HomeMy WebLinkAboutResolutions - 2016.08.31 - 22571MISCELLANEOUS RESOLUTION # 16236 BY: Commissioner Hugh Crawford, District #9 IN RE: BOARD OF COMMISSIONERS — PILOT LOCAL ROAD IMPROVEMENT PROGRAM — MULTIPLE YEAR PROJECT PLAN REQUIRING THE ROLLOVER OF COMMUNITY ALLOCATION — CITY OF NOVI — REALIGNMENT OF FLINT STREET To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS from the City of Novi has submitted a Local Road Improvement Program application with a multiple year project plan requiring the rollover and accrual of the City's maximum County contribution authorized in the current year's approved distribution formula; and WHEREAS the proposed budget for the identified project, the realignment of Flint Street, requires the accrual of three (3) years maximum County contribution at the current distribution amount for the City of Novi of $68,552; and WHEREAS the Oakland County Board of Commissioners established policies and procedures for the Local Road Improvement Program with the adoption of Miscellaneous Resolution *16103; and WHEREAS MR #16103 authorized the Local Road Improvement Subcommittee to establish policies and procedures regarding the limited rollover and accrual of a municipality's allocation for projects plans that require additional County funding; and WHEREAS the Local Road Improvement Subcommittee has adopted a policy authorizing a municipality to submit a multi-year plan for projects that require the accrual of the municipality's allocation for a maximum of three (3) years; and WHEREAS approval of a multiple-year plan and accrual of a municipality's allocation is subject to approval by the Board of Commissioners; and WHEREAS a project multi-year plan is to be utilized solely for planning purposes and does not obligate Oakland County in any way to funding a project; and WHEREAS rollover and accrual of a municipality's allocation is subject to the continuation of the Local Road Improvement Program, which has been established as a pilot program; and WHEREAS a municipality's allocation is subject to change from year to year based upon the factors utilized in current distribution formula and amendments to the distribution formula approved by the Board of Commissioners; and WHEREAS the Local Road Improvement Subcommittee has reviewed the plan submitted by the City of Novi for the realignment of Flint Street and is recommending that the Board of Commissioners authorizes the City of Novi's 2016 and 2017 allocations rollover for consideration of the project in 2018, contingent upon continuation of the program. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes the City of Novi to roll over their allocation under the Local Road Improvement Program for 2016 and 2017 for the purpose of the City to submit an application for the realignment of Flint Street in 2018, contingent upon the continuation of the program.. BE IT FURTHER RESOLVED that the Oakland County Clerk is requested to forward copies of this resolution to Oakland County Fiscal Services and the City of Novi. The County intends this Program to assist its municipalities by offering limited matching funds for specific, targeted road maintenance and/or improvement projects on roadways under the jurisdiction of cities and villages. Project Policies and Guidelines: The Oakland County Board of Commissioners and the Local Road Improvement Subcommittee has established policies, procedures and guidelines for project consideration. These documents have been included as Attachment "A". Available Funding: Oakland County's maximum contribution for projects in eligible cities or villages has been established within the distribution formula included as Attachment "B". The maximum county share for 2016 program projects in Novi has been set at $68,552. Required Matching Funds: A city or village participating in the Local Road Improvement Matching Fund program shall match any funds authorized by the Oakland County Board of Commissioners in an amount equal to a minimum of 50% of the cost of the total project award. Funding shall be utilized to supplement and enhance local road maintenance and improvement programs. Funding is not intended to replace existing budgeted local road programs or to replace funding already committed to road improvements. Flint Street is located in the southwest quadrant of the Novi Roadn and Grand River Avenue intersection. The realigned roadway will connect the planned Crescent Boulevard at Grand River Avenue intersection to the intersection of Main Street and Novi Road. ROAD/ROAD(S) TO BE IMPROVED Flint Street DESCRIPTION The City of Novi completed a Scoping Study for the Northwest Quadrant of the planned Novi Road and Grand River Avenue Ring Road in June 7, 2007 which included a recommendation that Flint Street be realigned so that it connects with the Crescent Boulevard Extension to the north of Grand River Avenue. This would help to complete the "ring road" concept and improve operations at the congested, skewed, Grand River Avenue/Novi Road intersection. A study of the southwest quadrant was then commissioned in late 2012 to determine the scope of work associated with the reconstruction of Flint Street to realign the intersection at Grand River with the proposed Crescent Boulevard extension's final phase (i.e., the third phase of the northwest quadrant ring road). The goal of the study was to manage access to the parcels along Grand River Avenue, serve the parcels fronting on Grand River from the realigned road, and to provide better access for the parcels along Flint Street when they get redeveloped. The project will include the realignment of Flint St, and concrete paths on both sides of the realigned