HomeMy WebLinkAboutResolutions - 2016.08.18 - 22509MISCELLANEOUS RESOLUTION #16211 August 18, 2016 BY: General Government Committee, Christine Long, Chairperson IN RE: DEPARTMENT OF HEALTH AND HUMAN SERVICES/HEALTH DIVISION — AMENDMENT #1 OF THE INLAND BEACH GRANT CONTRACT WITH THE MICHIGAN DEPARTMENT OF ENVIRONMENTAL QUALITY (MDEQ) —DEQ PROJECT NUMBER 2016-7209 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Michigan Department of Environmental Quality (MDEQ) has awarded the Oakland County Health Division continued funding for the Inland Beach Grant Project pursuant to the Clean Michigan Initiative Implementation Act, PA 288 of 1998; and WHEREAS miscellaneous resolution (MR) #15170 approved the agreement between the MDEQ and the Health Division to reimburse the County 75% of costs for bathing beach water quality activities for the period of March 1, 2015 through September 30, 2016; and WHEREAS the MDEQ is issuing Amendment #1 to increase reimbursement from $49,679.48 of state funds and $15,454.51 of local matching funds to $85,481.19 of state funds and $28,548.48 of local matching funds, an increase of $35,802 and $13,094 respectively, for a new project total of $114,029.67; and WHEREAS Amendment #1 also extends the expiration date from September 30, 2016 to December 31, 2016; and WHEREAS no personnel changes are required to administer this program; and WHEREAS this amendment has completed the Grant Review Process according to the Board of Commissioners Grant Procedures and is recommended for approval. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby accepts the Michigan Department of Environmental Quality's Amendment #1 of the Inland Beach Grant Project contract to extend the expiration date from September 30, 2016 to December 31, 2016 and to increase reimbursement from $49,679.48 with $15,454.51 of local matching funds to $85,481.19 with $28,548.48 of local matching funds for a new project total of $114,029.67. BE IT FURTHER RESOLVED that acceptance of this grant amendment does not obligate the County to any future commitment and continuation is contingent upon future levels of grant funding, BE IT FURTHER RESOLVED that the Board Chairperson is authorized to execute the Grant Agreement and approve changes and extensions not to exceed fifteen percent (15%). Chairperson, on behalf of the General Government Committee, I move the adoption of the foregoing resolution. Thank you for your cooperation, DEa DEQ Tracking Code/Project Number 2015-7209 Amendment Request No. GRANT CONTRACT AMENDMENT BETWEEN MI DEPARTMENT OF ENVIRONMENTAL QUALITY AND OAKLAND COUNTY HEALTH DIVISION This Amendment modifies the grant contract between the Michigan Department of Environmental Quality (hereafter "State"), and the Oakland County Health Division (hereafter "Grantee"), signed by the DEQ on August 10, 2015 for the Oakland County Bathing Beach Monitoring Program Project. This Amendment does not take effect until signed by both parties. The revisions to the grant contract are limited to those specified below. All other provisions of the contract remain in effect. PROJECT SCOPE (WORK PLAN) The State and the Grantee agree to the following [change in scope of work OR work plan]. The Grantee will monitor selected beaches for E. coli and attempt to analyze 30 samples per beach with culture-based and QPCR methods for determining an equivalent water quality standard for posting beaches. Please see attached workplan. CONTRACT PERIOD (END DATE) The State and the Grantee agree to extend the end date of this grant contract from September 30, 2016 to December 31, 2016. The Grantee will complete all obligations under this project no later than the end date, as amended. Costs incurred after the amended end date are not eligible for reimbursement under the grant contract. COMPENSATION (BUDGET) The State and the Grantee agree to the budget modifications described below. A total of $48.895.68 in grants and local match for this amendment is added to the budget for staffing, fringes, indirect, supplies, and travel costs. See attached budget revision. Start and End Dates: May 1, 2016 through December 31, 2016, Quarterly Reports and Final Report: A quarterly report and final report will be submitted to the DEQ. The minimum volume of 300 ml will be acquired in this manner: Collect 300 ml each from 3 designated monitoring points at a beach. This will result in three samples that contain a minimum of 300 ml in each bottle. Total volume of all 3 collection points collected is at least 900 ml. Collection of at least 30 samples: At least 30 samples will be attempted to be collected for each beach selected for this monitoring workplan by: Three samples will be collected at a beach during a sampling event and will be analyzed individually = 3). This sampling approach will be attempted to be repeated at least 10 times on different days to produce at least 30 sample results (n = 30). Analysis with 3 methods: One beach water sample of at least 300 ml will be tested by 3 different methods, each requiring 100 ml. A 300 nil water sample will be split 3 ways: 1. 100 ml for testing with a culture based method, Colilert, performed at the Oakland County Health Division Laboratory. 2. 100 ml filtered on a membrane and prepared for frozen storage by the Oakland County Health Division Laboratory. Frozen membranes will be prepared by the Oakland County Health Division Laboratory for draft Method C for E. coli with QPCR. 3. 100 ml filtered on a membrane and prepared for frozen storage by Oakland County. Frozen membranes will be collected and shipped together by Oakland County at the end of the summer to Mr. Rich Haugland of the USEPA-ORD lab in Cincinnati for testing with Method 1609 for enterococci with QPCR. Timetable and Reporting results: Samples tested will follow the DEQ approved Quality Assurance Project Plan. Samples will be transported to the lab in a cooler with ice within 6 hours. Lab will process water samples within 2 hours of receiving them. • Colilert: Local lab will prepare samples for Colilert method. Results will be reported to Health Department first and then to beach owners, local officials, and the DEQ via the BeachGuard web site. • Draft Method C: Local lab will filter samples on membrane and may freeze membranes for analysis at a later date in 2016. Results will be reported to the Health Department and DEQ (BeachGuard may be used as well as other electronic media). • Method 1609: Local lab will filter samples on membrane and will freeze membranes. Results from Method 1609 will be reported from the USEPA-ORD to the Health Departments and the DEQ (BeachGuard may be used as well as other electronic media). The resolution authorizes amendment #1 to the Michigan Department of Environmental Quality (MDEQ) grant contract with the Oakland County Health Division (OCHD).. 2. Miscellaneous Resolution #15170 accepted the grant award of $65,134 of which $49,679 was from state funding and $15,455 was the in-kind local grant match. 3. The amendment increases the total funding to $114,030 an increase of $48,896 of which $35,802 is from state funding and $13,094 is the local grant match . 4. Grant funds will be used for the purpose of protecting and promoting public health by evaluating the quality of water at bathing beaches to determine whether the water is safe for bathing purposes. 5. The additional $13,094 grant match from the OCHD is comprised of in-kind support which includes salaries, fringes, along with indirect costs associated with the grant. No additional positions are required for this grant. 6. The funding period has been extended through December 31, 2016. 7.
