McCULLOCH, CHAIRPERSON IN RE: DEPARTMENT OF MANAGEMENT AND BUDGET/PURCHASING DIVISION - PURCHASING/CONTRACTING PROCEDURES FOR COMMUNITY MENTAL HEALTH TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Chairperson, Ladies and Gentlemen: WHEREAS through Public Acts 167 and 168 of 1993, the Michigan State Legislature required all local units of government to conduct a sealed competitive bid process for any contract over $20,000 except where the governing body of the local unit of government exempts certain services through a written policy; and WHEREAS on February 10, 1994, the Oakland County Board of Commissioners adopted Miqr(-11Aneraus Resolution #94015 revising the OAKLAND COUNTY PURCHASING POLICIES AND PROCEDURES MANUAL to conform with the requirements of Public Acts 167 and 168 of 1993; and WHEREAS Misr-p11ant-0ns Resolution #94015 further granted the Division of Community Mental Health a temporary exemption to the revised purchasing procedures to allow sufficient time for the Full Management Transition Team to review the impact of the public acts and recommend purchasing procedures for Community Mental Health; and WHEREAS the Full Management Transition Team has recommended to the Community Mental Health Board the proposed purchasing/contracting procedures contained in Attachment A; and WHEREAS the Community Mental Health Board approved the purchasing/contracting procedures as recommended by the Full Management Transition Team on June 21, 1994, and requests the Board of Commissioners include the recommended procedures in the OAKLAND COUNTY PURCHASING POLICIES AND PROCEDURES MANUAL. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners Laaumpolombam into the OAKLAND COUNTY PURCHASING POLICIES AND PROCEDURES MANUAL, the Purchasing/Contracting Procedures for Community Mental Health listed in Attachment A. BE 17 FURTHER RESOLVED that all Community Mental Health contracts for providing of services and capital equipment shall be approved and authorized by the full Community Mental Health Services Board, reviewed by Oakland County Corporation Counsel, and signed by the Chairperson of the Community Mental Health Services Board. Chairperson, on behalf of the Finance Committee, I move the adoption of the foregoing resolution. FINANITCOMMITTEE OAKLAND COUNTY DEPARTMENT OF MANAGEMENT AND BUDGET PURCHASING DIVISION PURCHASING/CONTRACTING PROCEDURES FOR COMMUNITY MENTAL HEALTH I. COMPETITIVE BIDDING FOR SERVICES A. All contracts for services will be competitively bid to re.PponRihIp vendors. The purpose of competitive bidding is to ensure the delivery of the highest quality mental health services to the residents of Oakland County while maintaining the most efficient use of public resources. B. All current and potential service providers who wish to contract with Community Mental Health to provide services must be registered in the Purchasing Division's Master Vendor Bid List (MVBL)file. Unless a provider is part of the MVBL, there is no way to provide notification of available bids. C. Vendor proposals will be evaluated by a Proposal Review Committee appointed by the Community Mental Health Board Chairperson. At a minimum, the Proposal Review Committee will consist of staff members from the Department of Management and Budget and Community Mental Health, a member of the Community Mental Health Board, and representatives of interested stakeholders such as family members and/or consumers. D. Selection criteria will vary depending upon the service to be competitively bid and the desired result. In all cases the welfare of consumers will be the highest priority. E. Recommendations of the Proposal Review Committee will be submitted to the Community Mental Health Board for their approval. The Community Mental Health Board is rPsponsihlp for the selection of contractors. F. New programs associated with full management and approved by the Community Mental Health Board will be bid prior to September 30,1994. Beginning October 1, 1994, competitive bidding for current contracts will be phased-in with one-third of the current contracts bid for the fiscal year beginning October 1, 1994, one- third bid for the fiscal year beginning October 1, 1995 and one-third bid for the fiscal year beginning October 1, 1996. G. Efforts will be made to structure contracts in such a manner as to encourage the opportunity for consumer choice in services delivered. H. Annually, Community Mental Health will conduct an in- service meeting with all service providers. At a minimum the meeting will cover: 1. Explanation of CMH requirements that apply to providers; 2. New Federal, State, and County requirements. The information transmitted in this meeting is not meant to absolve the service provider of their knowledge and compliance with Federal, State and County requirements. Attendance shall be mandatory for continuation of a contract. II. CONTRACT FORMAT A. Contracts for service provision will extend over a multi-year period. Standard contract length to be three (3) years. Contracts may be extended to five (5) years to meet continuing care needs of consumers, with Community Mental Health Board approval. B. Per Board of Commissioner policy, contracts will be converted to a "fee for service" basis at the earliest practical moment, as appropriate. The fee contract will include a "not to exceed" amount, hourly rates for specific services (or other rate basis), and a detailed scope of work statement. C. All contracts will be reviewed by Corporation Counsel to ensure compliance with applicable state law, specifically the Mental Health Code, and local ordinance prior to submission to the CMH Board for approval. D. ReLplomn.s111.t.i.e.s in contract development: 1. Community Mental Health Responsibilities: a. Develop the scope of work statement; b. Develop and conduct contractor performduce measurements. 2. Purchasing Division Responsibilities: a. Develop, from information provided by Community Mental Health, appropriate Request of Proposal or Request for Bid documents; b. Send documents to vendors, conduct vendor conferences, officially receive bids. c. Work with Corporation Counsel to insure that all contracts are in conformance with applicable state law, local ordinance and specific Mental Health Code. Moved by Taub supported by Gosling the resolution be amended in the Purchasing/Contracting Procedures for Community Mental Health, Section II (CONTRACT FORMAT), Item D (Responaihi.l.i.ti.as in contract development),. Item 1(b), by changing the line so it reads as follows: "Develop and conduct contract performance measurements to include quality assurance measures." A sufficient majority having voted therefor, the amendment carried.