road. PROJECT BUDGET FUNDING REQUESTED LOCAL MATCH $205,656 (Accrued over 3 $1,315,344 years) DESCRtPTION OF PROPOSED PROJECT EXPENDITURES Construction of the following: FOTAL PROJECT BUDGET $1,521,000 • A three lane cross-section comprised of one 11-foot wide through lane in each direction, and an 11-foot wide center turn lane. • A curb and gutter section with an enclosed storm sewer system to allow for a narrower right of way and reduced impacts to adjacent property • 5-foot wide bicycle lanes on each side of the roadway • 6-foot wide sidewalks on each side of the roadway with a 4-foot greenbelt • Additional right turn lanes at the Grand River Avenue and Novi Road intersections • A 14 foot by 7 foot box culvert to replace the existing 84-inch culvert for the Walled Lake Branch of the Middle Rouge River near Novi Road. This culvert replacement is required based upon the hydraulic analysis and MDEQ Permit No. 09-63-0219-P obtained for the Crescent Boulevard Extension project north of Grand River Avenue. • Potential modifications to the detention basin within the project limits • Signal instillation at Grand River/Crescent Blvd and signal upgrades at Novi Rd/Flint Street Project cost estimate does not include right-of-way acquisition, utility relocation and/or expansion, landscaping, lighting, or engineering. ECONOMIC IMPACT OF PROJECT The Local Road Improvement Pilot Program has been established under MCL123.872, the Gifts of Property Act, which provides that "A county may grant or loan funds to a township, village, or city located within that county for the purpose of encouraging and assisting businesses to locate and expand within the county." DESCRIBE HOW THE PROJECT MEETS THE STATUTORY REQUIRMENT OF ENCOURAGING AND ASSISTING BUSINESS TO LOCATE AND EXPAND IN THE COUNTY Flint Street's current alignment bisects the land such that several small parcels exist that are not desirable for significant economic investments. Several alternatives were developed for realigning Flint Street, all of which would connect the existing Flint Street/Novi Road Intersection with the proposed Crescent Boulevard Extension/Grand River Avenue Intersection and provide the same benefits in terms of improved traffic and circulation. The various alignments would provide differing right of way requirements and possibilities for redevelopment of the adjacent properties. The various options were discussed with the Planning Commission and the adjacent property owners, including Hunter Development Company. Two alignments appear to be best in terms of property impacts and possibilities for redevelopment of the properties. Alternative 1A generally follows the existing Flint Street roadway alignment adjacent to the creek. The preferred alignment, Alternative 1B, shows the roadway alignment adjacent to the railroad. By relocating the road to the western edge of the mostly undeveloped tract and aligning it with the future West Crescent/Grand River intersection, access to a larger contiguous mass of parcels would be created. Once Flint Street has been realigned, attracting the right developer would be the first step in transforming this critical corner in Novi's Town Center District into a vibrant, appealing area — attracting new jobs to support a burgeoning mixed commercial/residential use. OPTIONAL MULTI-YEAR PROJECT PLAN The Local Road Improvement Program has been expressly established as a pilot program_ There is no guarantee the program will be continued from year to year. The Local Road Improvement Program Subcommittee recognizes that the allocation authorized for local governments may not provide adequate funding in a single year to allow a project to move forward. Local governments shall be offered the opportunity to submit project plans that would necessitate the accumulation of multiple years of the community's allocation amount to fulfill the County's share of a project budget. A multi-year project plan submittal shall not exceed three years in duration. The allocation amount available to each community is subject to change annually based upon the factors utilized in the distribution formula. Consideration of multi-year project plans does not obligate Oakland County in any way to fund any project or program in the future. These plans are meant to be utilized for planning purposes and for consideration by the Oakland County Board of Commissioners to authorize a limited carryover of a community's allocation year to year. DESCRIPTION OF MULTI-YEAR PLAN JNCLUDING ESTIMATED PROJECT BUDGET AND CARRYOVER PERIOD OF COMMUNITY'S LLO CATION The intent is to bank grant funding provide by The Local Road Improvement Program for the prescribed maximum three year duration with construction forecasted in 2020 when local match funds will be available in City fiscal year 2019-2020. In the interim, the the City will follow this project development timeline: • FY 2016/2017: Complete project scoping; add project to CIP • FY 2017/2018: Complete preliminary design and right-of-way acquisition • FY 2018/2019: Complete final design engineering ADDITIONAL INFORMATION The Local Road Improvement Program Subcommittee of the Finance Committee of the Oakland County Board of Commissioners has been tasked with managing this program and making recommendations for project approval. The properties accessing Flint Street in this area are expected to develop/redevelop in the near future and will need an improved roadway to support increased traffic volumes. The June 7, 2007 Scoping Study for the Northwest Quadrant, Novi Road and Grand River Avenue Ring Road includes a recommendation that Flint Street be realigned so that it connects with the Crescent Boulevard