HomeMy WebLinkAboutResolutions - 2016.08.18 - 22550MISCELLANEOUS RESOLUTION #1621 3 August 18, 2016 BY: General Government Committee, Christine Long, Chairperson IN RE: DEPARTMENT OF HEALTH AND HUMAN SERVICES/HEALTH DIVISION - HURON VALLEY SCHOOL DISTRICT SERVICE AGREEMENT AMENDMENT 3 ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS in 2012 the Huron Valley School District (HVS) entered into a service agreement with the Oakland County Health Division to assist in conducting a groundwater monitoring program that included sampling from certain residences located near HVS's Bogie Lake Campus Wastewater Treatment Plant In White Lake Township, Oakland County, Michigan; and WHEREAS I-IVS is requesting to amend the agreement to include two (2) additional years of service beginning on the day of acceptance and ending two (2) years later; and WHEREAS the HVS Amendment 3 reflects a total potential funding amount of $2,218 per year including mileage; and WHEREAS no personnel changes are requested for the Service Agreement; and WHEREAS this Amendment 3 has been reviewed by the County's Corporation Counsel and has been recommended for approval. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the Huron Valley School District's Amendment 3 in the amount of $2,218 per year, beginning on the day of acceptance and ending two (2) years later. BE IT FURTHER RESOLVED that the Board Chairperson is authorized to execute the Service Agreement and approve changes and extensions not to exceed fifteen percent (15%), which is consistent with the agreement as originally approved. Chairperson, on behalf of the General Government Committee, I move the adoption of the foregoing resolution. ADDENDUM 3 SERVICE AGREEMENT WHEREAS, Huron Valley School District (hereinafter referred to as "HVS") and the Health Division of Oakland County (the "County") entered into a service agreement on March 30, 2012 ("Service Agreement"). WHEREAS, under the Service Agreement, HVS retained the County to assist HVS in conducting a groundwater monitoring program, including sampling from certain residences located near HVS's Bogie Lake Campus Wastewater Treatment Plant in White Lake Township, Oakland County, Michigan. NOW, THEREFORE, THE PARTIES AGREE TO AMEND THE SERVICE AGREEMENT BY AMENDING THE FOLLOWING PROVISIONS: 1. Section III of the Service Agreement shall be amended to read: This Agreement shall be in force and effect for two (2) years from the date this Addendum is executed by the Parties. The Parties can mutually agree in writing to extend the term of the Service Agreement. Either Party may terminate, with or without cause, upon giving the other Party thirty (30) days advance written notice. HVS shall reimburse the County for any reasonable expenses incurred/services provided prior to the termination date. 2. EXHIBIT A, SCOPE OF SERVICES and EXHIBIT B, RESIDENTIAL WELL SAMPLING LIST shall be amended as attached to this Addendum. Otherwise, the provisions of the SERVICE AGREEMENT remain unchanged and remain in full force and effect. Executed by: HURON VALLEY SCHOOL DISTRICT By: Its: OAKLAND COUNTY By: Its: EXHIBIT A SCOPE OF SERVICES Residential wells are proposed for sampling as part of Huron Valley School District's groundwater monitoring program near HVS's Bogie Lake Campus Wastewater Treatment Plant in White Lake Township, Oakland County, Michigan ("WWTP"). The Health Division of Oakland County (referred to as the "County"or "Oakland County Health Division") has agreed to assist Huron Valley School's with the residential well sampling. See attached list (Exhibit B) for all homes to be included in the sampling survey for Spring 2016 and Spring 2017. The specific tasks for the residential sampling and the Party responsible to complete the task are as follows: - Prepare and send letter to those selected to have their well sampled o Entity to complete —Huron Valley Schools Prepare contact list of residents (addresses) o Entity to complete -Huron Valley Schools - Contact residents and schedule sampling appointments, including the potential mailing of postcards to residents o Entity to complete — Oakland County Health Division - Preparation of sample containers, and sample coolers o Entity to complete -Brighton Analytical Services and Huron Valley Schools • Review of resident's water system and collect sample from water supply well o Entity to complete Oakland County Health Division Transportation of samples to analytical laboratory (prior to transportation, a seal that is signed by the County will be placed on all sample containers and sample coolers, and Brighton Analytical Services will certify that such seals are in place at the time of delivery to the laboratory). o Entity to complete —Huron Valley Schools - Analysis of water samples (constituents to be sampled are: sodium, chloride and hardness.) o Entity to complete-Brighton Analytical Services Note: Lab fees to be paid by Huron Valley Schools Data quality review o Entity to complete —AMEC and Oakland County Health Division • Prepare letter to residents indicating results o Entity to complete —Oakland County Health Division Prior to groundwater sample collection, the water treatment system within each residence or its connection to an outdoor spigot will be reviewed by the County in order to identify an unsoftened sample tap or spigot location. If the County is unable to confirm whether the sample was collected from an unsoftened source prior to sample collection, the confirmation will be completed through analytical testing of the sample. Samples collected from a confirmed unsottened tap or outdoor spigot at the select residences in the study area will be labeled as "Unsoftenecl Sample" on the chain-of-custody documents and sample bottles. The County standard procedures for the collection of a sample will be used and the Brighton Analytical Services chain of custody form will be used for the collection of samples (attached). Analytical results will be transmitted by Brighton Analytical Services to the County and AMEC for quality control and quality assurance review. Upon completion of this review, the County will transmit the results to each property owner via a letter consistent with letters previously sent by the County to area residents. FISCAL NOTE (MISC. #16213) August 31, 2016 BY: Finance Committee, Tom Middleton, Chairperson IN RE: DEPARTMENT OF HEALTH AND HUMAN SERVICES/HEALTH DIVISION - HURON VALLEY SCHOOL DISTRICT SERVICE AGREEMENT AMENDMENT 3 ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above-referenced resolution and finds: 1. Miscellaneous Resolution #12058 established an agreement so that Oakland County could assist the Huron Valley School District in conducting a groundwater monitoring program that includes sampling from certain residences located near the Huron Valley School District's Bogie Lake Campus Wastewater Treatment Plant in White Lake Township. 2. The County has extended its contract with the Huron Valley School District for an additional two years, beginning on the day of acceptance, in order to assess the confined aquifer that is used for drinking water by the nearby residents, as well as to assist in developing and/or refining future soil boring/monitoring well drilling. 3. The County shall be compensated for performing its services on a per sample basis at a rate of $90 per sample collected, with twenty-two (22) proposed residential wells, amounting to $1,980 along with $238 in mileage for a total of $2,218 per year in anticipated revenue for FY 2016 and FY 2017. 4. There are no additional positions required with this agreement. 6.
