RE: COMMUNITY DEVELOPMENT- CITIZEN PARTICIPATION PLAN FOR FEDERAL GRANT
PROGRAMS
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS The Federal government, through the Department of Housing and Urban
Development (HUD), in an effort to build and strengthen new partnerships with
state and local governments, the private sector and citizens has consolidated
submission requirements for housing and community developmeuL programs including
the Community Development Block Grant, HOME Investment Partnerships Grant and
Emergency Shelter Grant through the C^Tir -lirlAteri plAtl and Annual Action Plan; and
WHEREAS The consolidated strategy and plan must result from an effective
citizen participation process; and
WHEREAS The Federal government requires urban county recipients of HUD
grant funding to adopt a citizen participation plan that sets forth division
policies and procedures for citizen participation and encourages citizens, non-
profit organizations and other interested parties to participate in the
development of the consolidated plan and annual action plan, any substantial
amendments to the consolidated plan and annual action plan and performance
reports; and
WHEREAS The Citizen Participation Plan must address strategies for citizen
involvement, access to meetings, access to information, technical assistance to
citizen groups, public hearings, timely response to written complaints and
grievances and accommodation of special needs residents; and
WHEREAS Urban Counties having a previously approved citizen participation
plan on file that compl,tes with the Housing and Community Development Act of 1974
prior to March 6, 1995 are allowed 180 days following March 6, 1995 or a period
not to exceed the start of a jurisdiction's program year to adopt a new citizen
participation plan that complies with the new federal rules and regulations
governing the consolidated submission for community planning and development
programs, 24 CFR 91.105 dated January 5, 1995; and
WHEREAS Oakland County prepared the 1995-2040 Conaclidar-esialan and Annual
Action Plan in compliance with the federal citizen participation requirements
governing the consolidated submission for community planning and development
programs; and
WHEREAS The Citizens Advisory Council for Community Development recommended
adoption of the Citizen Participation Plan on April 5, 1995.
NOW THEREFORE BE IT RESOLVED That the Oakland County Board of Commissioners
adopt the Oakland County Community Development Division Citizen Participation
Plan for community planning and development programs.
Chairperson, on behalf of the Planning and Building Committee, I move the
adoption of the foregoing resolution.
OAKLAND COUNTY COMMUNITY DEVELOPMENT
CITIZEN PARTICIPATION PLAN
FOR FEDERALLY FUNDED PROGRAMS
I. Introduction
In accordance with federal rules and regulations at 24 CFR 91.105 et seq., the County
of Oakland implements the following Citizen Participation Plan for housing and community
development activities including, but not limited to, activities financed under the
Community Development Block Grant (CDBG), HOME Investment Partnerships (HOME),
and Emergency Shelter Grant (ESG) program, This Citizen Participation Plan also
applies to the development and implementation of the Consolidated Plan, which is the
master planning document for the County's housing and community development needs
and the above-mentioned programs.
Definitions
In the text of this Citizen Participation Plan, the term "plan" shall refer to the Consolidated
Plan only. The Citizen Participation Plan is referred to by its full name and is not
abbreviated in any way. "Performance report" means the Consolidated Plan performance
report. "Amendment," standing alone, means an amendment to the Consolidated Plan.
III. Encouragement of Citizen Participation
Oakland County encourages residents of the communities participating with it in the
CDBG, HOME and ESG programs to participate in the development of the Consolidated
Plan, any amendments to the plan, and the performance report.
Oakland County maximizes citizen participation through a Citizen Advisory Council (CAC)
for housing and community development programs. The council consists of 20 members
appointed by the Oakland County Board of Commissioners who are representatives of
the communities participating in the urban county CDBG program, County Commissioners
and the general public. The members selected represent Oakland County's low and
moderate income population the federal programs are designed to benefit. The CAC
serves in an advisory capacity to County staff and the Oakland County Board of
Commissioners in assessing county federal grant program policies and operations.
IV. Information to be Provided
Oakland County will furnish appropriate information to citizens and/or local
governments regarding the above plan and programs through public hearings,
direct mailings, advertisement in newspapers of general circulation and through the
CAC,
2. Before the County adopts a consolidated plan, it will make information available
to citizens, public agencies, and other groups that includes the amount of
assistance expected and the range of activities that may be undertaken, including
the amount that will benefit very low- and low-income persons and plans to
minimize displacement of persons and to assist any persons displaced.
