HomeMy WebLinkAboutResolutions - 1993.03.17 - 23003MISCELLANEOUS RESOLUTION #93033 March 4, 1993 BY: PUBLIC SERVICES COMMITTEE, LAWRENCE A OBRECHT, CHAIRPERSON IN RE: CIRCUIT COURT - STATE COURT ADMINISTRATIVE OFFICE ANTI-DRUG ABUSE GRANT ACCEPTANCE TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies, and Gentlemen: WHEREAS the Circuit Court has applied for a grant from the State Court Administrative Office (SCAO) in the amount of $20,655 of which 75% would be funded by the SCAO and the balance by the County and; WHEREAS these funds are to provide assistance to trial courts, on the basis of demonstrated need, to expedite the adjudication of drug and drug-related cases; and WHEREAS the Circuit Court has been awarded a judicial support grant to assist in the adjudication of drug and drug-related cases in the amount of $14,000; and WHEREAS $10,500 (75%) is the State portion and $3,500 (25%) is the County match which is included in the Circuit Court's 1993 Adopted Budget; and WHEREAS a visiting judge, outside court reporter services and current Court staff will be assigned to the grant; therefore, no new personnel will be required; and WHEREAS the funds for this grant must be expended by September 30, 1993; and WHEREAS acceptance of this grant does not obligate the County to any future commitment. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the State Court Administrative Office Anti-Drug Abuse Grant in the amount of $14,000. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the grant agreement and to approve amendments and extensions up to fifteen (15) percent variance from the award, consistent with the agreement as originally approved. MCCULLOCH, CHAIRPERSON IN RE: CIRCUIT COURT - STATE COURT ADMINISTRATIVE OFFICE ANTI-DRUG ABUSE GRANT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies, and Gentlemen: Pursuant to Rule XI-G of this Board, the Finance Committee has reviewed Miscellaneous Resolution #93033 and finds: 1. The Circuit Court has been awarded a judicial support grant to assist in the adjudication of drug and drug -related cases in the amount of $14,000. 2. The grant is 75% ($10,500) funded by the State and 25% ($3,500) by the County which is the Circuit Court's 1993 Adopted Budget. 3. A visiting judge, outside court reporter services and current Court staff will be assigned to the grant; therefore, no new personnel are required. 4. Funds from this grant must be expended by September 30, 1993. 5. Corporation Counsel has reviewed and approved the grant contract as to legal sufficiency. 6. MCCULLOCH, CHAIRPERSON IN RE: CIRCUIT COURT - STATE COURT ADMINISTRATIVE OFFICE ANTI- DRUG ABUSE GRANT APPLICATION Pursuant to Miscellaneous Resolution t89105, the Public Services Committee has reviewed the above referenced application and reports as follows: 1) The Circuit Court is requesting funding from the State Court Administrative Office (SCAO) to support a visiting judge and staff to expedite adjudication of drug and drug-related cases. The application requesting funding in the amount of $20,655, which will support a Judge, court reporting services, a Court Clerk I and an Assignment Office Clerk for 45 days. The Circuit Court will utilize a visiting judge, outside court reporting services and existing staff to perform grant functions, no additional County positions are requested. " Of the total grant request 75%, or $15,491, will be funded by the SCAO while 25%, or $5,164, will be County match. Funds are available in the Circuit Court budget to cover the County match. Application and/or acceptance of this grant does not obligate the County to any future commitment. 6) This grant application is included in the County Executive's Contact Review process. A uisi CL1 , 4 on et;01 dl Unexpended Funds In the event a Judicial Support Grant Contract has been awarded and no billings for reimbursement have been received by May, 1993, the State Court Administrative Office will have the authority to reall• .te the funding. Independent Contractor Status Both • . .es of this Judicial Support Grant Contract will be acting in an independent capacity and not as agents, employees, partners, joint ventures, or associates of one another. The employees or agents of one party shall not be deemed or construed to be the agent or employee of the other party for any purpose. Grantee understands and agrees that all persons furnishing services pursuant to this Contract are, for purposes of Workers Compensation liability or other actions of employee- related liability, employees solely of Grantee and not of the State Court Administrative Office or the Michigan Supreme Court. Grantee bears the sole responsibility and liability for furnishing Workers Compensation benefits to any person for injuries arising from or connected with services performed pursuant to this Contract. Indemnification Grantee agrees to indemnify, defend and hold harmless the Michigan Supreme Court, the State Court Administrative Office, their agents, officers, and employees from and against any and all liability expense, including, but not limited to, bodily injury, death, personal injury, or property.. age arising from or connected with Grantee's operations or services performed pursuant to this Judicial Support Grant Contract. Grantee agrees to maintain accounting records following generally accepted accounting principles for the expenditure of funds for the purposes identified in the Application for Judicial Support Projects. Grantee agrees that the Michigan Supreme Court, State Court Administrative Office, the 1 government audit division of the Michigan Department of Treasury, the State Auditor General, or any of their duly autho - representatives shall have access to and the right to audit any pertinent accounting records related to the Contract.
