and the performance of such eligible activities does not exceed the total costs
stated in Attachment D.
It is currently anticipated construction will begin in 2016 and eligible activities are
expected to be completed in 2018.
The Developer desires to be reimbursed for the costs of eligible activities. Tax increment
revenue generated by the Property will be captured by the OCBRA and used to reimburse
the cost of the eligible activities completed on the Property either before or after approval
of this Plan pursuant to the temis of a Reimbursement Agreement with the OCBRA (the
"Reimbursement Agreement"), subject to limits contained in Act 381.
The costs listed in Attachment D are estimated costs and may increase or decrease
depending on the nature and extent of environmental contamination and other unknown
conditions encountered on the Property. The actual cost of those eligible activities
encompassed by this Plan that will qualify for reimbursement from tax increment
revenues of the OCBRA from the Property shall be governed by the terms of the
Reimbursement Agreement. No costs of eligible activities will be qualified for
reimbursement except to the extent permitted in accordance with the terms and conditions
of the Reimbursement Agreement and Section 2 of Act 381. The Reimbursement
Agreement and this Plan will dictate the total cost of eligible activities subject to
.payment, provided that the total cost of eligible activities subject to payment or
reimbursement under the Reimbursement Agreement shall not exceed the estimated costs
set forth above by more than 15% without an amendment to this Plan. As long as the
total costs, adjusted by the 15% factor, are not exceeded, line item costs of eligible
activities may be adjusted after the date this Plan is approved by the Oakland County
Board of Commissioners, to the extent the adjustments do not violate the teims of the
approved MDEQ or MSF work plan, if applicable.
D. Estimate of Captured Taxable Value and Tax Increment Revenues
(Section 13(1)(c)); Beginning Date of Capture of Tax Increment Revenues
(Section (13)(1)(f); Impact of Tax Increment Financing on Taxing Jurisdictions
(Section 13(1)(g))
This Plan anticipates the capture of tax increment revenues to reimburse the Developer
for the costs of eligible activities under this Plan in accordance with the Reimbursement
Agreement. A table of estimated tax increment revenues to be captured is attached to this
Plan as Attachment E.

In no event shall the duration of the Plan exceed 35 years following the date of the
resolution approving the Plan, nor shall the duration of he tax capture exceed the lesser
of the period authorized under subsection (4) and (5) of Section 13 of Act 381 or
30 years. Further, in no event shall the beginning date of the capture of tax increment
revenues be later than five years after the date of the Oakland County Board of
Commissioners resolution adopting the Plan.
E. Plan of Financing (Section 13(1)(d))j Ma ximum Amount of Indebtedness
(Section 13(1)(e))
The eligible activities are to be financed solely by the Developer. The OCBRA will
reimburse the Developer for the cost of approved eligible activities, but only from tax
increment revenues generated from the Property. No advances have been or shall be
made by the City or the OCBRA for the costs of eligible activities under this Plan.
All reimbursements authorized under this Plan shall be governed by the Reimbursement
Agreement. The inclusion of eligible activities and estimates of costs to be reimbursed in
this Plan are intended to authorize the OCBRA to fund such reimbursements and does not
obligate the OCBRA, Oakland County or the City of Novi to fund any reimbursement or
to enter into the Reimbursement Agreement providing for the reimbursement of any costs
for which tax increment revenues may be captured under this Plan, or which are
permitted to be reimbursed under this Plan. The amount and source of any tax increment
revenues that will be used for purposes authorized by this Plan, and the terms and
conditions for such use and upon any reimbursement of the expenses permitted by the
Plan, will be provided solely under the Reimbursement Agreement contemplated by this
Plan.

The OCBRA shall not incur any note or bonded indebtedness to finance the puiposes of
this Plan.
Reimbursements under the Reimbursement Agreement shall not exceed the cost of
eligible activities permitted under this Plan.
F. Duration of Plan (Section 13(1)(1))
Unless otherwise agreed to in writing by the OCBRA, this Plan shall expire and no longer
be valid if:
a. The Developer does not receive the applicable work plan approvals by the
Michigan Strategic Fund and the Michigan Department of Environmental Quality, as may
be required pursuant to Act 381, or
b. The Developer and the OCBRA have not finalized and executed the
Reimbursement Agreement, if required, within one hundred and eighty (180) days after
the date this Plan is approved by Oakland County Board of Commissioners, or such
other date as the OCBRA may agree to in writing.
In no event, however, shall this Plan extend beyond the maximum tenn allowed by
Section 13(1)(f) of Act 381 for the duration of this Plan.
G. Effective Date of Inclusion in Brownfield Plan
The Property will become a part of this Plan on the date this Plan is approved by the
Oakland County Board of Commissioners.
H. Displacement/Relocation of Individuals on Eligible Property (Section 13(1)(i4))
There are no persons or businesses residing on the eligible property and no occupied
residences will be acquired or cleared, therefore there will be no displacement or
relocation of persons or businesses under this Plan.
L Local Site Remediation Revolving Fund ("LSRRF") (Section 8; Section 13(1)(m))
The OCBRA has established a Local Site Remediation Revolving Fund (LSRRF). The
sum of Ten Thousand Dollars ($10,000.00) per year will be deposited into the LSRRF
commencing immediately after the Developer has been fully reimbursed under this Plan
and the administrative fee has been paid to the OCBRA pursuant to the reimbursement
agreement to be entered into by the Developer and the OCBRA, and shall continue for
five (5) years. The amount of tax increment revenue authorized for capture and deposit in
the LSRRF is estimated at $50,000.00.

Eligible activities currently are expected to include the following:
1. Preparation of a Plan for Response Activities ("Plan") and submittal of the Plan to
the MDEQ for review and approval.
2. Baseline environmental assessment investigation activities such as sampling and
other site investigations conducted commencing in 2014.
3. One or more baseline environmental assessments may be conducted on portions
of or the entire property that is the subject of the brownfield plan.
4. One or more documentations of due care compliance may be prepared for
portions of or the entire property that is the subject of the brownfield plan.
5. Qualified environmental professionals will observe and obtain samples of soils
and water encountered during construction in portions of the property where
hazardous substances may be present at levels exceeding unrestricted residential
criteria applicable to the property. Samples will be evaluated to deteunine if off
site disposal or other additional response activities should be conducted.

of Michigan of 1996, as amended (the "Act"), have established a redevelopment of Brownfields
Redevelopment Authority and Board (OCBRA) to facilitate the cleanup and redevelopment of Brownfields
within Oakland County's communities; and
WHEREAS the Dunhill Park Project in The City of Novi (the "Property") is an environmental hazard, a
"facility" under state statute and a non-producing parcel; and
WHEREAS a Brownfield clean up and redevelopment plan (the "Plan") has been prepared to restore the
environmental and economic viability to this parcel; and
WHEREAS pursuant to OCBRA by-laws, a local committee has been appointed, participated in
discussions regarding the proposed plan and project, reviewed the plan, and recommends its approval;
and
WHEREAS the City of Novi has reviewed the Plan, and has been provided a reasonable opportunity to
express views and recommendations regarding the Plan in accordance with Sections 13 (13) of the Act,
and has concurred with the provisions of the Plan; and
WHEREAS the OCBRA, pursuant to and in accordance with Section 13 of the Act, has approved a
resolution (attached) adopting the Plan, and recommends the adoption of the Plan by the Oakland County
Board of Commissioners to be carried out within the City of Novi relating to the Dunhill park
redevelopment .
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners does hereby
adopt the Brownfield Redevelopment Plan to be carried out within the City of Novi, relating to the Dunhill

Pursuant to your request, McDowell & Associates has completed this Progress Report to
summarize results of Incremental Soil Sampling and Analyses for a former orchard area on the
subject property. A Site Location Map, which shows the approximate location of the subject
property, is included as Attachment I.
As part of this assessment, McDowell & Associates conducted an Incremental Sampling
Methodology (ISM) approach to characterize the former orchard area. The former orchard area
was divided into twelve approximate 0.5-acre Decision Units (DU). Between 48 and 55
systematic random increment samples were collected from each of the DLTs, and a triplicate
sample was collected from one of the DUs.. Samples were submitted for testing to determine the
presence of arsenic.
Results of chemical testing show concentrations of arsenic in Decision Units 2 through 9 and 12
below the established Regional Background Level for arsenic of 15 mg/kg and would not require
remediation..
Arsenic concentrations in surface soil (0 — 6") at Decision Units 1, 10, and 11 ranged from16
mg/kg to 27 mg/kg, which exceed the Regional Background Level calculated for arsenic.
Results of chemical testing of incremental samples collected from those Decision Units from
depths of 6"- 12" showed arsenic in DU 1 and DU 10 below the Regional Background Level and
in DU 11 above the Regional Background. Results of an incremental sample collected from DU
11 from a depth of 12" — 18" was below the Regional Background Level.

Based on that information, the estimated volume of soil requiring remediation to meet MDEQ
Criteria for Generic Residential Closure and unrestricted residential use in that area is
approximately 2,000 in-place cubic yards. Assuming a soil expansion factor of 1.5, total truck
yar-cls-would-be-ealeulated-to-be-3-,000-yards.
It should be noted that some rubble fill material was encountered within some of the DIA. This
material may result in an increase to the soil expansion factor.
This assessment was completed for the exclusive use of Archdiocese of Detroit and Franklin
Properties, and each may rely on its contents.
The results of our investigation are presented below.
Background
Review of historic aerial photographs identified what appeared to be a former orchard on the
south-central portion of the subject property since prior to 1949 and 1961. Historic orchard
growers tended to use pesticides which are residual in nature.
In 2006, McDowell & Associates completed soil sampling and analyses in the former orchard
area using discrete methodologies. Results of sampling and testing of 98 soil samples showed
arsenic in soil at concentrations ranging between 4.1 mg/kg and 52 mg/kg. Since that
investigation, the MDEQ has announced their acceptance of the use of incremental Sampling
Methodologies for characterization of sites.
Regional Background Level for Arsenic
Arsenic occurs naturally in soil, and often occurs in southeast Michigan at concentrations above
the Michigan Statewide Default Background Level. Current lvDEQ guidelines permit the
calculation of a Facility-Specific Background Level if metals are found above Statewide Default
Background Levels and are suspected of being naturally occurring.
According to the MDEQ Sampling Strategies and Statistics Training Materials for Part 201
Cleanup Criteria (S 3TM, 2002), the objective of using a Background Level is to determine
whether site concentrations are significantly higher than what would be expected of a naturally
occurring condition.
The S 3TM presents a series of statistical tests that can be completed to evaluate a background
data set, A minimum of nine samples are to be obtained from a background area and analyzed for
the metal in question. According to the S 3TM, the data set should be evaluated for its statistical
distribution using calculated summary statistics, probability plots, and the Shapiro-Wilk test (less
than 50 data points) or the Shapiro-Francia test (greater than 50 data points), The final choice of
the statistical distribution should be based upon evaluation of the collective results of the
different methods described, in general, the data set is considered valid if it has a normal or
lognoitual distribution.

The mean value of the sample concentrations along with the standard deviation are used to
calculate a Facility-Specific Background Level, which is equivalent to the mean plus three
standard deviations.
As part of our investigation in 2006, McDowell & Associates collected soil samples from a
background (non-orchard area at higher elevation) location on the subject property for testing in
2006. Samples were designated BG-1 though BG-12. Samples were collected from topsoil ("a")
and clay ("b") below ground surface. Background samples were submitted for chemical testing
to determine the presence of arsenic. Arsenic concentrations in "a" ranged from 4.6 mg/kg to 7.7
mg/kg and in "b" between 5.3 mg/kg and 8.9 mg/kg. The Facility-Specific Background Level
calculated for arsenic in topsoil "a"rwas 7.7 mg/kg and for clay "b" was 11 mg/kg,
Based on our experience with topsoil background testing in the Novi area, the calculated
Facility-Specific Background Level for arsenic using the 12 background samples was not
consistent with what we would expect. Therefore, McDowell & Associates conducted an
evaluation of our in-house topsoil background data for arsenic in the Novi area,
McDowell & Associates compiled background topsoil arsenic data from 25 sites that we have
sampled in Novi, Northville, Commerce, Lyon, and Farmington Hills. These areas were selected
due to their proximity to the subject property and that they are also within the Huron-Erie Glacial
Lobe. The data set consisted of 350 topsoil grab samples obtained from 0" - 6" from about 2000
through 2012. Test results range from <0.1 mg/kg to 38 mg/kg. Statistical tests were performed
on the data set, and it was concluded that three of the values (<0.1 mg/kg, 0.22 mg/kg and 38
mg/kg) were outliers. Those values were removed from the data set. Calculations that show
outlier testing are provided in the calculations attachment.
Statistical tests on the remaining 347 sample results for both raw and log-transfoimed data
showed the following:
Minimum: 1.2 mg/kg
Maximum; 20 mg/kg
Mean: 6.78 mg.kg
Standard Deviation: 2.88
Coefficient of Variation: 0.42 (raw) and 0.22 (log-transformed)
Coefficient of Skewness: 1.49 (raw) and —0.13 (log-transformed)
Probability Plot (R2): 0,891 (raw) and 0.981 (log-transfolined)
The data set has a log-normal distribution. The Regional Background Level calculated from the
data set is 15 mg/kg. This Regional Background Level is consistent with the recent 1VIDEQ
"Draft" Interim Process for Addressing Elevated Background Concentrations of Arsenic in
Southeast Michigan Soils which identifies concentrations between 12 mg/kg and 16 rag/kg as
typical concentrations.
McDowell & Associates requested written concurrence from MDEQ of the appropriateness
of using 15 mg/kg as an acceptable Regional Background Level for topsoil for comparative

purposes at a nearby property in 2012. A written response was received on August 27, 2012,
which indicates the department agrees with comparing soil results to a Regional Background
Level of 15 mg/kg.
Field Work
McDowell & Associates divided the former orchard area into twelve approximate 0.5-acre
"Decision Units" (DU) designated DU-1 through DU-12. The DUs are depicted on the
accompanying Decision Unit Map.
Each DU was g-ridded into between 48 and 55 sections, and a systematic random sampling
approach was utilized within each of the sections. Increment samples from 0" to 6" bgs were
obtained from each section with the DU on July 14, 2014. Two replicate systematic random
samples were collected from DU-3, and designated DU-3A, DU-3B, and DU-3C.
Based on results of initial testing, additional incremental samples were collected from DU-1,
DU-l0 DU-11 on July 25, 2014 from depths between 6"- 12" and from DU-11 at 12"- 18"
on August 14, 2014 using the same approach listed above.
A random number generator was utilized to select sample locations within each of the sections.
Samples were collected by McDowell & Associates utilizing direct push methods. Sampling
tools were cleaned between samples to limit cross-contamination.
Samples were placed in labeled and laboratory-provided containers and hand-delivered to a
representative of Trace Analytical Laboratories, Inc. of Muskegon, Michigan, for chemical
testing. Sample chain-of-custody documentation is attached.
Chemical Testing Program
Samples were submitted to Trace Analytical Laboratories, Inc. of Muskegon, Michigan for
chemical testing to determine the presence of arsenic (Method 6020), Samples were processed
and prepared at the laboratory using US EPA SW-846 Method 8330B.
Chemical Test Results
The accompanying Table 1 summarizes arsenic concentrations for each DU in comparison to the
Regional Background Level and MDEQ Generic Residential Criteria.
Results of chemical testing of DU-3A, DU-39, and DU-3C showed arsenic concentrations of
4.0, 4,0, and 4.2 mg/kg, with a mean of 4.07 mg/kg, a standard deviation of 0.115, and a
coefficient of variation of 0.03.

potential for recognized environmental conditions in connection with the property within
reasonable limits of time and cost. The conclusions represent our professional opinion based
upon infoimation obtained during assessment procedures and may not represent those that would
be made under other conditions.
Nothing in this report constitutes a legal opinion or legal advice. It is suggested that
environmental counsel be retained to evaluate site conditions and property transaction-related
issues from a legal perspective.
Property lines and soil sample locations estimated on maps are estimates and are limited by scale
inaccuracies. The approximate boundaries shown on report attachments are not intended to be

To The Oakland and County Board of Commissioners
Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced
resolution and finds:
1. The resolution adopts a Brownfield Plan relating to the clean-up and redevelopment of property at
Dunhill Park Project in the City of Novi to restore the property's environmental and economic
viability.
2. The developer, Hunter Pasteur Homes Dunhill Park LLC, has assumed environmentally related
development costs estimated at $1,836,374 including remediation of environmental impacts,
environmental investigations, due care, administrative controls, and preparation of environmental
reports.
3. The cost of these eligible plan activities will be reimbursed to the developer by the Oakland
County Brownfield Redevelopment Authority (OCBRA) from tax capture based on the incremental
difference on the taxable value of the property; estimated at $454,992 for Oakland County
capture amount.
4. No budget amendment is required as the budget already includes an estimate for tax capture
offsets.
