HomeMy WebLinkAboutResolutions - 2016.08.18 - 22511MISCELLANEOUS RESOLUTION #4 6 2 15 August 18, 2016 BY: Human Resources Committee, Bob Hoffman, Chairperson IN RE: HUMAN RESOURCES DEPARTMENT — EXCEPTION TO MERIT RULE 2.10.1.2 FOR IT TRAINEE CLASSIFICATION — INFORMATION TECHNOLOGY DEPARTMENT To the Oakland County Board of Commissioners Chairperson, Ladies, and Gentlemen: WHEREAS Merit Rule 2.10.1.2 provides that "Exceptions may be made in departments or divisions which have received approval from the Board of Commissioners and the County Executive to adopt work schedules other than eight hours per day, such as 4/40, flex time, etc."; and WHEREAS M.R.14192 allowed for this exception for eighteen (18) IT classifications; and WHEREAS the Information Technology Department is requesting to add an exception to Merit Rule 2.10.1.2 with regards to payment of overtime for the non-exempt classification of IT Trainee (job code #01447); and WHEREAS overtime shall be paid after 40 hours in a work week in accordance with the Fair Labor Standards Act; and WHEREAS Information Technology Department's professional employees are working in a 24X7 high availability environment and staff are called upon to work outside of their regular work schedule when dealing with maintenance, incident, and project related work; and WHEREAS the option for non-exempt employees to use flextime versus overtime to meet the needs of the department cultivates a more productive, open work environment that provides both the employees and their Supervisors another approach to accomplish the required work. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes the exception to Merit Rule 2.10.1.2 for employees in the classification of IT Trainee in the Information Technology Department to receive overtime only after working in excess of 40 hours per week in accordance with the employee's regular work schedule. BE IT FURTHER RESOLVED this exception will apply to the IT Trainee classifications in the Information Technology Department.
