PALMER, CHAIRPERSON IN RE: DEPARTMENT OF FACILITIES MANAGEMENT, REAL ESTATE SECTION LEASE AGREEMENT WITH THE OAKLAND COUNTY ROAD COMMISSION FOR OAKLAND COUNTY TREASURER OFFICE SPACE TO: OAKLAND COUNTY BOARD OF COMMISSIONERS, MR. CHAIRPERSON, LADIES, AND GENTLEMEN: WHEREAS the County of Oakland, by Resolution 90136, dated June 14, 1990, renewed a Lease for approximately 427 square feet of office space at the Oakland County Road Commission building, 31001 Lahser Road, Beverly Hills, Michigan, for the Oakland County Treasurer, for a term of five (5) years, commencing on the first day of May 1990 and terminating on the 30th day of April :995; and WHEREAS the Oakland County Treasurer desires to continue to provide a satellite office and supports the rental of said office space as being in the best interests of the public; and WHEREAS the Road Commission has submitted the attached Lease Agreement tor the period of May 1, 1995, through April 30, 2000, which provides for the payment of $3,100.00 per year to defray the costs of maintenance, custodial services and utilities. NOW THEREFORE BE 17 RESOLVED that the Oakland County Board of Commissioners approves the Lease Agreement between the Oakland County Road Commission and the County of Oakland for 427 square feet of office space for the Oakland County Treasurer for a term of five (5) years, commencing May 1, 1995, and ending April 30, 2000, at the sum of $3,100.00 per year. BE IT FURTHER RESOLVED that the Board directs its Chairperson to execute the Lease Agreement, a copy of which is attached hereto. VITNESSETH: WHEREAS, the Lessor is the owner of certain real property and building. known and designated as 31001 Lahser Road, Deverly Hills, Michigan, which is a pert of the properties owned and used by the Lessor as administrative office, for the Road Commission for Oakland County; and WHEREAS, since 1976, the Lessor has leased a portion of said property and building to the County of Oakland for use as a satellite office of the Oakland County Treasurer; and WHEREAS. the current lease expires OA April 30, 1995; and moilhs, Lome wishes to execute another Agreement to Lease approximately 427 square feet of office space in said building, for the purpose of providing a satellite office of the Oakland County Treasurer; and WHEREAS, in the opinion of the Lessor and the Lessee, the lease of such office space, in accordance with the terms and conditions set forth herein. would be in the best interests of the public. NOV, THEREFORE, IR CONSIDERATION OF THE MUTUAL COVENANTS SET FORTH HEREIN. IT IS MuTtIALLT AGREED BY THE PARTIES HERETO. AS FOLLOWS: 1. The Lessor does hereby lease to the Lessee, mub3ect to the terms 4nd conditions hereinafter set forth, approximately 427 square feet of office space on the ground floor of the Lessor's building located at 31001 Lahser Road, Beverly Hills, Michigan, for use as a satellite office of the Oakland County Treasurer, for a term of five (5) years, commencing an the lit day of May 1995, and ending on the 30th day of April, 200o, 2. The Lessor shall proi4dv mlintenance and custodial services, together with all heat, electricity and other utilities, except telephone service, for such leased office space. 4. The tess.. shall pay annually to UMW, an amount equal to the 'mutton/nee. custodial and utility costs incurred by the Lessor, attributable to the leased °Mee space. together with all other variable costs associated with the LO3Bor$ operation and maintenance of the building within 'which the leased office space is located; which costs, to be paid by Lessee hereunder, are currently determined to be approximately Three Thousand One Hundred Dollar's (33,100) per year and which shall be payable by Lessee on May 1. of each year during the ecru of this Lease, commencing on May 1, 1995. S. Lessor agrees to provide two (2) deeignated employee parking spaces for the exclusive use of the employees of the Lessee assigned to the Oakland County Treasurer's Office. 6. Lessor agrees to provide the appropriate signs and/or directories inside and outside the building. indicating the directions to and location of the satellite Oaklahd county Treasurer's Office. 7. The Lessor agrees to permit the employees of the Lessee assigned to the Oakland County Treasurer's Office to use Lessor's vault. S. Lessor agrees to provide utility epace to house data processing modems; such space is not considered a part of the leased office space, but shall be additional space in the Lessor's general utility area. 9. IT Is MUTUALLY AGE= between the parties hereto that neither the Lessor, nor its employees, shall be held liable for any theft or loss or any other claims, injury or damage incurred by the County of Oakland or the Oakland County Treasurer, or any other person, as a result of or arieing odt of the occupancy or use at the leased office space. 10. IT IS MUIR MUALLY ACRED that the parties hereto may renew this lease, according to terms and conditions which may be mutually agreed upon by the parties. 11. Any provisions in this Lease Agreement to the contrary notwithstanding. Lessor and the Lessee expressly reserves the right to terminate this Lease, upon Sixty (60) days written notice to the other party. Lessor shall sell Ite property known as 31001 Labser Road, Beverly Mills. Michigan, or enter into an Agreement to sell said property; or B. Lessor determines that the leased office space, which is the subject of this Agreement, is needed by the Lessor for its own use; or C. Lessee determines that the leased office °pace, which is the subject of this agreement, is no longer needed by the Lessee for use as a satellite office of the Oakland County Treasurer. U. In the event this Lease is terminated. pursuant to paragraph 11. Lessor shall refund to Loewe. if applicable. an appropriate prorated portion of any payments previously made by Lessee in accordance with the provisions of paragraph 4 above. McCulloch, Chairperson IN RE: FACILITIES MANAGEMENT, REAL ESTATE SECTION LEASE AGREEMENT WITH THE OAKLAND COUNTY ROAD COMMISSION FOR OAKLAND COUNTY TREASURER OFFICE SPACE - MISCELLANEOUS RESOLUTION #95196 To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: Pursuant to Rule XII-G of this Board, the Finance and Personnel Committee has reviewed Miscellaneous Resolution #95196 and finds: 1) Miscellaneous Resolution 90136, dated June 14, 1990 authorized renewal of a lease for 427 sq. ft. of space for the County Treasurer at the Oakland County Road Commission Building located in Beverly Hills, Michigan for a period of five years terminating on April 30, 1995. 2) The resolution requests authorization to renew the lease agreement for an additional five year period, May 1, 1995 through April 30, 2000, at a rate of 03,100 annually. 3) The following amendment to the 1995 Budget is required: 4-10100-902-01-00-3658 Non-Departmental Rent ($200.00) 4-10100-221-01-00-3658 Rent - County Treasurer $200.00 0 5) The increased cost will be incorporated in the 1996-1997 Biennial Budget for the County Treasurer.
