Commissioner Marsha(Girshensoh, District #13 MISCELLANEOUS RESOLUTION #16319 BY: Commissioner Marsha Gershenson, District #13 and Commissioner Helaine Zack, District #18 RE: BOARD OF COMMISSIONERS AMENDMENT TO BOARD RULES - STANDARD OF CONDUCT To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS federal and state laws regulate the conduct of election campaigns and public officers in order to protect the integrity of the political process and ensure honorable conduct; and WHEREAS Michigan statutes such as the County Boards of Commissioners Act, MCL 46.1 of seq, and the Standards of Conduct for Public Officers and Employees Act, MCL 15,341 of seq. are to protect the integrity of a public officer or employee and prohibits a public officer or employee from engaging in a business transaction in which the public officer may profit from his or her official position or authority or benefit from confidential information; and WHEREAS the existing rules for the Oakland County Board of Commissioners do not encompass standards of conduct or conflict of interest in relation to receipt of contributions, gifts, goods, services or other things of value which tends to influence the manner or performance of official duties. NOW THEREFORE BE IT RESOLVED THAT the Board of Commissioners hereby amend the Board Rules of Procedure with the inclusion of the following language within Section XIII, Standard of Conduct: Section XIII N. Conflict of interest No member shall be interested directly or indirectly in any contract or business transaction with the County or any Board, Office, or Commission thereof during the time for which he/she is elected or appointed, nor for one (1) year thereafter, except as provided by law. No member shall be eligible to receive or shall receive any appointment from or be employed in any capacity whatsoever by any Officer, Board, Committee, or other authority of the County except as provided by law. A solicitation for campaign or political contributions may not be linked with an official action taken or to be taken by a Commissioner, and a Commissioner/Member may not accept any contribution that is linked with an action that the Commissioner has taken or is being asked to take. A corollary of these rules is that a Commissioner and staff are not to take or withhold any official action on the basis of the campaign contributions or support of the involved individuals, or their partisan affiliation. Commissioner and staff are likewise prohibited from threatening punitive action on the basis of such considerations.
