HomeMy WebLinkAboutResolutions - 1995.02.09 - 24428February 9, 1994 MISCRTJANROTN RESOLUTION # 95014 BY: GENERAL GOVERNMENT COMMITTEE, KAY SCHMID, CHAIRPERSON IN RE: BOARD OF COMMISSIONERS - OPPOSITION TO UNFUNDED MANDATE FOR ADDITIONAL COUNTY CLERK AND CIRCUIT COURT SERVICES TO THE OAELAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS the State Legislature passed Public Act 61 of 1994, requiring Circuit Courts and County Clerks to provide forms and assistance to individuals pursuing a Domestic Pfetrining Order without the aid of an attorney; and WHEREAS, because domestic violence is prevalent in society, a significant number of individuals are seeking justice through P.A.61, resulting in a commitment of additional time and materials (approx±mately $20,000 annually) provided by the offices of Oakland County Clerk and the 6th Judicial Circuit Court; and WHEREAS the Headlee State rn-mtitiltiewil Tax Limitation Amendment, passed by the voters in 1978, specifies that "The State is prohibited from requiring any new or expanded activities by local yuvLsuiteliLs without full State financing"; and WHEREAS P . A 61 of 1994 violates the intent of the Headlee Amendment since no provision is made for funding this new requirement. NOW THEREFORE BE IT RESOLVED that, although the Oakland County Board of Commissioners recognizes and appreeiAteg the problems of victims of domestic violence, we object to the unfunded mandate imposed by Public Act 61 of 1994 and strongly urge legislative enactment of State appLppriatian to reimburse counties that comply with the requirements of P.A.61. BE IT FURTHER RESOLVED that copies of this resolution be sent to the Governor, the Legislators rep^egenting Oakland County, the Michigan AgRnriatinn of Counties, and the other 82 Michigan Counties.
