MISCELLANEOUS RESOLUTION #95073 March 23, 1995

RE: CORPORATION COUNSEL-AUTHORIZE DRAIN COMMISSIONER TO REQUEST THE RELEASE
OF THE REVERTER RESTRICTION ON LAND OBTAINED FROM THE STATE OF MICHIGAN
(MAYNARD DRAIN PROJECT)
TO: OAKLAND COUNTY BOARD OF COMMISSIONERS,
MR. CHAIRPERSON, LADIES, AND GENTLEMEN:
WHEREAS, Act 223, P.A. 1909, as last amended by Act 196, P.A. 1970
provides for the conveyance of State-owned tax-reverted lands to municipal
units for public purposes, and
WHEREAS, the County of Oakland acquired the West thirty (30) feet of Lot
74 of the Plat of Union Lake Sub., Oakland county records, for public purposes
and when it ceased to be used for public purposes, it shall revert to the
State of Michigan; and
WHEREAS, the Department of Natural Resources has determined that it is
in the best interest of the parties to release the reverter clause and provide
for distribution of all proceeds, if the property is sold, to all the local
taxing units.
HOW THEREFORE BE IT RESOLVED that the Oakland County Drain Commissioner
is authorized to make application to the State of Michigan, Department of
Natural Resources, Real Estate Division for release of the reverter
restriction on said land, and
FURTHER BE IT RESOLVED that the County of Oakland shall set up necessary
procedures and controls to provide for the proper distribution of funds
arising from the subsequent sale of the acquired property in conformity with
the above mentioned acts.
