Correct the NOW THEREFORE BE IT FURTHER RESOLVED paragraph as follows: NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes the City of Royal Oak to roll over their allocation under the Local Road Improvement Program for 2017 and 2018 and 2019 for the purpose of the City to submit an application for the Reconstruction of Fernlee Avenue in 2019, contingent upon the continuation of the program. MISCELLANEOUS RESOLUTION *17123 BY: Commissioners David Woodward, District #19; Gary McGillivray, District #20; Wade Fleming, District #16 IN RE: BOARD OF COMMISSIONERS — PILOT LOCAL ROAD IMPROVEMENT PROGRAM — MULTIPLE YEAR PROJECT PLAN REQUIRING THE ROLLOVER OF COMMUNITY ALLOCATION — CITY OF ROYAL OAK — RECONSTRUCTION OF FERNLEE AVENUE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the City of Royal Oak has submitted a Local Road Improvement Program application with a multiple year project plan requiring the rollover and accrual of the City's maximum County contribution authorized in the current year's approved distribution formula; and WHEREAS the proposed budget for the identified project, the Reconstruction of Fernlee Avenue, requires the accrual of three (3) years maximum County contribution at the current distribution amount for the City of Royal Oak of $77,230; and WHEREAS the Oakland County Board of Commissioners established policies and procedures for the Local Road Improvement Program with the adoption of Miscellaneous Resolution #16103; and WHEREAS MR #16103 authorized the Local Road Improvement Subcommittee to establish policies and procedures regarding the limited rollover and accrual of a municipality's allocation for project plans that require additional County funding; and WHEREAS the Local Road Improvement Subcommittee has adopted a policy authorizing a municipality to submit a multi-year plan for projects that require the accrual of the municipality's allocation for a maximum of three (3) years; and WHEREAS approval of multiple year plan and accrual of a municipality's allocation is subject to approval by the Board of Commissioners; and WHEREAS a project multi-year plan is to be utilized solely for planning purposes and does not obligate Oakland County in any way to funding a project; and WHEREAS rollover and accrual of a municipality's allocation is subject to the continuation of the Local Road Improvement Program, which has been established as a pilot program; and WHEREAS a municipality's allocation is subject to change from year to year based upon the factors utilized in current distribution formula and amendments to the distribution formula approved by the Board of Commissioners; and WHEREAS the Local Road Improvement Subcommittee has reviewed the plan submitted by the City of Royal Oak for the Reconstruction of Fernlee Avenue and is recommending that the Board of Commissioners authorizes the City of Royal Oak's 2017, 2018 and 2019 allocations rollover for consideration of the project in 2019, contingent upon continuation of the program. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes the City of Royal Oak to roll over their allocation under the Local Road Improvement Program for 2017, 2018 and 2019 for the purpose of the City to submit an application for the Reconstruction of Fernlee Avenue in 2019, contingent upon the continuation of the program. The County intends this Program to assist its municipalities by offering limited matching funds for specific, targeted road maintenance and/or improvement projects on roadways under the jurisdiction of cities and villages. Proiect Policies and Guidelines: The Oakland County Board of Commissioners and the Local Road Improvement Subcommittee has established policies, procedures and guidelines for project consideration. These documents have been included as Attachment "A". Available Funding: Oakland County's maximum contribution for projects in eligible cities or villages has been established within the distribution formula included as Attachment "B". The maximum county share for 2017 program projects in Royal Oak has been set at $77230. Required Matching Funds: A city or village participating in the Local Road Improvement Matching Fund program shall match any funds authorized by the Oakland County Board of Commissioners in an amount equal to a minimum of 50% of the cost of the total project award. Funding shall be utilized to supplement and enhance local road maintenance and improvement programs. Funding is not intended to replace existing budgeted local road programs or to replace funding already committed to road improvements. TELEPHONE NUMBER 248.246.3260 STREET ADDRESS 211 Williams Street CITY/ZIP Royal Oak, MI 48067 E-MAIL ADDRESS mattc@romi.gov hollyd@romi.gov PROJECT INFORMATION SHORT DESCRIPTION OF PROJECT Reconstruct the north-south section of Fernlee Avenue in the City of Royal Oak between Samoset Road and 14 Mile Road ROAD/ROAD(S) TO BE IMPROVED Fernlee Avenue in the City of Royal Oak between Samoset Road and 14 Mile Road DESCRIPTION Fernlee Avenue is a 27' wide concrete road that serves as access for numerous business and industrial properties including HHI Form Tech (Forming Technologies). This road continues to provide access to other numerous businesses including SOCWA and areas to the south which have primarily light industrial and other small businesses. This section of road sees a variety of traffic types including numerous regular multi-axel trucks. The section of Fernlee Avenue in Royal Oak was originally constructed in the 1960's as a concrete roadway. Sections of this road have been repaired numerous times to preserve and extend the life of the pavement. Traffic and weather has certainly taken a toll on the roadway. Recent pavement condition assessments revealed a failure of the original concrete pavement that is due to a combination of factors. These factors include poor base conditions and ASR, but primarily an insufficient cross section for heavy truck traffic. This road was not built with underdrains. At the current time, the road is in poor condition and has an overall Paser Rating of 3, and it should be noted that areas of the roadway have failed. PROJECT BUDGET FUNDING REQUESTED LOCAL MATCH TOTAL PROJECT BUDGET $231,690 - Multi-Year $248,310 $480,000 DESCRIPTION OF PROPOSED PROJECT EXPENDITURES Remove existing road pavement section. Excavate subsoils for new aggregate road base. Install new underdrains. Reset, adjust and reconstruct existing storm drainage as needed. Install new aggregate road base. Install 10" non-reinforced concrete pavement with integral curb. Construct new ADA sidewalk ramps where existing sidewalks will meet new pavements. Restore landscaping. Oakland County Grant Matching Funding Requested Breakdown: 2017 - $77,230 2018 - $77,230 2019 - $77,230 ECONOMIC IMPACT OF PROJECT The Local Road Improvement Pilot Program has been established under MCL 123.872, the Gifts of Property Act, which provides that "A county may grant or loan funds to a township, village, or city located within that county for the purpose of encouraging and assisting businesses to locate and expand within the county." DESCRIBE HOW THE PROJECT MEETS THE STATUTORY REQUIREMENT OF ENCOURAGING AND ASSISTING BUSINESS TO LOCATE AND EXPAND IN THE COUNTY Royal Oak is an older community with very little undeveloped property. Most of the commercial development in our city is actually redevelopment of existing building and land. Roadways that serve the unique and distinct commercial or industrial areas lend to the viability and desirability of these areas. Esthetically, new roadways, sidewalks and landscaping are generally inviting, and in commercial and industrial areas can soften the harshness of land where often there is little green space. The very first impression of a developer is an assessment of the roadways that serve the property, often even before they see the building. Poor road conditions make travel to the site undesirable not just from a delivery standpoint but also from a customer perspective. Location and access to adequate and suitable transportation is a main factor in choosing a business location. Poorly maintained transportation facilities reflect upon the community as a whole. Roadway improvement is a major investment in a neighborhood that has been shown to promote and maintain viability and desirability regardless of whether it is commercial or residential. As the owner of the road network, improving the roadways in commercial or industrial areas is a key component to keeping existing businesses and attracting new/redevelopment. The condition of Fernlee Avenue in Royal Oak has spurned numerous complaints. Motorists often avoid this roadway due to the deteriorated conditions. Large gaps in the pavement are being held together with pothole patch materials and is very uncomfortable to drive. In order for businesses to see value in reinvesting or to relocate, they require a reasonable expectation that their customer base will be improved. Several properties served by this section of Fernlee are vacant and for sale or lease. Improving the roadway would be expected to make these sites more desirable to potential redevelopment or use. OPTIONAL MULTI-YEAR PROJECT PLAN The Local Road Improvement Program has been expressly established as a pilot program. There is no guarantee the program will be continued from year to year. The Local Road Improvement Program Subcommittee recognizes that the allocation authorized for local governments may not provide adequate funding in a single year to allow a project to move forward. Local governments shall be offered the opportunity to submit project plans that would necessitate the accumulation of multiple years of the community's allocation amount to fulfill the County's share of a project budget. A multi-year proiect plan submittal shall not exceed three years in duration. The allocation amount available to each community is subject to change annually based upon the factors utilized in the distribution formula. Consideration of multi-year project plans does not obligate Oakland County in any way to fund any project or program in the future. These plans are meant to be utilized for planning purposes and for consideration by the Oakland County Board of Commissioners to authorize a limited carryover of a community's allocation year to year. 1DESCRIPTION OF MULTI-YEAR PLAN INCLUDING ESTIMATED PROJECT BUDGET AND CARRYOVER PERIOD OF COMMUNITY'S ALLOCATION The city would elect to accumulate multiple years of the Royal Oak's allocation amount to fulfill the county's share of a project budget. ADDITIONAL INFORMATION The Local Road Improvement Program Subcommittee of the Finance Committee of the Oakland County Board of Commissioners has been tasked with managing this program and making recommendations for project approval. Please supply any additional information you believe may be helpful in the consideration of your application. OPTIONAL ADDITIONAL INFORMATION Fernlee Avenue in Royal Oak has been identified as our primary candidate for improvement. The city is submitting three applications for this grant. If this location qualifies for the grant we would prefer that this is the only grant awarded to the city. REPORT FOLLOWING COMPLETION OF THE PROJECT MCL 123.872 requires that "the grant or loan contract made by a county shall require a report to the county board of commissioners regarding the activities of the recipient and the degree to which the recipient has met the stated public purpose of the funding". Resolution authorizes the rollover of FY2017 City of Royal Oak allocation in the amount of $77,230.Also, the resolution authorizes the rollover allocation for 2018. 2. The roll-over allocation amount for the City of Royal Oak under the Local Road Improvement Program will be retained in the Local Road Improvement Matching Program Assigned Fund Balance (GL account #383465) and will require a separate resolution anticipated in 2019 to appropriate funding for reconstruction of Fernlee Avenue project; contingent upon continuation of the program. 3. The funding will be contingent upon the County's distribution from the Michigan General Revenue Sharing Act. Reduction or elimination of the County's distribution of revenue sharing funds may result in the elimination or suspension of the program. 4. No budget amendment is required at this time.
