HomeMy WebLinkAboutResolutions - 1995.04.06 - 24331.April 6, 1995 REPORT (Misc. #95089) RY: GENERAL GOVERNMENT COMMITTEE - KAY SCHMID, CHAIRPERSON IN RE: M.R. #95089, BILLING THE STATE AND FEDERAL GOVERNMENT FOR UNFAIR AND UNFUNDED MANDATES To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: The General Government Committee, having reviewed M.R. 495089 on March 27, 1995, reports with the recommendation that the last BE IT FURTHER RESOLVED paragraph be amended to include that the resolution also be sent to the majority and minority leaders of the Senate, the Speaker of the House and House Minority Leader. Chairperson, on behalf of the General Government Committee, move acceptance of the foregoing Report. GENERAL GOVERNMENT COMMITTEE MISCELLANEOUS RESOLUTION 195089 BY: Dan Devine, Jr., Ruth A. Johnson, Shelley G. Taub IN RE: BILLING THE STATE AND FEDERAL GOVERNMENT FOR UNFAIR AND UNFUNDED MANDATES To the Oakland County Board of Commissioners, Chairperson, Ladies and Gentlemen: WHEREAS, Figrnrinally, the federal government of the United States and the State of Michigan legislature have passed laws, rules and regulations that require county and municipal governments to carry out specific actions; and, WHEREAS, In order to keep their budgets low, the state and federal government have not provided the necessary funds to carry out their mandated activities; and, WHEREAS, County, city, township and village governments must comply with the unfunded mandates; and, WHEREAS, local taxes often must be increased in order to comply with the unfunded requirements; and, WHEREAS, in many cases, the unfunded mandates would not be passed by local governments; and WHEREAS, many of these laws, rules and regulations are very inefficient, very expensive and frequently stymies business growth; and WHEREAS, the Oakland County Board of Commissioners strongly opposes the continuation and enactment of new unfunded legislation; and, WHEREAS, the Oakland County Board of Commissioners passed Miscellaneous Resolution #93047 on April 29, 1993, supporting H.R. 140 that protected states and localities from future unfunded federal mandates by making any new requirements applicable only if all funds necessary to pay the direct costs incurred are provided by the federal government; and, WHEREAS, the Oakland County Board of Commissioners passed Miscellaneous Resolution #93209 on October 21, 1993, opposing unfunded state and federal mandates; and, WHEREAS, the Oakland County Board of Commissioners passed Miscellaneous Resolution #95013 on February 9, 1995, opposing federal unfunded mandates; and WHEREAS, Oakland County residents, businesses and government continue to be unduly burdened financially by unfunded mandates. NOW THEREFORE BE IT RESOLVED that beginning in June, 1995, the Oakland County Board of Commissioners will bill on a monthly basis the Federal and State governments for costs net of expenses related to meeting the requirements of unfunded mandates. BE IT FURTHER RESOLVED that a copy of this resolution be sent to the President of the United States, Governor of the State of Michigan, Oakland County's delegation of Federal and State legislators and the Michigan Association of Counties.