Extension to the north of Grand River Avenue. This would help to complete the "'ring road" concept and improve operations at the congested Grand River Avenue/Novi Road intersection. Flint Street is in the Novi Town Center Area. The Town Center Area Study approved by the Novi Planning Commission on March 26, 2014 includes specific recommendations for the realignment of Flint Street, including: • Preferred routes • Pedestrian and Bicycle amenities • Adjacent land use and zoning The purpose of this report is to summarize the studies completed to date and provide an outline for implementation of the realignment and improvements in the Flint Street corridor. Several alternatives were developed for realigning Flint Street, all of which connect the existing Flint Street/Novi Road Intersection with the proposed Crescent Boulevard Extension/Grand River Avenue Intersection and provide the same benefits to traffic and circulation. The various alignments provide differing right of way requirements and possibilities for redevelopment of the adjacent properties. The various options were discussed with the Planning Commission and the adjacent property owners, including Hunter Development Company. Two alignments appear to be best in terms of property impacts and possibilities for redevelopment of the properties. Alternative lA (Figure 1) generally follows the existing Flint Street Roadway alignment adjacent to the creek. Alternative 1B, (Figure 2) shows the roadway alignment adjacent to the railroad. Appendix 2 (Alternatives Not Selected), shows an additional alignment which would bisect the area available for development/redevelopment, leaving narrower areas on each side of the roadway, rather than a wider area on one side. This alternative would limit options for redevelopment of properties in the area and is considered undesirable for this reason. Flint Street Realignment Study City of Novi Engineering Department Alternative This alternative connects the planned Crescent Boulevard at Grand River Avenue to Main Street at Novi Road, with signalized intersections at each end (see Figure 1). It roughly matches the existing Flint Street alignment, except at the north end where it continues further west to connect to the planned Crescent Boulevard. ROADWAY DESIGN Alternative 1A has a three lane cross section (Figure 3), including: • One 11-foot wide lane through lane in each direction, and an 11 foot wide center turn lane • 5-foot wide bicycle lanes on each side of the roadway • 5-foot wide sidewalks on each side of the roadway with a 5-foot greenbelt • Additional right turn lanes are provided at the Grand River Avenue and Novi Road intersections The proposed right-of-way width is generally 70 feet, with additional width at each end to accommodate the additional turn lanes at Grand River Avenue and Novi Road. A curb and gutter section with an enclosed storm sewer system is proposed to allow for a narrower right of way and reduced impacts to adjacent property. Either concrete or asphalt pavement could be used for the roadway. A five foot wide greenbelt is included between the sidewalks and the back of curb. This area provides room to place signing and provides for some snow storage during winter months. The greenbelt also improves aesthetics and increases safety by increasing the separation between pedestrians and vehicles. A wider greenbelt is desirable; however this would require additional property acquisition. A four lane boulevard was considered, but eliminated due to its increased right-of-way and higher construction cost. HYDROLOGY AND DRAINAGE The existing 84-inch culvert for the Walled Lake Branch of the Middle Rouge River near Novi Road will be replaced with a 14 foot by 7 foot box culvert. This culvert replacement is required based upon the hydraulic analysis and MDEQ Permit No. 09-63-0219-P obtained for the Crescent Boulevard Extension project north of Grand River Avenue. The existing 84-inch culvert for the Walled Lake Branch of the Middle Rouge River near Grand River Avenue is not required to be replaced based on the hydraulic analysis, and will be left in place. Alternative 1A impacts the existing detention pond on the George Keros parcel, so modifications would be required. BICYCLE AND PEDESTRIAN AMENITIES Bicycle lanes are provided in each direction on the roadway and sidewalks provided along both sides. The sidewalk along the northeast side of the roadway will border the creek for most of the project length. Turnouts and benches could be incorporated into the project design to create amenities for pedestrians along the creek. Flint Street Realignment Study 2 City of Novi Engineering Department ACCESS MANAGEMENT The following parcels have direct access to Grand River Avenue: • CSX Transportation Yard • Country Building Supply • Lee BeGole parcel • Gap Property Management parcels • George Keros parcel As the Flint Street area is developed, these access points should be eliminated from Grand River Avenue and replaced with access to the new Flint Street. This would result in decreased turning movements to and from Grand River Avenue and improve safety. TRAFFIC SIGNALS The existing traffic signal at Novi Road/Flint Street will require minor modifications due to the widened roadway. The planned traffic signal at Grand River Avenue/Crescent Boulevard has been designed to accommodate a three leg intersection. Additional traffic signal heads and mast arms will be needed to accommodate the fourth leg of the intersection. CONSTRUCTION COST ESTIMATE The improvements shown in Alternative 1A are estimated at $1,900,000 for design and construction. This estimate does not include right of way, street lighting, landscaping, or