(Assistance provided to displaced persons will be provided in accordance with the
Uniform Relocation Act and Section 104d Barney Frank Anti-displacement Act)

3. Oakland County will publish a summary of the proposed Consolidated Plan in one
or more newspapers of general circulation and provide copies of the proposed plan
to libraries, government offices, and public places. The summary shall describe
the contents and purpose of the plan and will include a list of the locations at which
copies of the entire plan may be examined.
4. The County shall notify citizens and/or local governments, as appropriate, of the
availability of the Consolidated Plan as adopted, amendments thereto, and the
performance report, as these documents are developed, to afford citizens a
reasonable opportunity to examine contents of same. Citizens shall be notified
through newspaper advertisements.
5. The County will provide a period of not less than 30 days for citizens and/or local
governments to comment on the plan, amendments, or report before submission
to the federal government.
V. Access to Records
Oakland County will provide citizens, public agencies, and other interested parties with
reasonable and timely access to information and records relating to the Consolidated Plan
and use of CDBG, HOME, and ESG funds over the past five years.
VI. Technical Assistance
The County will provide technical assistance to groups representative of very low- and
low-income-persons requesting such assistance in developing funding proposals under
any of the programs covered by the Consolidated Plan, with the level and type of
assistance determined by Oakland County. .4
VII. Public Hearings
1. The County shall hold at least two public hearings annually to obtain citizens'
views, and shall be conducted at a minimum of two different stages of the program
year. Together, the hearings shall address housing and community development
needs, development of proposed activities, and shall review program performance.
At least one of these public hearings shall be held before the proposed
Consolidated Plan is published for comment, in order to obtain citizens' views on
housing and community development needs, including priority non-housing
community development needs.
2. Adequate advance notice shall be given to citizens and/or local governments, as
appropriate, of each hearing, with sufficient information published about the subject
of the hearing to permit informed comment.
3. Public Hearings shall be held at times and locations convenient to potential and
actual beneficiaries, and with accommodation for persons with disabilities.
4. If a significant number of persons unable to understand the English language can
be reasonably expected to attend one or more of the above-mentioned public
hearings, the County shall make sufficient translation services available so that
such persons may understand the proceedings.

VIII. Comments and Complaints
1. Oakland County shall consider any comments or views of citizens and/or local
governments received in writing, or verbally at public hearings, in preparing the
final Consolidated Plan, amendments, or performance report. A summary of these
comments or views, and a summary of any comments or views not accepted and
the reasons therefor, shall be attached to the final Consolidated Plan, amendment,
or performance report.
2. The County shall provide a timely, substantive, and written response to every
written citizen complaint within 15 working days of its receipt.
IX. Criteria for Amendment of the Consolidated Plan
I . Oakland County shall amend its Consolidated Plan whenever it makes a
substantial change in the method or distribution of funds, carries out an activity
using funds from any program covered by the plan (including program income
derived therefrom) not previously described in the annual action plan (which is part
of the Consolidated Plan), or to substantially change the scope, purpose, location,
or beneficiaries of an activity.
2. A "substantial change" shall be defined as a change in amount of funds greater
than fifteen percent of aggregate funds allocated by the County for the appropriate
program (CDBG, HOME, ESG) for the program year in question. Changes in the
scope, purpose, location, or beneficiaries of a project affecting fifteen percent or
less of the aggregate program funds for the program and program year in question
shall not be considered a substantial change.
3. If a substantial change does occur, the County shall make the amendment public
and provide for a comment period as provided for in Section IV, paragraphs 4 and
5.
4. Changes in the use of CDBG funds by local participating communities shall be
proceeded by a public hearing, to be held by the local jurisdiction, and advertised
in the newspaper of greatest local circulation, at minimum. The jurisdiction shall
follow the guidelines of Section VII, paragraphs 2, 3 and 4 when holding public
hearings.
5. The County shall follow the procedures set forth in the preceding paragraph
whenever it makes changes in the use of that portion of CDBG funds allocated to
the County, and when the County makes a change in the method of distribution
of such funds. The authority for changing the CDBG distribution formula rests with
the Oakland County Board of Commissioners and the County Executive.
- X. Adoption of the Citizen Participation Plan
The County shall provide citizens with a reasonable opportunity to comment on the
original Citizen Participation Plan and on any amendments thereto. The Citizen
Participation Plan shall be made public and in a format accessible to persons with
disabilities.
Xl. Use of Citizen Participation Plan
The County shall use the Citizen Participation Plan for all housing and community
development activities, specifically the CDBG, HOME, and ESG programs.
