HomeMy WebLinkAboutResolutions - 2016.06.16 - 22395MISCELLANEOUS RESOLUTION #16138 May 18, 2016 BY: Human Resources Committee, Robert Hoffman, Chairperson IN RE: HUMAN RESOURCES DEPARTMENT - CHANGE TO MERIT RULES 14, 21 AND 22 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the County Executive has put forth for approval a Parental Leave Policy to provide six (6) consecutive weeks at 100% of current salary at 40 hours per week to allow for bonding time following the birth or adoption of a child; and WHEREAS this policy will effect Oakland County leaves of absence with pay, adherence to the Family and Medical Leave Act (FM LA), as well as employee benefits coverage; and WHEREAS the Merit Rules have been reviewed and it has been determined that changes are necessary to Rules 14, 21 and 22 to allow for this; and WHEREAS Section IV, Subsection A of the Merit System Resolution requires that all changes in the Niles an d regulation s of- the Wit" Systerg Wall be slillmitted --to-the -Bo ard- of -Com m issio ners-at-a regular meeting of the Board and shall become effective thirty (30) days after such meeting unless an objection is received in writing by the Chairperson of the Board of Commissioners, in which case the objection shall become a matter of business at the next meeting of the Board. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes that the reading and distribution of this notice and copy of the proposed change to Merit Rule 14, 21 and 22 to all Commissioners present and absent, is considered as the official submission to the Board of Commissioners of the described changes in Merit Rule 14, 21 and 22, BE IT FURTHER RESOLVED that changes to the Merit Rules be cross referenced by the appropriate Board of Commissioners' Resolution number authorizing such change. Full time appointed and employees excluded from Merit Rule provisions covering the manner of selection, appointment or removal from employment are included. 14.4.2.2 An eligible parent is defined as a mother or father with parental rights to the child. 14.4.3 None Currently 14.4.3 Pay and Benefits During Parental Leave 14.4.3.1 Parental Leave is paid at 100% of an employee's current straight time rate of pay for six consecutive weeks (40 hours per week, maximum to be paid 240 hours). 14.4.3.2 Employees will continue to accrue leave time while on Parental Leave. Section IV Subsection A of Merit System Resolution Copies of the rules and regulations developed by the Personnel Committee and all future changes in such rules and regulations shall be submitted to the Board of Commissioners at a regular meeting of the Board of Commissioners and shall become effective thirty days after such meeting unless objection is received in writing by the Chairman of the Board of Commissioners, in which case the objection shall become a matter of business at the next meeting of the Board of Commissioners, PROPOSED CHANGE IN MERIT SYSTEM RULE RULE NUMBER 14 RULE NUMBER 14 14.4.4 Current Wording Proposed Wording None Currently 14.4.4 Using Parental Leave 14.4.4.1 Parental Leave may not be used for the five day waiting period before short-term disability begins. 144.4.2 Parental Leave must be used for six (6) consecutive weeks. Unused Parental Leave will be forfeited if the employee chooses to return to work before the end of the six (6) week Parental Leave period. 14.4.4.3 Intermittent Parental Leave is not permitted. 14.4.4.4 Parental Leave for the mother will begin immediately after the termination of short- term disability. 14.4.4.5 Parental Leave for the father or spouse will begin the day after the birth event. Parental Leave will begin the day of the adoption or placement for adoption for mother, father or spouse. 14.4.4,6 Parental Leave will be granted per birth or adoption event; multiple births or adoptions in one event does not increase the amount of Parental Leave time granted. 14.4.5 None Currently 14.45 Application for Parental Leave 14.4.5.1 A Parental Leave form shall be completed and submitted to the Human Resources Department at least 30 days before Parental Leave is to be used. Employees must submit sufficient documentation of birth or placement for adoption to the Human Resources Department in order to complete the Parental Leave approval process, 14.4.5.2 The Human Resources Department is responsible for reviewing and approving all requests for Parental Leave. 14.4.5.3 Submitting false information or falsified documents in support of or in connection with Parental Leave is subject to disciplinary action up to and including termination. PROPOSED CHANGE IN MERIT SYSTEM RULE-draft RULE NUMBER 21 Current Wording 214.11 Does not receive pay from the County unless the employee is having time deducted from their available leave banks in accordance with section 21.1.3. RULE NUMBER 21 Proposed Wording 21.4.1.1 Does not receive pay from the County unless the employee is on Parental Leave pursuant to Merit Rule 14.4 or is having time deducted from their available leave banks in accordance with section 21.1.3 of this rule. 21.4.1.2 Does not earn Annual Leave except for the time period during which the employee is having time deducted from their available leave banks in accordance with section 21.1.3 or receiving short term disability payments. 21.4.1.2 Does not earn Annual Leave except for the time period during which the employee is on Parental Leave pursuant to Merit Rule 14.4, is receiving short term disability payments or is having time deducted from their available leave banks in accordance with section 21,1.3. 21.4.1.3 Does not get paid for Legal Holidays occurring during the Family Leave unless the employee's leave banks covered the day immediately preceding the holiday and the day immediately following the holiday. 21.4.1,3 Does not get paid for Legal Holidays occurring during the Family Leave unless the employee's leave banks covered the day immediately preceding the holiday and the day immediately following the holiday. Ineligibility or exhaustion of FMLA does not preclude eligibility for Parental Leave pursuant to Merit Rule 14.4. FISCAL NOTE (MISC. #16138) June 16, 2016 BY: Finance Committee, Tom Middleton, Chairperson IN RE: HUMAN RESOURCES DEPARTMENT — CHANGE TO MERIT RULES 14, 21 AND 22 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced resolution and finds: 1. The resolution authorizes changes to Merit Rules 14, 21 and 22 due to the Parental Leave Benefit Policy. 2, Section IV, Subsection A of the Merit System Resolution requires that all changes in rules and regulations of the Merit System shall be submitted to the Board of Commissioners at a regular meeting of the Board and shall become effective thirty (30) days after such meeting unless an objection is received in writing by the Chairperson of the Board of Commissioners, in which case the objection shall become a matter of business at the next meeting of the Board. 3. The Oakland County Board of Commissioners authorizes that the reading and distribution of this notice and copy of the proposed change to Merit Rule 14, 21 and 22 to all Commissioners present and absent, is considered as the official submission to the Board of Commissioners of the described changes in Merit Rule 14, 21 and 22. 4. Merit Rule changes will be cross referenced by the appropriate Board of Commissioners' Resolution number authorizing such change. 5. No Budget Amendment is required.