utility work. See Appendix 1 for detailed information. Flint Street Realignment Study 3 City of Novi Engineering Department Alternative iB This alternative (Figure 2) is similar to Alternative lA and connects the same two points on each end, but is adjacent to the CSX Railroad instead of the creek in the center portion of the alignment. Traffic operations should be the same as with Alternative 1A. ROADWAY DESIGN The roadway design would be the same as Alternative 1A. HYDROLOGY AND DRAINAGE The hydrology and drainage would be the same as Alternative IA; except that Alternative 1B does not impact the existing detention pond on the George Keros parcel, so it would not require modifications. BICYCLE AND PEDESTRIAN AMENITIES The bicycle and pedestrian amenities would be the same as Alternative IA, except that the opportunities to provide aesthetic amenities adjacent to the creek present with Alternative lA will not be present with Alternative 1B. ACCESS MANAGEMENT The same parcels listed under Alternative IA for having their access points changed from Grand River Avenue to the relocated roadway should be considered for Alternative 1B also. The drawing for Alternative 1B shows one possible roadway/driveway that would accomplish this. Although this is not shown in the drawing for Alternative 1A, a similar access roadway/driveway could be included with Alternative IA to accomplish the access revisions. The right of way and construction costs for this access roadway/driveway are not included in the estimate for either alternative. Alternative 1B also requires more additional right of way than Alternative IA, due to the alignment not utilizing the existing Flint street right of way to the same degree as Alternative 1A. To minimize right of way impacts to the adjacent properties, the existing Flint Street right of way could be combined with the adjacent properties in order to make them more economically viable. The City may want to retain some of the Flint Street right of way adjacent to the creek for use as a pathway. TRAFFIC SIGNALS The traffic signal changes would be the same as Alternative IA. CONSTRUCTION COST ESTIMATE The improvements shown in Alternative 1B are estimated at $1,740,000 for design and construction. The construction cost for Alternative 1B is less than Alternative lA because the existing detention basin would not need to be modified. This estimate does not include right of way, street lighting, landscaping, or utility work. See Appendix 1 for detailed information. Flint Street Realignment Study 4 City of Novi Engineering Department Impacts of the Alternatives RIGHT OF WAY IMPACTS The existing Flint Street right of way varies from 45 feet wide to 90 feet wide. The wider portions include the existing creek where the creek is adjacent to the roadway. Alternative lA utilizes all of the existing right of way and requires some additional right of way for widening and for realignment at the north end of the roadway. The chart which follows lists each parcel affected by the project and the right of way requirements from each parcel for both Alternative lA and IB. Appraisals and further study are needed to estimate the cost of the right of way required for the project. WETLAND IMPACTS There are existing wetlands in the project area, as shown in Figure 3 along with the Alternative IA alignment. This information is from the City GIS system. The existing wetlands closely follow the creek. The realigned roadway for Alternative 1A may encroach slightly into the wetlands along the creek. Alternative 1B should not impact wetlands. Flint Street Realignment Study 6 City of Novi Engineering Department Actual wetland impacts will depend upon the grading limits required for the roadway and the actual limits of the existing wetlands. As part of the design of the project, detailed grading limits will be established. The actual wetland limits also need to be staked by a wetland ecologist as part of the design. FL OODPLAIN IMPACTS There is a regulated floodplain in the project area. Figure 4 shows the existing FEMA 100 year floodplain in the project area and the Alternative lA alignment. Because the floodplain follows the creek, floodplain impacts appear to be possible with Alternative 1A, and much less likely with Alternative 1B. The existing floodplain shown is based upon the PEMA model of the existing creek. Note that the floodplain encroaches onto the edge of existing Flint Street in some areas. An MDEQ Permit was obtained for the Crescent Boulevard Extension project north of Grand River Avenue, which has not yet been constructed. The analysis done for this permit shows that the existing culvert under Flint Street just west of Novi Road is under-sized and negatively impacts the hydraulic capacity of the creek. Upsizing of this culvert is needed. The design plans completed for the Crescent Boulevard Extension project include replacing the culvert, as reflected in Figures 1 and 2. We anticipate that floodplain impacts will be mitigated by this culvert replacement and that further mitigation for floodplain impacts will not be required for either alternative. Following construction, a FEIVIA Letter of Map Revision should be done to document the change in floodplain resulting from the culvert replacement. UTILITY IMPACTS There are numerous public and private utilities in the project area, as shown in Figures 1 and 2. Some utility relocation will be required for the project. Specifically: • Several power poles for the existing line running parallel to Grand River will need to be relocated. This power line is not in an existing roadway easement and likely has its own easement. As a result, relocation will likely be at project expense. • Existing sanitary and water main covers also may need to be adjusted to grade within the grading limits of the roadway work. • The former concrete plant site has existing utility services. Redevelopment of this parcel and the adjacent Hunter Development parcel will likely include providing water, sewer, gas, electric power and telecom services. It is prudent to plan for these future services to ensure that the roadway work is compatible with the addition of these utility facilities. In particular, consideration could be given to constructing water supply and sanitary sewer adjacent to the roadway to service future development. Sleeves for gas, electric and telecom crossings of the new roadway could also be constructed if the best locations for these crossings can be determined. Costs for utility relocation and upgrading/extension of utility services in the area are not included in the construction cost estimate. Flint Street Realignment Study 7 City of Novi Engineering Department HISTORIC PROPERTY IMPACTS The project has the potential to impact historic properties. In particular, the Lee BeGole and other residential buildings along Grand River Avenue appear to be over fifty years old, which is the first criterion for determining whether a structure may be of historical significance. Both alternatives will have similar impacts to these properties. There are other criteria, including whether important events have occurred on the property, the extent to which remodeling has removed original features, and whether the structure is unique or is a particularly good example of a particular architectural style. When federal funding is involved in a project, coordination with the State Historic Preservation Office is required as part of the design process. This process will determine whether there are historically significant properties which would be impacted by the project, should federal funding be obtained. Flint Street Realignment Study 8 City of Novi Engineering Department Implementation Recommendations To implement the improvements outlined, the following actions need to be completed: FUNDING In addition to local funds, the City should explore obtaining state and federal funds for the improvements. Possible sources include: • Block Grants • Transportation Economic Development Funds • STP funding If Federal funding is to be used for the project, an Environmental Assessment may need to be prepared and processed, including conducting public hearings regarding the proposed improvements. Coordination with the State Historic Preservation Officer is also required for projects using federal funds. Should impacts to potentially significant historic properties be identified, preparation and processing of a Section 4(1) Statement could be required in addition to the Environmental Assessment. RIGHT OF WAY As the design advances, legal descriptions can be prepared. Right of Way negotiations can then be completed. PERMITS Permits will need to be obtained from the Oakland County Road Commission and the Michigan Department of Environmental Quality. • No significant issues are anticipated in obtaining the Oakland County Road Commission permit. • For the MDEQ Permit, hydraulic studies need to be completed and an application completed. The hydraulic study completed for the Crescent Boulevard Extension included the Flint Street area, and determined that the culvert under Flint Street just west of Novi Road needs to be replaced. However, the permit obtained for the Crescent Boulevard Extension will expire in March 2015. While a permit extension can be requested, approval of an extension by MDEQ is unlikely unless construction is underway. If a new permit application is required for the Crescent Boulevard Extension, the new application should include both the Crescent Boulevard Extension and the Flint Street realignment projects. Additional wetland impacts, floodplain impacts, and storm sewer connections to the creek along Flint Street could be included in the permit application. The change in impervious area due to widening of Flint Street also should be reflected in the hydraulic model. Relocation of the existing detention pond for the City Center Shopping Center also needs to be included in the hydraulic studies and MDEQ permit application. • After the construction is done, A FEMA Letter of Map Revision should be completed to document the change to the floodplain. Flint Street Realignment Study 9 City of Novi Engineering Department DESIGN Topographic surveys and geotechnical exploration work are the next steps in the design process that should be completed. A traffic study also is needed to determine turn lane storage lengths and to validate the design concept. UTILITY COORDINATION Additional information regarding the locations of existing privately owned utilities has been requested. Necessary relocation work will be estimated as the information is provided and the design progresses. In addition, the City and the private utility companies should discuss redevelopment needs to ensure that utilities constructed as part of the roadway project are compatible with utility needs for the area. The 2016 and 2017 roll-over allocation amounts for the City of Novi under the Local Road Improvement Program will be retained in the Local Road Improvement Matching Program Assigned Fund Balance (GL account #383465) and will require a separate resolution anticipated in 2018 to appropriate funding for the realignment of Flint Street project; contingent upon continuation of the program. 6. The funding will be contingent upon the County's distribution from the Michigan General Revenue Sharing Act.
