MCCULLOCH, CHAIRPERSON IN RE: M.R. #95213, BOARD OF COMMISSIONERS - PROCEDURE FOR SALE AND PURCHASE OF PROPERTY (AMENDMENT TO M.R. #91090) TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS: Chairperson, Ladies and Gentlemen: The Finance and Personnel Committee, having reviewed the above-referenced resolution on November 30, 1995, reports that there are no fiscal implications related to its adoption. Law, County Commissioner-District #13 RE: BOARD OF COMMISSIONERS - PROCEDURE FOR SALE AND PURCHASE OF PROPERTY (Amendment to M.R.91090) TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: ' WHEREAS Oakland County Board of Commissioners, by adoption of M.R.91090, has established the procedures for the sale of County property which safeguards the public's interest by establishing a policy that ensures that land will not be sold, purchased or leased at less than appraised value; and WHEREAS M.R. 91090 has been incorporated into the Rules of the Oakland County Board of Commissioners. WHEREAS the charge of M.R.91090 should be clarified to add more inclusive language. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners hereby amends M.R. 91090 per the attached Procedure for Sale and Purchase of Property. All leasing and purchasing of property shall be under the jurisdiction of the Planning & Building Committee and shall be as follows: a. No formal negotiations for the acquisition of any interest in real put-ehaee—e—ftny property, including lease and option to purchase shall be undertaken until such time as the Planning & Building Committee has authorized such negotiations. b. For property acquisition purchaaco under $100,000, the Planning & Building Committee may rely on the Appraisal Staff of the County Equalization Division for the establishment of fair market price. c. For property acquisition purchasco over $100,000 the County Executive, with the concurrence of the Planning & Building Committee, shall employ a real estate appraiser who shall be approved by the American Institute of Real Property Appraisers or shall be a Senior member of the Society of Residential Appraisers, who shall appraise the property under ronRiciprAtinn and submit a written report regarding, the appraisal findings; said appraisal shall have oversight and review by staff. d. No offer to acquire Purchasc may be made prior to the receipt of the necessary appraisals, and no offers to acquire purc,asc shall be made in an amount more than the highest appraised rice, except by a 3/5 vote of the Board of Commissioners elected and serving. e. Purchases for Public Utility Easements shall follow procedures in (b.) and (c.). t. A written environmental assessment pertaining to toxic waste by qualified professionals of real property proposed for purchase in fee or proposed for permanent improvement, excepting rights of way and sewer, water, drainage, or utility easements, shall be obtained prior to making any offer to purchase, provided, however, that this requirement may be waived by a majority vote of the Planning & Building Committee. A sufficient majority having voted therefor, the reports were accepted. Moved by McCulloch supported by Moffitt the resolution be adopted. Moved by McCulloch supported by Law the resolution be amended to coincide with the recommendations in the General Government Committee and Planning and Building Committee Reports. A sufficient majority having voted therefor, the amendments carried.
