IN RE: SHERIFF'S OFFICE — FY2018 BULLETPROOF VEST PARTNERSHIP (BVP) PROGRAM
GRANT ACCEPTANCE
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the U.S. Department of Justice, Bureau of Justice Assistance Programs, has awarded the
Sheriff's Office grant funding in the amount of $43,013.23 for the period April 1, 2018 through March 31,
2020; and
WHEREAS the reimbursement program provides up to 50% of the cost of bulletproof vests; and
WHEREAS the grant allows reimbursement of costs incurred by the Sheriff's Office for the purchase of
approved bulletproof vests for deputies; and
WHEREAS the grant agreement has completed the Grant Review Process in accordance with the Board
of Commissioners Grant Acceptance Procedures; and
WHEREAS acceptance of this grant does not obligate the County to any future commitment and
continuation of this program is contingent upon future levels of reimbursement program funding.
BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners approves the FY2018
U.S. Department of Justice Bulletproof Vest Partnership Program Grant funding in the amount of
$43,013.23 for the period April 1,2018 through March 31, 2020.
BE IT FURTHER RESOLVED that the Chairperson of the Board of Commissioners is authorized to
execute the grant agreement and to approve any grant extensions or changes, within fifteen percent
(15%) of the original award, which are consistent with the original agreement as approved.

The Bureau of Justice Assistance (BJA) is pleased to inform you that your agency will receive an award
under the Fiscal Year (FY) 2018 Bulletproof Vest Partnership (BVP) solicitation. These funds have been
posted to your account in the BVP System. A complete list of FY 2018 BVP awards is available at:

The FY 2018 award may be used for National Institute of Justice (NW compliant armored vests which
were ordered after April 1, 2018. The deadline to request payments from the FY 2018 award is August
31, 2020, or until all available funds have been requested. Awards will not be extended past that date,
and any unused funds will be forfeited.

SUBJECT: PROTECTIVE VESTS
DISTRIBUTION
H-Sworn Deputies
REFERENCE:
All personnel who have been issued department-approved vests shall wear the
protective vest at all times while on duty. The only exception will be for those
who are assigned to a plain clothes duty or those employees who have signed a
waiver.
11. In the event that he/she elects not to wear a protective vest, he/she must have the
protective vest in his/her possession at all times when on duty; and he/she must
sign a waiver form {copy attached}.
111. In times of a disorder or on direct order of a supervisor, he/she shall wear a
protective vest, even if a waiver form is on file.
IV. The waiver form will be maintained in the individual's personnel file until such time
he/she requests, in writing, removal from said file.
V. Upon removal of the waiver, the wearing of the vest becomes mandatory by virtue
of this order.

WAIVER
, acknowledge the issuance of a protective
vest by the Oakland County Sheriffs Office for my personal protection. I request
the option of wearing the vest at my own discretion, except in times of disorder or
on direct order of my supervisor. In the event that I do not wear the vest, I agree
to have it with me in my possession at all times when on duty.
Subject to applicable laws, regulations, and collective bargaining agreement
provisions, I hereby release, hold harmless and discharge the County of Oakland,
the Sheriff of Oakland County, and all of their agents, officers and employees from
any and all claims, demands and liabilities for injuries arising from my decision not
to wear the Department issued protective vest.
This waiver agreement will remain in effect until I personally request, in writing, a
withdrawal from my file, at which time I realize that the wearing of the vest will be
mandatory in accordance with General Order No. 6.

the Bulletproof Vest Partnership (BVP) Grant program, certify under penaltyof
perjury to the Office of Justice Programs (OJP), U.S. Department of Justice
(Department), that all of the following are true and correct:
a. I have the authority, as chief executive of the applicant to make the following
representations on behalf of myself and the applicant. I understand that these
representations will be relied upon as material in any OJP decision to make an
award to the appiicant based on its application.
b. The applicant has the legal authority to apply for the federal assistance
sought by the application, and that it has funds sufficient to pay any required non-
federal share of project costs.
c. I assure that, throughout the period of performance for the award (if any)
made by OJP based on the application, the applicant wW-
i. with all award requirements and all federal statutes and regulations
applicable to the award;

applicable to the award (if any) made by OJP based on the application
specifically include statutes and regulations pertaining to civil rights and
nondiscrimination, and, in addition-
i, the applicant understands that the applicable statutes pertaining to civil rights will
include section 601 of the Civil Rights Act of 1964 (42 U.S.C. ?? 2000d); section 504
of the Rehabilitation Act of 1973 (29 U.S.C, ?? 794); section 901 of the Education
Amendments of 1972(20 U.S.C. ?? 1681); and section 303 of the Age Discrimination
Act of 1975 (42 U.S.C. ?? 6102);
ii, the applicant understands that the applicable statutes pertaining to
nondiscrimination may include section 815(c) of Title l of the Omnibus Crime Control
and Safe Streets Act of 1968 (42 U.S,C. ?? 3789d(c)); section 1407(e) of the Victims
of Crime Act of 1984 (42 U.S.C. ?? 10604(e)); section 299A(b) of the Juvenile
Justice and Delinquency Prevention Act of 2002 (42 U.S.C. ?? 5672(b)); and that the
grant condition set out at section 40002(b)(13) of the Violence Against Women Act

on behalf of the applicant, I make the specific assurances set out in 28

documentation to support the BVP application and payment requests will be kept
for at least a three year period.

g. I certify that submission of this application for funding under the BVP Grant
Act constitutes the legally binding acceptance by the applicant of the terms and
conditions set forth in the application, and of the BVP program's statutory,
regulatory, and programmatic requirements, restrictions, and conditions.
h. The applicant understands that, in the case of any equipment or products
that may be purchased under an award under the BVP Grant Act, it is the sense
of the Congress that BVP recipients receiving the assistance should, in
expending the award funds, purchase only American-made equipment and
products.

Wearer Measurementand Fitting of Armor"-ASTM Standard E3003-and the Justice
Information Technology Center's "Personal Armor Fit Assessment".

protectivevest that is uniquely fitted to them.
Note: In the BVP Program, "uniquely fitted vests" means protective (ballistic or

best possible fit and coverage, through a combination of 1)correctly-sized panels
and carrier, determined through appropriate measurement, and 2) properly
adjusted straps, harnesses,fasteners, flaps, or other adjustable features. The
requirement that body armor be "uniquely fitted" does not necessarilyrequire
body armor that is individually manufactured based on the measurements of an
individual wearer.

GRANT ACCEPTANCE

Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above referenced
resolution and finds:
1. Resolution authorizes the acceptance of reimbursement funding in the amount of $43,013 from
the U.S. Department of Justice, Bureau of Justice Assistance for the period of April 1, 2018
through March 31, 2020.
2. The reimbursement funding is used toward the purchase of 200 approved bulletproof vests for
Oakland County Sheriff deputies.
3. The reimbursement program provides up to 50% of the cost of bulletproof vests.
4. Application and acceptance of this reimbursement program does not obligate the county to any
future commitment and continuation of this program is contingent upon continued future levels of
funding.
5. The FY 2019 Budget is amended to reflect the grant award as follows:
