Chairperson, Ladies and Gentlemen:
The Planning and Building Committee, having reviewed the
above-referenced resolution on November 1, 1994, reports with the
recommendation that the resolution be adopted.

IN RE: CENTRAL SERVICES - OAKLAND/TROY AIRPORT - 1994 GRANT
PROGRAM ACCEPTANCE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
WHEREAS the County of Oakland is in receipt of Michigan
Department of Transportation Grant Contracts, Project Nos. C-26-
0118-0194/0294/0394, for Federal funds in the amount of $137,700,
and State funds in the amount of $7,650, for the development and
improvement of Oakland/Troy Airport; and
WHEREAS the planning projects consist of an Airport Master
Plan Update, design engineering, and security fencing; and
WHEREAS the Michigan Department of Transportation has received
a block grant from the Federal Aviation Administration for airport
development projects and shall act as agent on behalf of the County
in the administration of the projects; and
WHEREAS the development projects require a local grant match;
and
WHEREAS the Airport Committee has reviewed and approved the
grant subject to ratification by the Oakland County Board of
Commissioners and believes it to be in the County's interest to
accept the grant; and
WHEREAS the attached contracts have been approved in
accordance with the County Executive's review process.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners accepts the grant in an amount not to exceed
$145,350.
BE IT FURTHER RESOLVED that the Chairperson of the Oakland
County Board of Commissioners or the approved designee is
authorized to execute the grant contracts and to approve grant
modification up to fifteen (15) percent which is consistent with
the original grant contracts.
On behalf of the General Government Committee, I move the
adoption of the foregoing resolution.

GRANT CONTRACT FOR FEDERAL/STATE/LOCAL
AIRPORT DEVELOPMENT
THIS GRANT CONTRACT is made and entered into this date of
, by and between the Michigan Department of Transportation, hereinafter
referred to as the DEPARTMENT, and the Board of County Commissioners of the County of
Oakland, hereinafter referred to as the SPONSOR, for the purpose of fixing the rights and
obligations of the parties in agreeing to the following capital improvements at the Oakland/Troy
Airport in Troy, Michigan, hereinafter referred to as the PROJECT and estimated in detail on
Exhibit 1, dated October 6, 1994, attached hereto and made a part hereof.
Install Security Fencing and Gates all as more completely defined in Contract No. PM 63-
6.C16 as approved by the Department
WITNESSETH:
WHEREAS, the PROJECT is eligible for federal funding pursuant the Airport and Airway
Improvement Act of 1982 as amended and/or the Aviation Safety and Noise Abatement Act of
1979, and
WHEREAS, the DEPARTMENT has received a block grant from the Federal Aviation
Administration (FAA) for airport development projects, and
WHEREAS, the DEPARTMENT is responsible for the allocation and management of
block grant Rinds pursuant to the above noted act,
NOW, THEREFORE, it is agreed:
1. The term PROJECT COST, as herein used, is hereby defined as the cost of the
physical construction necessary for the completion of the PROJECT, including the costs of
preliminary engineering, design engineering, construction supervision, environmental studies and
reports, airport layout plan updates relating to the PROJECT. PROJECT COST shall also include
administrative costs incurred by the DEPARTMENT in connection with the PROJECT.

DESIGN ENGINEERING
THIS GRANT CONTRACT is made and entered into this date of
, by and between the Michigan Department Of Transportation, hereinafter
referred to as the DEPARTMENT, and the Board of County Commissioners of County of
Oakland, hereinafter referred to as the SPONSOR, for the purpose of fixing the rights and
obligations of the parties with regards to the DEPARTMENT granting funds to the SPONSOR
for the preparation of plans and specifications hereinafter referred to as the PROJECT, for the
following improvements at the Oakland/Troy Airport in Troy, Michigan:

W1TNESSETH:
WHEREAS, the PROJECT is eligible for federal funding pursuant the Airport and Airway
Improvement Act of 1982 as amended and/or the Aviation Safety and Noise Abatement Act of
1979, and
WHEREAS, the DEPARTMENT has received a block grant from the Federal Aviation
Administration (FAA) for airport development projects, and
WHEREAS, the DEPARTMENT is responsible for the allocation and management of
block grant funds pursuant to the above noted acts,
NOW, THEREFORE, it is agreed:
1. The term PROJECT COST, as herein used, is hereby defined as all the costs
necessary for the performance of the PROJECT work, and administrative costs as incurred by the
DEPARTMENT in connection with the PROJECT.
THE SPONSOR SHALL:
2. Select a consultant to perform each element of the PROJECT. The contract shall
be between the SPONSOR and the consultant and shall be submitted to the DEPARTMENT for
review and approval. Any such approvals shall not be construed as a warranty of the consultant's
qualifications, professional standing, ability to perform the work being contracted, or financial

IT IS FURTHER AGREED:
11. The PROJECT COST participation is estimated to be as shown below:

The PROJECT COSTS shown here are the maximum obligation of state and
federal funds under this Grant Contract. If the total amount of PROJECT COSTS exceeds the
maximum obligation shown above in this Section, the PROJECT scope will have to be reduced
or a written amendment to this Grant Contract to provide additional funds will have to be
executed by both parties.
The actual DEPARTMENT, FAA, and SPONSOR share of the PROJECT COST
will be determined at the time of financial closure.
12. The PROJECT COST shall be met in part with federal funds granted to the
DEPARTMENT by FAA through the block grant program and State Airport Development Funds.
Upon final settlement of costs, the federal fluids will be applied to the eligible items of PROJECT
COST at the rate of 90 percent up to the maximum obligation shown in section 11. The State
Airport Development funds will be applied to the balance of the PROJECT COST at a rate of
50 percent for those items eligible for state participation up to the maximum obligation shown
in Section 11.
Any items of PROJECT COST not funded with state or federal funds will be the
sole responsibility of the SPONSOR.
13. The SPONSOR hereby agrees the costs reported to the DEPARTMENT for this
Grant Contract shall represent only those items which are properly chargeable in accordance with
this Grant Contract. The SPONSOR also hereby certifies that it has read the Grant Contract
terms and has made itself aware of the applicable laws, regulations, and terms of this Grant
Contract that apply to the reporting of costs incurred under the terms of this Grant Contract.
14. In the event it is determined by the DEPARTMENT that there will be either
insufficient funds or insufficient time to properly administer such funds for the entire PROJECT
or portions thereof, the DEPARTMENT, prior authorizing work performance, may cancel the
PROJECT, or any portion thereof; by giving written notice to the SPONSOR. In the event this
°CCM, this Grant Contract shall be void and of no effect with respect to the cancelled portion
of the PROJECT. Any SPONSOR deposits on the cancelled portion, less PROJECT COST
incurred on the cancelled portions, will be refunded following receipt of a letter from the
SPONSOR requesting excess funds be returned, or at the time of financial closure, whichever
comes first.

THIS GRANT CONTRA CT is made and entered into this date of

TRANSPORTATION, hereinafter rlferred to as the DEPARTMENT, and the Board of County
Commissioners of the County of Oakland, hereinafter referred to as the SPONSOR, for the
purpose of fixing the rights and r oligations of the patties in agreeing to the preparation of an
Airport Master Plan (AMP) at d/or an Airport Layout Plan (ALP) drawings and reports
hereinafter referred to as the PP OJECT and defined in the attached Exhibit 1. The PROJECT
is being performed for the Oak iand Troy Airport in Troy, Michigan.
WITNESSETH:
WHEREAS, the PROJECT is eligible for federal funding pursuant the Airport and Airway
Improvement Act of 1982 as amended and/or the Aviation Safety and Noise Abatement Act of
1979, and
WHEREAS, the DEPARTMENT has received a block grant from the Federal Aviation

WHEREAS, the DEPARTMENT is responsible for the allocation and management of

NOW, THEREFORE, it is agreed:

THE SPONSOR SHALL:

integrity. The SPONSOR shall not execute a consultant contract nor authorize the consultant to
proceed prior to receiving written approval of the contract from the DEPARTMENT.

(d) If any part of the work is subcontracted, the SPONSOR shall assure compliance
with subsections (a), (b), and (0) above for all subcontracted work.
6. Provide, and will require its subcontractors to provide, access by the
DEPARTMENT, the FAA or its representatives, to all technical data, accounting records, reports,
documents, and work in process pertaining to this Grant Contract. Copies of technical data,
reports, and other documents shall be provided by the SPONSOR or its sub-contractors to the
DEPARTMENT and the FAA upon request.
The SPONSOR agrees to permit representatives of the DEPARTMENT and the
FAA to inspect the progress of all PROJECT work at any reasonable time. Such inspections are
for the exclusive use of the DEPARTMENT and are not intended to relieve or negate any of the
SPONSOR'S obligations and duties contained in this Grant Contract.
7. Furnish to the DEPARTMENT written reports, monthly, regarding the employment
of persons, either directly or through subcontract to this Grant Contract, who have retired from
State of Michigan employment pursuant to 194 PA 2 and 3. Reports must comply with the
Report Conditions and meet the Information Requirements set forth in Appendix "D", dated July
18, 1986, attached hereto and made a part hereof.
THE DEPARTMENT SHALL:
8. Bill the SPONSOR for the SPONSOR's share of estimated PROJECT COST. The
DEPARTMENT will not make payments for any PROJECT work prior to receipt of payment
from the SPONSOR for the SPONSOR's share of that item of PROJECT work.
9. Upon receipt of payment request approved by the SPONSOR make payment for
eligible PROJECT COSTS. The DEPARTMENT will seek reimbursement from the FAA,
through the block grant issued to the DEPARTMENT, for funds expended on eligible PROJECT
COSTS.
10. Make final accounting to the SPONSOR upon completion of the PROJECT,
payment of all PROJECT COSTS, and completion of necessary audits. Any excesses or
deficiencies will be returned to or billed to the SPONSOR.

Chairperson, Ladies and Gentlemen:
Pursuant to Rule XI-G of this Board, the Finance Committee
has reviewed Miscellaneous Resolution n4324 and finds:
1) Oakland County has received a Michigan Department of
Transportation Grant Contracts, Project Nos.C-26-0118-
0194/0294/0394, for Federal funds in the amount of
$137,700, and State funds in the amount of $7,650, for
the development and improvement of the Oakland/Troy
Airport.
2) The planning projects consist of an Airport Master Plan
Update, design engineering, and security fencing.
3) County match funds are planned for in the Airport
Capital Improvement Fund and are being requested as a
General Fund appropriation in the amount of $7,650,
consistent with the following budget amendment:
