HomeMy WebLinkAboutResolutions - 2018.05.02 - 23449MISCELLANEOUS RESOLUTION #18142 May 2, 2018 BY: Commissioner Bill Dwyer, Chairperson, Public Services Committee IN RE: SHERIFF'S OFFICE — FY2018 DRUG RECOGNITION EXPERT (ORE) CALL OUT REIMBURSEMENT AGREEMENT — GRANT ACCEPTANCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Sheriff's Office will receive funding from the Office of Highway Safety Planning (OHSP) for the period of October 1, 2017 through September 30, 2018; and WHEREAS this grant funding will be used for the reimbursement of up to four hours of overtime to Michigan certified Drug Recognition Experts (DRE) in good standing to respond to a request for service related to drugged driving cases; and WHEREAS no county match is required; and WHEREAS the grant agreement has completed the Grant Review Process in accordance with the Board of Commissioners Grant Acceptance Procedures. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the funding from the Office of Highway Safety Planning (OHSP) for the period of October 1, 2017 through September 30, 2018. BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to execute the grant agreement and to approve any grant extensions or changes, within fifteen percent (15%) of the original award, which are consistent with the original agreement as approved. BE IT FURTHER RESOLVED that acceptance of this grant funding does not obligate the County to any future commitment and continuation of this program is contingent upon future levels of grant funding. Corporation Counsel approves.— Sharon Barnes (4/3/18) 3115/2018 MSP - ORE - Drug Recognition Expert Program RECRUITING AND SELECTION SPECIAL OPERATIONS STATE 911 COMMITTEE TRAINING DIVISION MSP DIVISIONS OFFICE OF HIGHWAY SAFETY PLANNING LAW ENFORCEMENT PROGRAMS ORE - Drug Recognition Expert Program The top tier of the OWI Pyramid is the Drug Recognition Expert (DRE) training program. DRE training is advanced training for highly motivated officers active in OM enforcement. This program offers an academically challenging curriculum developed to enhance an officers ability to identify, evaluate, and document suspected drug impairment. Officers that successfully complete the training often times become the leader in alcohol and or drug impairment within their department and communities. DRE students will learn about the seven drug categories, human physiology and the signs and symptoms as they relate to the drug impaired driver. Students will also learn to conduct a standardized and systematic twelve step evaluation of a drug impaired driver and determine the category of drugs most likely causing that impairment. DRE training consists of three phases. Phase I and Phase II involve seventy two hours (two weeks) of classroom lecture and hands-on instruction. Phase III involves 40 hours of field training during which officers are required to perform evaluations on subjects known to be under the influence of drugs and or drug alcohol combinations. Field training may occur at out of state locations. DRE students are required to maintain minimum scores of 80% on quizzes and exams to complete the course. Students that fail to meet the minimum passing scores will be asked to leave the program. A DRE certification is valid for two years. To recertify, DREs must conduct a minimum of four enforcement evaluations, one DRE-instructor supervised evaluation, be current in the data tracking system, and complete a minimum of eight hours of DRE related continuing education training within that two year period. Due to the nature of DRE training, class size is limited. Not everyone that applies to DRE School will be selected. The DRE steering committee will review all completed applications and select the students for the training. Registration, materials and travel costs associated with DRE training are covered or reimbursed through the federal grant however officer time is NOT covered or reimbursed. ORE School Application process: Applications for the 2018 DRE School will be accepted beginning September 1 through October 31, 2017. Officers are encouraged to submit OWI reports that demonstrate use of the SFSTs. Eligibility for overtime reimbursement is listed below: Michigan State Police DREs Only: 1. Beginning October 1, 2017, continue with the same OT process as in 2017. a. You must submit the required ORE call out documentation to the OHSP Traffic Enforcement Grant project director and cc the State DRE Program Coordinator. Non-Michigan State Police DREs Only: 1. Beginning October 1, 2017, submit all required OT documentation to the State DRE Program Coordinator ONLY. 2. In addition to the DRE call out documentation, you must include a copy of the Officer Reimbursement Spreadsheet and a copy of the General Ledger showing that activity. a. The Officer Reimbursement Spreadsheet should match the General Ledger b. Your financial department will have the General Ledger documentation detailing the exact payout for that DRE call out activity. c. The ORE call out documentation, Officer Reimbursement Spreadsheet and General Ledger must be submitted all at one time. All DREs: 1. Required DRE call out documentation includes; DRE OT Daily, ORE Facesheet, and a copy of the DRE's work schedule 2. You must abide by the ORE requirements for a call out listed in the attached policy 3. The DRE Daily MUST be signed by a supervisor 4. Court time as a result of a DRE call out is not reimbursable 5. All required documentation must be received at one time 6. Mileage for personal vehicle usage is not reimbursable in 2018 7. This is a reimbursement grant. The agency will pay the overtime initially and request reimbursement afterwards 8. The authorized overtime rate is the officers overtime rate at the time including fringe benefits a. *Fringe benefit costs that are fixed or a capped monthly amount, like health insurance and or unemployment, cannot be charged to the grant. Only those fringe benefit costs that actually increase as a result of hours worked on this overtime can be claimed for reimbursement. Usually, RCA, workers compensation and retirement. 9. Although we strongly encourage DREs to respond if available, signing this understanding does not mandate the agency send their ORE when requested. Authorizing Department Official Signature Dote 2018 OHSP DRE Caliout Policy Overtime reimbursement is provided to Drug Recognition Experts (DRE) to increase response to requests for assistance with drugged driving cases. Who is eligible for DRE Overtime Funding: (All must apply) 1. Certified DRE in good standing. 2. DRE is off- duty and eligible for overtime. What is reimbursed: 1, Up to 4 hours of overtime per callout. a. Court time due to DRE callout is NOT reimbursed. All MSP DREs: MSP DRE must submit to the Traffic Enforcement Grant Project Director and cc the DRE State DRE Coordinator: 1. Completed Officer Daily a) DRE Daily must be signed by a supervisor 2. DRE face sheet. 3. Copy of work schedule verifying off-duty status. All non-MSP DREs: DRE must submit to the DRE State DRE Coordinator ONLY: 1. Completed Officer Daily a. Listed below is clarification of what is acceptable and required financial supporting documentation; 1. DRE Grant OT reimbursement funding consists of federal funding. 2. Grant Management Requirements (GMR's) requires ALL federal funding to be tracked separately on the General Ledger. 3. The separate General Ledger federal funding account line for your agency must show Payables (amount paid to officer for overtime) and Receivables (amount requested from OHSP for reimbursement). Both amounts should balance. 4. A copy of the General Ledger page showing exactly what you were paid in overtime for that callout is considered acceptable supporting financial documentation 5. Payable tracks exactly what you were paid for overtime enforcement; Receivable tracks exactly what is being requested from OHSP to cover overtime costs. 6. If this separate General Ledger account line identifies you by name, then the Officer Reimbursement Spreadsheet is not necessary. 7. If this General Ledger account line does not identify you by name, then you must also submit the Officer Reimbursement Spreadsheet. 8. Along with the copy of the General Ledger, the OT Daily, Face Sheet, Work Schedule and Officer Reimbursement Spreadsheet (if applicable) must be submitted to the DRE Program Coordinator NOT your Traffic Enforcement Grant Project Director for reimbursement. Due to the limited number of DREs in the state, this resource must be shared amongst law enforcement agencies. The intent of this pilot project was to limit the financial burden on DRE agencies when they allow their off-duty DRE to respond when requested. This DRE OT reimbursement is available to all police agencies in the state with DREs but they must be willing and or able to follow federal funding guidelines indicated above. If your financial department is unable or unwilling to set up a separate line on the General Ledger to track federal funding Payables and Receivables for you, then your agency will NOT be eligible for OT reimbursement for a ORE Call Out. Resolution authorizes the acceptance of FY 2018 Drug Recognition Expert (DRE) Call Out Reimbursement agreement from the Michigan Office of Highway Safety Planning (OHSP). 2. Funding will be used for the reimbursement of up to four (4) hours of overtime to Michigan certified DREs in good standing to respond to a request for service related to DRE call out events. 3. The amount of reimbursement is unknown as it is based on the number of events. 4. No county match is required. 5. The grant period is October 1, 2017 through September 30, 2018. 6.
