IN RE: SHERIFF DEPARTMENT - ACCEPTANCE OF 1994/1995 CHARITABLE
INSTITUTION AGREEMENT
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS the United States Department of Agriculture, through
the Michigan Department of Education, distributes surplus food to
charitable organizations; and
WHEREAS the Oakland County Sheriff Department qualifies as a
charitable organization under the guidelines as is eligible to
receive surplus food; and
WHEREAS receipt of this surplus food reduces County cost for
Sheriff Department operations by decreasing the use of General
Fund dollars to purchase food supplies; and
WHEREAS the agreement has been reviewed through the County
Executives' Contract Review Process.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board
of Commissioners accepts the 1994/1995 Charitable Institution
Agreement with the United States Department of Agriculture and
the Michigan Department of Education.
BE IT FURTHER RESOLVED that the Chairperson of the Board is
authorized to execute said agreement and to approve changes and
extensions with in fifteen (15) percent of the agreement as
originally approved.

SUBJECT: Charitable Institution Agreement
Enclosed are Charitable Institution Agreement forms (SM-4458-CI) so that you may apply for
United States Department of Agriculture (1.1.S.D.A.) donated food items for meals served to
needy persons in your institution for the 1994-95 fiscal year. Your current agreement expires on
October 1, 1994.
The available commodities for Charitable Institutions use for next year will be diminished. As of
this date, butter is the only item slated to be available for fiscal year 1995 although we anticipate
other food items being offered.
If your agency desires to remain in the program, meets the requirements of the Agreement (non-
profit, Federal tax exempt, charitable, etc.), and will abide by its terms, then these forms should be
completed in detail, signed, and returned to our office by SEPTEMBER 12, 1994,
You have received two goldenrod colored Agreement forms, a sponsor page, a site page for each
of your sites and a blank site page for any additions that you may have. All of these must be
returned to be certified for the 1994-95 fiscal year. One copy of the Agreement, along with a
certification sheet (yotfr approval to receive commodities) wiLl be mailed back to you. At that
time, the distribution outlet servicing your area will be notified of your eligibility and they, in turn,
will contact you with instructions on how to order commodities.

DEFINITION OF TERMS:
In accordance wilh the agreement between the Stale of Michigan Department of Education and the United Suites Department of
Agriculture (U.S.D.A.), the above-named recipient agency hereby makes application for food commodities furnished by the
U.S.D.A. to the Michigan Food Distribution Section (hereinafter referred to is the slate agency), and agrees to the following
terms and conditions.
ACCORDING TO THE TERMS OF THIS AGREEMENT, THE DEFINITtON OF AN INSTITUTION IS: A PUBLIC (FEDERAL, STATE OR LOCAL)
OR PRIVATE INSTITUTION, WHICH IS TAX EXEMPT, NONPENAL, NONEDUCATIONAL, NONPROFIT AND CHARITABLE, AND PROVIDES
CARE FOR PERSONS RESIDING WITHIN.

4. To mums all lability and reiponeibility for any toes or damage to commodities caused by tire, water, wind, theft, rodent
or Infestation, dus to their fault or negligenoe.
5. To dispose of seivageble containers In accordance with instructions preecribed by the Slate Agency. Funds accruing
from the sale of containers, salvage of commoditise, or recoveries from !neurone" involving lost donated commodities
shill be used only for the payment of expenses related to the commodity distribution program.
8. That It a common kitchen Is used in the preparation of meals tor patients, Inmates or sten employees, no segregation of
USDA. commodities is necessary.
7. That if Food Service Conn:mules are employed the contracts with such companies will be channeled through the Slats
Agency for approval.
S. That normal food eipenditures will not be reduced because of the receipt of U.S.D.A. donated commodities, nor will they
be Into consideration In preparing their regular Institution food budget.
9. To maintain true and accurate records pertaining to all transactions rotating to the receipt. Inventory and disposal of
commodities. Such records, Including financial records "hall be retained by the Recipient Agency for period of three
(3) years. dating from the -close of the fiscal year to which they pertain, and shell be available during such period for
inspection by representatives ot the Ststa Agency or the U.S.D.A. al a reasonsble thine or piece, and even though there
is a change in personnel. these records are to remain within the office of said Recipient Agency. Further, no record,
"hall be disposed of without written authorization of the Slate Agency. These records "hall contain the following minimum
transactlans.
A record at all commodities received (including the date and quantity) according to the "Delivery Receipt of
Donated Commodities", Form Sal-4221. The Recipient Agency must sign and date all four copiee of the "Delivery Receipt
of U.S.D.A. Donated Commodities", Form $11.4221, In ink or Indelible pencil upon receipt of the commodities, and must
retain a copy for record and audit purposes.
10. To furnish the Stets Agency with an inventory of all U.S.D.A. commodities on hind, upon request of said State Agency.
11. Thal whenever the representative who eigned this !agreement for the institution le replaced, the Institution officiate will
immedisteiy advise the $tate Agericyof said change In edmInistration.
12. That any lime the number at eligible recipients within the Institution citing*" more than ten percent (plus or annum), the
institution shall notify the State Agency immediately; whereby, adiustnnente can be instituted.
13. That either the Recipient Agency or the State Agency may terminate this agreement by giving • 39-day notice in writing
to the other party. The Stale Agency may cancel this agreement immediately upon receipt of evidence that the terms and
conditions %hewn have not been fully complied with. Subnict to such notice of termination or cancellation of this
egreemont, the Recipient Agency agrees to comply with Instructions of the State Agency — either to distribute all remaining
U.S.D.A. commodities in accordance with the provisions of this agreement or to return such inventories to their distribution
outlet upon written authorization as requested by the State Agency no 143.0.A. commodities will be transferred or
destroyed without written permission from the State Agency —and to submit such reports as are required by the Stele
Agency to record final distribution of such inventories. This Is in accordance with regulations assuring the State Agency of
accountability.
14. The recipient agency hereby agrees that It will comply with Tills Viol the Civil Rights Act of 1964 (P.L. 88-352), Title IX
of the Educetion Amendments of 1972, Section 504 of the Rehabilitation Act of 1973 (P.L. 93-112), Age Discrimination
Act of 1973 (P.1.. 94-135) ad all requirements Impaired by the regulations of the Department of Agriculture (7 CFR Part 15),
Department of Justice (28 CFR Parts 42 and 50) and HIS directive" or regulations issued pursuant to that Act and the
regulations. to tha effect that, no person In the United States shalt, on the grounds of race, color, national origin, ape,
sex, or handicap, be excluded from participation In, be denied the benefits of, or be otherwise sublect to discrimination
under any program or activity for which the program applicant received Federal financial asalciance from the Department;
and hereby gives assurance that it will Immediately talks any measures necessary to effectuate this agreement.

grants and donation of Federal property.
The recipient sgancy agrees to compile date, maintain records and submit reports ea required, to permit effective
enforcement at Title VI and permit authorized U.S.O.A. personnel during normal working hours to review Ouch records,
books and accounts as needed to ascertain compliance with Title VI. If there are any violations of thin aseurence, the
Department of Agriculture, Food and Nutrition Service, shall have the right to seek Judiciel enforcement of this
assurance. This assurance Is binding on the recipient agency, Its successors, transferees, and assignees es long is it
receives assistance or retains possession of any assistance from lha Department. Thu parson or persons whose

INSTITUTION AGREEMENT
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
Pursuant to Rule XI-G of this Board, the Finance Committee
has reviewed Miscellanpous Resolution #94328 and finds:
1. The Oakland County Sheriff Department is qualified as a
charitable institution, by the United States Department
of Agriculture and the Michigan Department of
Education, to receive surplus food.
2. Value of the food received through this agreement in
1993 was $84,000. The receipt of this food is a direct
offset to the cost of prisoner care experienced by the
County.
3. While the actual food is free of charge, the Sheriff
Department must cover the cost of food tralimpumiztion.
The annual estimated cost of $18,000 is included in the
Sheriff's budget.
4. Since revenues will match expenses for the food
received, no amendments are recommended to the 1994
Budget. Amendments to the 1995 Budget will be
recommended once the 1994 amounts has been calculated.
